SUBJECT: Sale of Portion of Lot 25 Finley Home Addition
A request has been received from Dennis Benda, representing The Finley Hospital, to
purchase a part of Lot 25 of Finley Home Addition owned by the City of Dubuque. The
lot size is 3,958 square feet and is located on West Third Street. Finley has leased the
area from the City of Dubuque since 1996 for its Health Education Center. City
Engineer Gus Psihoyos states that the City has no plans for the utilization of that part of
Lot 25 Finley Home Addition, except for reserving an easement for access and utilities
to the water tower, and recommends the sale for the purchase price of $19,790, plus
publication and filing fees, and that Finley Hospital pay the costs to survey and plat the
lot. It is further recommended that a public hearing be set for March 5, 2007 on the sale
of the property.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The attached vicinity map and plat shows proposed Lot 1 of Finley Home
Addition No. 2 to be purchased. The adjoining property east of Lot 1 is utilized
for a City of Dubuque water tower and the area west of Lot 1 is an existing
driveway next to The Finley Hospital parking ramp. The Finley Hospital plans to
remove the Health Education Center building when the Finley Diabetes Center is
completed on University Avenue. This will allow Finley to widen and improve the
driveway from West Third Street to the hospital loading docks.
There was an appraisal of the property in November, 2004. The Finley Hospital's
offer agrees with the value recommended in the appraisal ($5.00 per square foot)
and is in line with the value of other City property that has been sold. Finley
Hospital paid for surveying and platting of the property.
A copy of The Finley Hospital's offer is attached. Water Department Manager
Bob Green indicates the City does not have a need to retain ownership of the
property provided access to the water tower is retained. Easements for said
access and utilities will be reserved on the entire Lot 1 being disposed of.
Based on this information, I believe Finley's offer is fair. Due to the location, size,
and very limited potential use of the property, there would not be other interested
parties. Normally, the City disposes of property to adjoining property owners if
the property is not needed for City purposes.
RECOMMENDATION
The City has no plans for the utilization of a part of Lot 25 Finley Home Addition
to be known as Lot 1 of Finley Home Addition No. 2 except for reserving an
easement for access and utilities to the water tower as noted.
I recommend a public hearing be set for the disposition of the City's interest in
Lot 1 of Finley Home Addition No. 2 on March 5, 2007. I would further
recommend that the purchase price be established at $19,790, plus publication
and filing fees, and that Finley Hospital pay the costs to survey and plat the lot.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public
hearing should be scheduled on the sale of the property by adoption of the
enclosed resolution.

RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT 1
OF FINLEY HOME ADDITION NO. 2 IN THE CITY OF DUBUQUE,
DUBUQUE COUNTY, IOWA
Whereas, The Finley Hospital has requested the disposal of a portion of
Lot 25 of Finley Home Addition; and
Whereas, IIW Engineers & Surveyors, PC has prepared and submitted to
the City Council a plat showing a portion of Lot 25 of Finley Home Addition and
assigned lot number thereto, which hereinafter shall be known and described as
Lot 1 of Finley Home Addition No. 2 in the City of Dubuque, Dubuque County,
Iowa, should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot
1 of Finley Home Addition No. 2 in the City of Dubuque, Dubuque County, Iowa.
Section 2. That the conveyance of Lot 1 of Finley Home Addition No. 2 in
the City of Dubuque, Dubuque County, Iowa, to The Finley Hospital be
contingent upon the payment of $19,790.00, plus platting, publication, and filing
fees.
Section 3. That the City Clerk be and is hereby authorized and directed to
cause a notice of intent to dispose of said real estate to be published in the
manner as prescribed by law.

RE: Finley Purchase of City Property on West 3rd
Dear Ken:
This is a follow up to my June 19, 2006 letter on Finley's interest in buying the
West Third property next to the Water Tower.
Finley would like to purchase this property from the City. We plan to remove the
Health Education Center trailer when the Finley Diabetes Center construction is
completed on University. We would then widen and improve the drive way from
West 3~d to the Hospital loading dock. Finley would be willing to grant an
easement to the City on this property to gain access to the water tower.
During previous conversations, you said the appraised value of this property is
$5.00 per square foot. Neal Erdmann, Director of Maintenance at Finley, has
estimated that this property is 4,779 square feet. I have attached his analysis.
Finley would like to purchase this property for $23,895 (4,779 times $5.00).
Please let me know what the next steps would be to make this transaction occur.
