Spence, Leisure Services Manage SUBJECT: Miller-Riverview Park Management Agreement INTRODUCTION The purpose of this memorandum is to ask for City Council approval of the management agreement for Miller-Riverview Park with Pat Felderman. DISCUSSION This agreement formalizes the working relationship we have for management of the campground operation. It clearly states what is expected from Pat Felderman and from the City, and works out very well for both parties. Pay to Ms. Felderman is based on the number of camping units served, so that the City is assured it will not lose money on the operation. The Park and Recreation Commission reviewed and approved the agreement at their February 13th meeting. RECOMMENDATION It is recommended that the City Council approve the management agreement for Miller- Riverview Park with Pat Felderman, and authorize the City Manager to sign it. GDS:et attachment LEISURE SERVICES DEPARTMENT City of Dubuque, Iowa MANAGEMENT AGREEMENT FOR CAMPING AT MILLER-RIVERVIEW PARK and DUBUQUE WATER SKI CLUB This agreement, made and entered into this day of , 2007, by and between the City of Dubuque, Iowa, acting through the Park and Recreation Commission, hereinafter called the "City," whose address for the purpose of this agreement is 2200 Bunker Hill Road, Dubuque, Iowa, and Pat Felderman, acting as "agent" of the City, for whom the City is responsible in all respects, hereinafter called "Felderman," whose address for the purpose of this agreement is 1850 Admiral Sheehy Drive, Dubuque, Iowa. It is agreed by and between the parties as follows: The term of this agreement shall be from April 1st to November 1, 2007. This agreement may be terminated by the City with three (3) days' written notice and by Felderman with thirty (30) days' written notice. 2. Felderman will manage the camping operation at Miller-Riverview Park and the Dubuque Ski Club. She shall register all camping units, collect fees, keep accurate and detailed records, and open and close the park. Records shall be made available for review by the City on a monthly basis or as desired by the City. 3. All expenses for operation of the Miller-Riverview Park and campground (only), shall be the responsibility of the City. Said expenses shall include, but are not limited to, electricity, telephone, and rest rooms. 4. General maintenance of the Miller-Riverview Park and campground (only), shall be the responsibility of the City and include, but is not limited to, grass cutting, road maintenance, trash collection, grounds maintenance, and equipment maintenance. 5. Felderman shall supervise the area, including the enforcement of rules, regulations, and ordinances established by the City. This shall include, but is not limited to, the ban on swimming in the river, hours of operation, ban on the consumption of keg beer, ban on sale of alcoholic beverages, and sale of concessions. -1- 1 6. Felderman shall be paid a management fee of $3.00 per camping unit paid per day. Said sum shall be paid by the City on a monthly basis. The City shall not be providing worker's compensation for Felderman. Pay shall be $4.00 per camping unit if Felderman cleans the rest room facility. 7. All funds received in conjunction with the rental of camping facilities shall be turned over to the City. 8. This agreement does not allow for the operation of a concession business or any other type of business without written approval of the Leisure Services Manager. Felderman will manage the park in such a reasonable manner as to enhance the reputation of the City and will not do anything which might unreasonably damage that reputation.
