SUBJECT: Eagle Point Park Concrete Replacement Projects, #1762 and #1763
Leisure Services Manager Gil Spence is recommending acceptance of the Eagle Point
Park Concrete Replacement Project, as completed by Kluck Construction, in the final
contract amount of $91,312.75, which is $31,452.75 over the bid amount due to Change
Order #1 for additional concrete replacement at the Shiras Memorial Pavilion
($2,983.53); and Change Order #2 at the East Porch of the Riverfront Pavilion for
changing the railing paint from regular painting process to powder coating ($4,655.28),
removal of the concrete around the entire Riverfront Pavilion and replacement of the 4"
x 6" wood support around the entire building ($21,668.88), and additional saw cuts and
caulking ($2,145.06).
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Eagle Point Park Concrete Replacement Projects, #1762 and #1763
INTRODUCTION
The purpose of this memorandum is to recommend that the City Council accept the
Eagle Point Park Concrete Replacement Project.
DISCUSSION
The Eagle Point Park Concrete Replacement Project has been completed by Kluck
Construction in the final contract amount of $91,312.75. This project combined two CIP
projects, concrete replacement on the East Porch of the Riverfront Pavilion and Shiras
Memorial Pavilion. A summary of the project costs is as follows:

Change order #1 provided additional concrete replacement at the Shiras Memorial
Pavilion. Change order #2 was all at the East Porch and included: changing the railing

concrete around the entire Riverfront Pavilion and replacement of the 4" x 6" wood
support around the entire building ($21,668.88), and additional saw cuts and caulking

The CIP budget contains $80,000 for these projects. The following is a summary of the
project costs:

The project is $15,357.75 over budget. I recommend funds from Eagle Point Park
Stone Work be used to cover this overrun.
ACTION STEP
The action requested is that the City Council adopt the attached resolutions accepting
the improvement and setting the final cost.

RESOLUTION NO. 42-07
ACCEPTING IMPROVEMENT
WHEREAS, the contract for the Eagle Point Park Concrete Replacement Project
has been completed and the City Manager has examined the work and filed his certificate
stating that the same has been completed according to the terms of the contract, plans and
specifications and recommends its acceptance.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
1. That. the recommendation of the City Manager be approved and that said
improvement be and the same is hereby accepted.
BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby directed
to pay to the contractor from the General Fund in amount equal to the amount of his
contract, less any retained percentage provided for therein.

RESOLUTION NO. 43-07
FINAL ESTIMATE
WHEREAS, the contract for the Eagle Point Park Concrete Replacement Project
has been completed and the Engineer has submitted his final estimate showing the cost
thereof including the cost of estimates, notices and inspection and all miscellaneous costs;
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the cost of said improvement is hereby determined to be
$91,312.75, and the said amount shall be paid from the General Fund of the City of
Dubuque, Iowa.
Passed, approved and adopted this 5th day of February , 2007.
