CIP#1021825: Eagle Point Bluff Stabilization Project
In October 2006, the City Council initiated the public bidding process for the Eagle Point
Bluff Scaling & Tree Removal project. No bids were received on the project at that time.
Engineering staff contacted several specialized contractors who routinely perform rock
scaling operations, and they suggested that due to the small size of the project, it would
be best to re-bid the project with a March or April schedule.
The project was re-bid with a completion date of April 20, 2007. The sole bidder on the
project was Hi-Tech Rockfall Construction Inc. in the amount of $230,150. This amount
is 360.76% over the estimate of probable cost.
City Engineer Gus Psihoyos recommends rejection of the sole bid for the Eagle Point
Bluff Scaling & Tree Removal Project, and that the project be reviewed to determine the
best manner to re-bid the project at a later date.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
In October, 2006, the City Council initiated the public bidding process for the
Eagle Point Bluff Scaling & Tree Removal Project. No bids were received on the
project at that time.
Engineering contacted three specialized contractors who routinely perform rock
scaling operations: Hi-Tech Rockfall Construction (Forest Grove, Oregon),
Janod, Inc. (Champlain, New York), and Yenter (Arvada, Colorado). To them,
Dubuque's project is a small project. According to the specialized contractors,
their workloads made it impractical to pull crews from current jobs to perform the
work on Dubuque's schedule. Two indicated that a better schedule would be
after the first of the year. The third indicated that a March or April schedule would
work best.
On December 18, 2006, the City Council authorized the public bidding process
for the Eagle Point Bluff Scaling & Tree Removal Project with a completion date
of April 20, 2007.
DISCUSSION
One sealed bid was received on January 16, 2007 for the project. Hi-Tech
Rockfall Construction, Inc. of Forest Grove (Oregon) submitted the low bid in the
amount of $230,150.00. This amount is 360.76% over the estimate of probable
cost.

Engineering will review the project and determine the best manner to re-bid the
Project at a later date. One potential change that will be investigated will be to
split the work up into separate projects. For example, the tree removal portion
could be done as a separate project by local contractors while leaving the rock
scaling operation to specialized crews.
RECOMMENDATION
I recommend rejection of the sole bid for the Eagle Point Bluff Scaling & Tree
Removal Project and that the project be re-bid at a later date.
PROJECT COST -BUDGET IMPACT
With the adoption of the Fiscal Year 2007 Capital Improvement Program Budget,
$350,000 was set aside to stabilize the bluff if deemed appropriate by the City
(CIP 10281825).
ACTION TO BE TAKEN
I recommend that the City Council reject all bids received through the adoption of
the enclosed resolution for the Eagle Point Bluff Scaling & Tree Removal Project.

RESOLUTION NO. 66-07
REJECTING BIDS FOR THE EAGLE POINT BLUFF & TREE REMOVAL
PROJECT
Whereas, sealed proposals have been submitted by contractors for the
Eagle Point Bluff & Tree Removal Project (the Project) pursuant to Resolution
No. 606-06 and notice to bidders published in a newspaper published in the City
of Dubuque, Iowa on the 22"d day of December, 2006.
Whereas, sealed proposals were opened and read on the 16th day of
January, 2007; and
Whereas, the City Council has deemed it advisable to reject all bids and to
re-bid the Project at a later date.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the bids for the above Project be rejected and the City
Treasurer is authorized and instructed to return the bid deposits of all bidders.

Re: Eagle Point Bluff Scaling 8~ Tree Removal Hearing February 5, 2007
I want to thank the Council, Staff and others for their follow-upon my letter of November 2006
which requested clarification of the Bluff Scaling & Tree Removal process.
I also want to thank those involved in the formation of the Bluffland Advisory Committee; I think
this committee will provide Dubuque with valuable input for environmentally friendly growth.
On the one hand Bluffs provide green belts throughout the city that are environmentally beneficial
and inspirational; on the other hand bluffs deteriorate under the forces of nature and people and
require periodic maintenance.
The photos below were taken in November 2006. As Kleinfelder Consulting supervises the
Bluff Scaling and Tree Removal Project it would be helpful to note which actions are
considered routine type maintenance and which are not. For illustrative purposes I've shown the
9th St. Parking Lot bluff which might be an example of a bluff that requires routine maintenance.
