Van Milligen, City Manager SUBJECT: 5th and Bluff Restroom - Project Acceptance DATE: January 8, 2014 Dubuque band AI- America City 1 2007 • 2012 • 2013 Building Services Manager Rich Russell is recommending acceptance of the construction contract for the 5th and Bluff Restroom Project, as completed by Portzen Construction, in the final contract amount of $381,059, which is $12,059 over the original contract amount of $369,000. The additional expense is due to unforeseen soil issues, sodding instead of seeding, painting of the electrical meter box and a child seat in family restroom. Van Milligen, City Manager FROM: Rich Russell, Building Services Manager DATE: January 7, 2014 RE: 5th and Bluff Restroom— Project Acceptance INTRODUCTION Dubuque Itutri All-America City 1111 r 2007 • 2012 • 2013 The enclosed resolution provides for the acceptance of the construction contract for the 5th and Bluff Restroom project. BACKGROUND On April 15, 2013, the City Council approved the plans and specs for this project. On May 19, 2013, the City Council awarded the project to Portzen Construction. DISCUSSION On November 27, 2013, the 5th and Bluff Restroom project was completed by Portzen Construction of Dubuque, Iowa in the final contract amount of $381,059, which is above the original contract amount of $369,000. The additional expense is due to unforeseen soil issues, sodding instead of seeding, painting of the electrical meter box and a child seat in family restroom. The $12,059 in additional funding will come from the City Hall Remodeling CIP. Significant savings were seen as a result of the City Hall Envelope Restoration Project. There are a few outstanding items, but they are outside the scope of the contract documents. They include: screws penetrating the porch roof, door lintels need paint and stain the floors for a more consistent appearance. These items will be completed when weather permits. RECOMMENDATION I recommend that the City Council accept the public improvements and authorize the final payment of the contract amount of $381,059 to Portzen Construction for the 5th and Bluff Restroom project. ACTION TO BE TAKEN I respectfully request that the City Council adopt the attached resolution to accept the public improvements for and to authorize the final payment of the contract amount of $381,059 to Portzen Construction for the 5th and Bluff Restroom project. 2 RESOLUTION NO. 11 -14 ACCEPTING THE 5th AND BLUFF RESTROOM PROJECT AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR Whereas, the Public Improvement Contract for the 5th and Bluff Restroom Project (the Project) has been completed and the Building Services Manager has examined the work and recommends that the Project be accepted; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the Building Services Manager is approved and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor the contract amount of $381,059, less any retained percentage provided for therein as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
