City Clerk's Office • 50 W. 13' Street, Dubuque, IA 52001 • 563.589.4100 Title 2 Chapter 5 Housing Commission 2 -5B -1: COMMISSION CREATED: There is hereby created a housing commission. (2007 Code § 15 -21) 2 -5B -2: PURPOSE; APPROVAL OF PROPOSALS: A. Duties And Responsibilities: The housing commission shall monitor and evaluate city housing needs and shall make recommendations to the city council as to how those needs can be met. In furtherance of this mission, the housing commission's duties and responsibilities shall include, but not be limited to, the following: 1. To contribute as appropriate in the planning, coordinating and review of housing development; 2. To conduct public hearings to ensure meaningful citizen input in the planning, implementation and assessment of the city's housing programs; 3. To provide for and encourage the participation of low and moderate income persons in the planning, implementation and assessment of housing programs; 4. To provide input into the community planning process and to assist in accomplishing a coordinated and consistent housing development program of the city in accordance with present and future housing needs; 5. To request and review ongoing surveys assessing housing needs and identifying future community housing needs, particularly the needs of persons of low and moderate income; 6. To support the efforts of the city council and other city commissions in the assessment of the general housing needs of the community; 7. To undertake from time to time other specific ongoing housing planning which may be referred to it by the city council; 8. To research and recommend to the city council policies and programs facilitating the development of affordable housing; 9. To undertake public information efforts to educate citizens of the availability of federal, state and locally funded housing assistance programs; 10. To assist in the preparation of the housing element of the city comprehensive plan and the annual consolidated plan; 11. To offer comment, as appropriate, on the consistency of proposed housing development with the comprehensive plan, consolidated plan and existing city-housing strategies. B. Project Approval: Any proposed low rent housing project shall be subject to specific approval by the city council and any project requiring a referendum as provided in the code of Iowa shall be submitted to the voters of the city in accordance with the code of Iowa. C. Monitor Housing Program; Conduct Hearings On Grievances: The housing commission shall monitor the city's housing program and conduct hearings on grievances which arise out of the operation of such program except in the area of housing code enforcement. D. Additional Duties: The housing commission shall undertake such additional duties, with regard to the housing trust fund, as are specified in this code. (2007 Code § 15- 22) 2 -5B -3: MEMBERSHIP; VACANCIES; QUALIFICATIONS: A. Membership: The housing commission shall be comprised of ten (10) members. B. Term Of Office: Appointments shall be for a term of three (3) years. C. Vacancies: Vacancy caused by death, resignation or otherwise on the commission shall be promptly filled by the city council for the unexpired term of office. D. Manner Of Selection: At least three (3) members of the commission shall be selected specifically on the basis of experience in real estate development, banking, finance, accounting, funds management or other related areas of expertise. E Member Receiving Rental Assistance: One member of the commission shall be a person who is a recipient of tenant based rental assistance under section 8 of the United States housing act of 1937 (42 USC 14370 whose name appears on a lease of section 8 property and who is eighteen (18) years of age or older. If such member ceases to be a recipient of rental assistance under section 8, the term of such member shall be deemed terminated and a new member who meets the requirements of this subsection shall be appointed for the remainder of the term (2007 Code § 15 -23) 2 -5B -4: MEETINGS: A. Frequency Of Meetings: The housing commission shall meet not less than monthly. B. Attendance Of Members: Members of the commission shall attend at least two - thirds (2/3) of all regularly scheduled and held meetings within a twelve (12) month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the commission to recommend to the city council that the member be replaced. The attendance of all members shall be entered upon the minutes of all meetings. C. Minutes Filed With Clerk: The housing commission shall file with the city clerk a copy of the minutes of each regular and special meeting of the commission within ten (10) working days after each such meeting. (2007 Code § 15 -24) ` 2 -5B -5: COMPENSATION: All members of the commission shall serve without compensation except for reimbursement of necessary expenses. (2007 Code § 15 -25) 2 -5B -6: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as it may deem necessary and which are not in conflict with this article. (2007 Code § 15 -26) 2 -5B -7: PROCEDURES FOR OPERATIONS: All administrative personnel, accounting, budgetary and procurement policies of the city shall govern the commission in all of its operations. (2007 Code § 15 -27) CITY OF DUBUQUE, IOWA BOARD /COMMISSION APPLICATION Individuals serving on Boards and Commissions play an important role in advising the City Council on matters of interest to our community and its future. The City Clerk's Office, City Hall, 50 West 13th Street, Dubuque, IA accepts applications for any Board and /or Commission at any time, and the application stays active for one year from the date of receipt in the Clerk's Office. At the appropriate regularly scheduled meeting, applications will be submitted to the City Council for their review and applicants are encouraged to address the Council stating their reasons for wanting to serve on this particular Board or Commission. Fax CIVIC CENTER ADVISORY COMMISSION 2 -4 -1: COMMISSION CREATED: There is hereby created a civic center advisory commission to have such powers and responsibilities as hereinafter provided. (2007 Code § 13 -11) 2 -4 -2: PURPOSES, OBJECTIVES GENERALLY: A. The commission is charged with development of the optimum utilization of the civic center facility by the widest possible range of users and uses to respond to community needs and demands at the least possible cost to the city. B. It is intended that the commission shall have that authority and responsibility essential to assure that its general purpose is fulfilled subject to this chapter and subject to the approval of the city council in matters of policy. (2007 Code § 13 -12) 2 -4 -3: SPECIFIC PURPOSES: The specific purposes of the civic center advisory commission shall be to: A. Provide the city council as necessary with recommendations that further the general and specific purposes of the commission. B. Develop effective leadership for efficient planning, control and administration of policies and programs to realize optimum use of the civic center. C. Foster the development of financial and other resources to support the short and long term needs of the civic center facility and its programs. D. Develop programs to provide a variety of year round intellectual, cultural, enjoyable and attractive leisure time activities which contribute to the physical and mental well being of residents and visitors. E. Develop programs which contribute to the economic base of the community by encouraging business use of the civic center facility. (2007 Code § 13 -13) 2 -4 -4: DUTIES AND RESPONSIBILITIES: The duties and responsibilities of the commission are as follows: A. Development of an administrative plan and operating policies to assure the maximum effectiveness in the use of all facilities and resources. B. Development of schedules of fees and charges for special building services, equipment, special building features, rental rates, admissions, and concessions. C. Development of informational and promotional programs to secure the full support and participation of the community. D. Development of accurate, timely and understandable financial data and measurements of effectiveness necessary to assure sound policy formulation for operation and management. E. Development of the annual operating budget and an ongoing capital improvements budget. F. Development of a maintenance program to provide a safe, secure, sanitary, clean and attractive facility. G. Serve as a personnel advisory committee to the city manager in the selection of civic center personnel. H. Participate with the Dubuque area chamber of commerce, the hotel and restaurant industry and other interest groups to promote and develop the convention and tourism business for the Dubuque area. 1. Execution of contracts and agreements for the use, operation and maintenance of the civic center facility; contracts and agreements for the use of the facility may be signed by the city manager, except that all contracts for usage of the facility involving a term of longer than five (5) days shall be signed by the mayor with the approval of the city council. (2007 Code § 13 -14) 2 -4 -5: PROGRAMS, PROJECTS AND SERVICES: All programs, projects and services to be developed by the commission must conform to the policies of the city and to applicable local, state and federal laws, rules and regulations. (2007 Code § 13 -15) 2 -4 -6: MEMBERSHIP; APPOINTMENT: A. Membership; Terms: The commission shall be comprised of a membership of five (5) persons, who shall be appointed by the city council for terms of three (3) years. B. Serve Until Successor Appointed: Upon completion of the term of office, a member of the commission shall continue to serve in the member's full capacity until a successor has been duly appointed. (2007 Code § 13 -17) 2 -4 -7: VACANCIES IN MEMBERSHIP: A vacancy caused by death, resignation or otherwise on the commission shall be promptly filled by the city council for the unexpired term of office. (2007 Code § 13 -18) 2 -4 -8: ATTENDANCE AT MEETINGS: A. Frequency of Attendance: Members of the commission shall attend at least two - thirds (2/3) of all regularly scheduled and held meetings within any twelve (12) month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the commission to recommend to the city council that said member be replaced. B. Record of Attendance: The attendance of all commission members shall be entered upon the minutes of all meetings by the secretary. (2007 Code § 13 -19) 2 -4 -9: COMPENSATION: All members of the commission shall serve without compensation except for reimbursement of necessary expenses. (2007 Code § 13 -20) 2 -4 -10: ORGANIZATION; ELECTION OF OFFICERS: A. Officers Designated: The officers of the commission shall be a chairperson, a vice chairperson, and a secretary. All officers shall be members of the commission. B. Election by Commission: At the initial meeting of the commission and at the first meeting of each calendar year thereafter, the commission shall elect the above identified officers to serve one year terms of office. Purpose: The housing code appeals board shall conduct hearings upon application by any person aggrieved by a notice and order of the city manager issued in connection with a violation of this housing code or of any applicable rule or regulation issued pursuant to this housing code. Mechanical Code Board 14 -1f -2: International Mechanical Code Amendments: Section 203, "Board Of Appeals" is hereby amended by repealing such section and replacing such section with a new section in lieu thereof as follows: Section 203. Mechanical Code Board. (a) Board Established. In order to determine the suitability of alternative materials and methods of installation, to provide for reasonable interpretations of the mechanical code, to serve as an appeal body for the decisions of the building official, to advise the city council on all heating, ventilating, air conditioning and refrigeration regulations and procedures, and to provide for examining applicants for certification of competency and issuing certificates of competency and registration, there is hereby created the mechanical code board. (b) Membership. The mechanical code board shall consist of seven (7) members appointed by the city council. Each member shall have a background or experience in sheet metal contracting, hot water and steam fitting contracting, hot water and steam fitting work, refrigeration contracting, refrigeration work, or mechanical engineering. (c) Term Of Office. The term of office of all board members shall be three (3) years. (d) Rules And Regulations. The board shall make such rules and prescribe such procedures as may be reasonably necessary for its operation, except that such rules shall include the following: (1) The chairperson of the board shall be elected annually by a majority of the board. The appeal shall be made by the person aggrieved giving written notice of such appeal to the building official at the building official's office within seven (7) days. The building official shall, within seven (7) days thereafter, notify the board of the appeal.
