Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Historic Old Main Street -Lighting and Sidewalk Replacement Project CIP 3001633 -Main Street Sidewalk Improvements -Jones to Fifth Street CIP 3001627 -Main Street Historic Lighting (1st to 5th) INTRODUCTION The enclosed resolutions authorize the public bidding procedure for the Historic Old Main Street -Lighting and Sidewalk Replacement Project. BACKGROUND The current streetlights along Historic Old Main Street from 1St to 5th street are scheduled to be replaced due to high maintenance. The sidewalks are also scheduled to be replaced to match the current downtown sidewalk pattern. DISCUSSION This project provides for the replacement of all street lights and traffic signals from 1St Street to 5th Street. The replacement of the street lights and intersection lights will be with historic looking fixtures. It is planned to replace the existing street lights with 20 - 12' high historic street lights and 8 - 25' high historic intersection street lights. This lighting will be similar to what was installed at Washington Park. The project will include the total reconstruction of the traffic signals located at 3~d and Main and at 4th and Main to include count-down pedestrian signals, pre-emption capabilities and battery backup systems along with fiber optic communications conduit. New historic lighting equipment and traffic control equipment have already been purchased for the project to eliminate the long lead time in ordering. These lighting controllers will also be able to support any future reconstruction of street lights around the Five Flags Center. In conjunction with this lighting replacement, the project provides for the replacement of the existing sidewalk and pedestrian access curb ramps with buff colored sidewalk to match the historic downtown sidewalk standard. In addition, an asphalt street overlay of Main Street from 1St Street to 5th Street will be included as part of the 2007 Asphalt Paving Program and coordinated with this project. PROJECT COORDINATION In an effort to inform and involve the impacted property owners along Main Street, city staff met on several occasions with the property owners and staff of Dubuque Main Street Ltd. Engineering staff held three large-group meetings and on-site individual property owner meetings to review the planned improvements. During these discussions, the property owners were not in agreement with the assessable portion of the project for the decorative concrete sidewalk replacement. On March 16, 2006, Engineering formally presented the project before the Historic Preservation Commission (HPC) for review and comments. HPC supported and approved the project. A work session was then held on March 27, 2006, with City Council to review the project and to discuss the decorative concrete sidewalk issue. After this meeting, the property owners understood how the Historic District Public Improvement Program (HDPIP) grant would benefit the assessable portion of the project. During the planning phase (March through December, 2006), it was discovered that several basements or structures from properties extended under the existing sidewalk. In some instances the existing sidewalk is the ceiling of the basement for a particular property. City staff met with these property owners and discussed ways to deal with these basements or structures during the removal of the existing sidewalk and the construction of the new sidewalk. This particular section of Main Street was part of the original town site for the City of Dubuque. The city lots in that part of the city abut each other with right-of-way easements over the lots rather than platted street right-of-way. The City is obligated to maintain the easement for street and sidewalk use; however, the property owner has the obligation to maintain any basement structure under the street or sidewalk . Based on the referenced information, the Engineering Department retained the services of IIW Engineers & Surveyors, PC (IIW) to determine alternatives to resolve the conflict between the proposed sidewalk construction and the basements and structures encroaching under the sidewalk area. Since the property owners have the right to maintain their respective basement structures inside the street/sidewalk right-of-way, coupled with the fact that these basements have minimal usage, it is the recommendation of the Engineering Department that the City could assume the expense of abandonment of these basement structures. This work would be performed by the contractor as part of Historic Old Main Street Lighting and Sidewalk Replacement Project award. If the impacted property owner opts to retain its basement structure under the street/sidewalk right-of-way, the property owner would need to execute a "hold harmless" agreement for any work performed by the City. On December 14, 2006, a meeting was again held with the property owners to review the project schedule and the estimated preliminary assessments. CONSTRUCTION PHASING This project will need to be constructed in multiple phases to accommodate the needs of the property owners abutting the project. Several property owners have voiced specific needs to limit the disruption of their business during the construction of the project. Engineering will incorporate in the plans as best as possible to limit the disturbance to the businesses on Lower Main by multi-phasing the project. PROPERTY ASSESSMENTS The property owners abutting the project limits will be directly assessed for the sidewalk removal and installation. The City of Dubuque will pay for the first two feet of the sidewalk directly behind the curb as part of the historic lighting portion of the project. The remaining ± 9 feet of the project will be split 25 percent (25%) for the property owner, with the remaining 75 percent (75%) to be paid for with a Historic District Public Improvement Program (HDPIP) grant of $100,000. Copies of the plans and specifications may be obtained in the City Engineer's office at the City Hall. No plan deposit is required. Payment to the contractor will be made from funds as may be legally used for such purposes. All work herein provided for shall be commenced within ten (10) days after the Notice To Proceed has been issued, and shall be fully completed with Phase I by June 6, 2007 and Phase II by July 13, 2007.. All bids must be submitted on the Bid Form bound in the specifications. For each calendar day that any work shall remain uncompleted beyond the completion schedule, $750 per calendar day will be assessed, not as a penalty but as predetermined and agreed liquidated damages. The contractor will be separately invoiced for this amount, and final payment will be withheld until payment has been made of this invoice. The assessment of liquidated damages shall not constitute a waiver of the City's right to collect any additional damages which the City may sustain by failure of the contractor to carry out the terms of his contract. An extension of the contract period may be granted by the City for any of the following reasons: 1. Additional work resulting from a modification of the plans. 2. Delays caused by the City. 3.
