BACKGROUND In October 2011, the City of Dubuque received a grant award of $8 million through the State of Good Repair (SOGR) program for the construction of a new Dubuque Intermodal Facility. The Federal Transit Authority (FTA) requires all parking spaces constructed using SOGR funds must be used for daily transit user parking only and cannot be used for non - transit users. The FTA will require the City to repay the SOGR funds used on the transit parking if there is a misuse or underuse of the transit spaces. The City will construct the remaining 200 non - transit spaces using City funds. This scenario allows the City to meet FTA requirements and meet the future parking needs of the Historic Millwork District (HMD). This scenario also requires the City to acquire the land from the Iowa Department of Transportation (Iowa DOT). On July 1, 2013 the FTA Region VII accepted the Feasibility Study for the proposed Dubuque Intermodal Facility. The FTA's acceptance allowed City to incur costs and move forward with final design. The approved Feasibility Study states that the City will own and operate the facility with the 200 non - transit spaces on the first and third levels and the 92 transit spaces on the second level. The 200 non - transit spaces will not be under FTA jurisdiction and will be eligible for use by Millwork District customers, residential, and commercial tenants. The 92 spaces in the second level will only be eligible for parking by public transit users. This supports the design of the Intermodal Center where a walkway will be constructed on the second floor, crossing Elm Street, and connecting the parking facility to the offices in the terminal building. PROJECT DEVELOPMENT SCHEDULE The City has started the final design process for the Dubuque Intermodal Facility. The initiation of the public bidding process for the construction of the Intermodal Transportation Center is tentatively scheduled for a City Council meeting in March. Currently, construction documents are 90% complete and the final cost estimate from Neumann Monson Architects (NMA) will be provided by early February. The Federal Transit Administration, who is providing $5,719,043 of the anticipated $12,560,594 overall project cost, typically will not allow the construction bid process to begin until all property has been purchased. To expedite project development schedule, the City received approval from FTA to initiate bidding in conjunction with the continuation of property procurement from the State. PROPERTY ACQUISITION The proposed location of the Intermodal Facility will be on a portion of properties that are currently owned by the State of Iowa. The City initiated discussions with the Iowa DOT regarding the disposal of the excess State of Iowa property. The Iowa DOT acknowledged they had no remaining interest in said property and agreed to dispose of said public property as permitted by Iowa Code. The three (3) State of Iowa properties that are impacted by the Intermodal Transportation Center project are identified as Parcel 254 (former Jacobson Steel), Parcel 293 (former Interstate Power) and Parcel 293A (former Pine Street, City of Dubuque). First, the Iowa DOT has the properties appraised to establish the current fair market value. Second, the original owners of said property are offered the opportunity to purchase the property at the appraised value. The original property owners are given 60 days to either accept the offer or decline via waiving their rights of interest. If the original property owner declines, the next step is for the State to offer said property to the local governmental entities. Parkingscenarios fo1 Dubuque Intermodal Transportation Center Page 3 Regarding the disposal and sale of excess State of Iowa property for the Intermodal Facility, all the previous original owners (Jacobson Steel and Interstate Power) declined the offers to buy and the Iowa DOT has now issued the formal Offer to Buy said properties to the City of Dubuque. The following is a summary of the three (3) State of Iowa properties and the associated Offer to Buy amounts which are based on the appraised valuation: Parcel Summary P Offered Purchase Price Parcel 254 (former Jacobson Steel) $400,000 Parcel 293 (former Interstate Power) $70,000 Parcel 293A (former Pine Street, City of Dubuque) $25,000 Total Acquisition Cost $495,000 Initially, the Intermodal Transportation Center budget included $100,000 for property acquisition based on the assumption that the State would dispose of the property at a reduced cost due to the "Transportation" purpose of the intermodal facility. However, based on a ruling by the Office of the Attorney General, since the property is not for a highway or bridge project, the dispose of said public property would need to follow the process per Iowa Code. RECOMMENDATION City staff is recommending accepting the State of Iowa's Offers for Buy for the three (3) properties that are identified for the Intermodal Transportation Center. Based on Iowa Code, the Offers for Buy amounts are based on Certified Appraisal and Review Appraisal valuations of the current market value. The Federal Transit Administration has authorized the City proceed with initiating the public bidding process for the construction of the Intermodal Transportation Center, concurrently while the City completes the purchase of property form the State of Iowa. BUDGET IMPACT The City has sufficient funding in the Historic Millwork District Parking Improvements CIP to cover the cost of the property acquisition.
