SUBJECT: Chaplain Schmitt Memorial Project, CIP Project #1777
Sealed bids were received for the Chaplain Schmitt Memorial Project. Leisure Services
Manager Gil Spence recommends award of the contract to Tri-State Development, LLC
in the amount of $60,793, as they were the low bidder for the total project, which
included the Base Bid and Alternates 1 and 2.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Chaplain Schmitt Memorial Project, CIP Project #1777
INTRODUCTION
The purpose of this memorandum is to request that the City Council award a contract to
Tri-State Development Company, LLC for construction of the Chaplain Schmitt
Memorial Project.
DISCUSSION
Bids were received on January 4, 2007 for construction of the Chaplain Schmitt
Memorial Project. A summary of the bids received is as follows:

The City has $40,000 budgeted in the Fiscal Year 2007 C.I.P. budget and the Navy
League has a $20,000 DRA Grant and $5,000 in cash, and will raise the remaining
funds. The architect's estimate for the base bid and alternates 1 and 2 was $80,000.
The base bid of this project includes the oval part of the attached design. Alternate #1
is the ship garden and Alternate #2 switches the concrete from regular gray to colored
(Navy Gray) concrete.
A summary of the project cost estimates is as follows:

RECOMMENDATION
I recommend that a contract be awarded to Tri-State Development, LLC in the amount
of $60,793.
ACTION STEP
The action requested is that the City Council adopt the attached resolutions awarding a
contract to Tri-State Development, LLC in the amount of $60,793 for construction of the
Chaplain Schmitt Memorial.

RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
WHEREAS, on the 4th day of December, 2006, plans, specifications, form of
contract and estimated cost were filed with the City Clerk of Dubuque, Iowa for the
Chaplain Schmitt Memorial Project.
WHEREAS, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are hereby
approved as the plans, specifications, form of contract and estimated cost for said
improvements for said project.

WHEREAS, notice of hearing on plans, specifications, form of contract, and

WHEREAS, sealed proposals have been submitted by contractors for the Chaplain
Schmitt Memorial Project pursuant to Resolution No. 582-06, and notice to bidders
published in a newspaper published in the City of Dubuque, Iowa, on the 8th day of
December, 2006.
WHEREAS, said sealed proposals were opened and read on the 4th day of
January, 2007, and it has been determined that the bid of Tri-State Development, LLC in
the amount of $60,793 was the lowest bid for the furnishings of all labor and materials and
performing the work as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Tri-State Development,
LLC, and the Manager be and is hereby directed to execute a contract on behalf ofthe City
of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's bond, the
City Treasurer is authorized and instructed to return the bid deposits of the unsuccessful
bidders.
