INTRODUCTION
The enclosed resolutions authorize the public bidding procedure for the 5th Street
Reconstruction Project -Alpine Street to Hill Street.
BACKGROUND
West 5th Street was originally constructed with macadam in 1868. In 1914 the street
received curb and gutter and was later paved with asphalt in 1922. In 1966 an asphalt
maintenance overlay was completed. Since that time, interim chip seal applications
have been applied.
DISCUSSION
The 5th Street Reconstruction Project -Alpine Street to Hill Street will provide for the
reconstruction of underground utilities, roadway sub-base and the construction of a new
31-foot wide concrete roadway between Alpine Street and Hill Street.
The project will incorporate upgrades to the existing sanitary sewer system that include:
the complete reconstruction of approximately 1,255 lineal feet of 8-inch mainline sewer;
the reconstruction of 7 deteriorated brick manholes; and the replacement of 46 private
sanitary sewer laterals. The cost for the individual sanitary sewer lateral replacements
will be assessed to each respective private property owner.
The project will also include the reconstruction of approximately 1300 lineal feet of
watermain, mainline valves, fire hydrants, and the replacement of 23 lead residential
water services. The cost of the individual lead residential water service replacements
will be assessed to each respective private property owner.
The project also provides for the construction of approximately 1,230 lineal feet of new
storm sewer and 13 catch basins to improve the stormwater conveyance in the area;
the installation of fiber optics and telecommunications conduit infrastructure; and the
replacement of existing sidewalks along both sides of West 5th Street.
City staff met with the City Forester on this project to discuss the condition and impact
to the existing City trees within the project corridor. There is one mature tree in this
corridor. No trees will be removed as part of this project.
PROJECT COORDINATION
In an effort to inform the impacted residents along 5t" Street, from Alpine Street to Hill
Street, the Engineering Department staff conducted two public informational meetings.
A third informational meeting is planned to have the residents meet the contractor who
will be performing the work. The open forum meetings allowed staff to discuss the
scope of the project, construction schedule, special assessment procedures, availability
of financial assistance, as well as to answer any questions relating to the project. The
public informational meetings proved to offer mutual benefit to both staff and residents
that attended.

I recommend that the City Council give preliminary approval to the construction plans
and specifications, approve the Resolution of Necessity, approve the Preliminary
Schedule of Assessments, establish March 5, 2007 as the date of the public hearing,
and hereby authorize the City Clerk to advertise for bid proposals for the 5t" Street
Reconstruction Project -Alpine Street to Hill Street.

The 5th Street Reconstruction Project -Alpine Street to Hill Street will be funded
through the annual capital improvement project appropriation of City funds as noted
above in the amount of $1,000,245.21. The project, as outlined, will require Special
Assessments in the amount of $199,881.35 and expenditure from the FY 2008 Annual
Street Construction Program (Funded through Local Option Sales Tax) in the amount of
$586,870.06.
PROPERTY ASSESSMENTS
Low- to moderate-income property owners subject to street assessment will be eligible
for financial assistance ranging from 20 to 100 percent of the street assessment for the
owner-occupied resident property depending on family size and income level. This
financial assistance program is made available through the One Percent Local Option
Sales Tax.
ACTION TO BE TAKEN
The City Council is requested to give preliminary approval to the Resolution of
Necessity; approve the Preliminary Schedule of Assessments; to establish the date of
the public hearing; and to authorize the City Clerk to advertise for bid proposals through
the adoption of the enclosed resolutions for the 5th Street Reconstruction Project -
Alpine Street to Hill Street.

Whereas, the City Council of the City of Dubuque, Iowa has given its preliminary

the 5th Street Reconstruction Project -Alpine Street to Hill Street (the Project) and
ordered the same to be on file in the office of the City Clerk for public inspection.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That a public hearing will be held on the 5th day of March, 2007, at 6:30 p.m. in

NOTICE IS HEREBY GIVEN: The City Council of the City of Dubuque, Iowa will
hold a public hearing on the proposed plans, specifications, form of contract and
estimated cost for the 5th Street Reconstruction Project -Alpine Street to Hill Street, in
accordance with the provisions of Chapter 26, Code of Iowa, at 6:30 p.m., on the 5th
day of March, 2007, in the Public Library Auditorium, 360 West 11th Street, Dubuque,
Iowa. Said proposed plans, specifications, form of contract and estimated cost are now
on file in the office of the City Clerk. At said hearing any interested person may appear
and file objections thereto.

RESOLUTION OF NECESSITY
Whereas, proposed plans have been duly prepared and approved by the City
Council of the City of Dubuque and are now on file in the office of City Clerk showing
among other things the plans, specifications, form of contract, estimate of probable cost
and the Preliminary Schedule of Assessments showing the amount proposed to be
assessed against each lot and the valuation of each lot as filed by the City Council, for
the 5th Street Reconstruction Project -Alpine Street to Hill Street.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the City Council deems it advisable and necessary for the public welfare to
make the herein mentioned improvements, and unless property owners at the time of
the final consideration of this proposed resolution have on file with the City Clerk
objections to the Resolution of. Necessity, they shall be deemed to have waived all
objections pertaining to the regularity of the proceeding and the legality of using the
special assessment procedure.
Said improvements shall be constructed and done in accordance with the plans
and specifications which have been approved by the City Council and now on file with
the City Clerk. That the cost and expense of making such improvement will be
assessed partially or totally against privately owned property lying with the assessment
limits, and in an amount not to exceed that provided by law, and in proportion to the
special benefits conferred.
The portion of the cost which shall be borne by the City will be paid from the
Fiscal Year 2008 Street Construction Program Fund, Watermain Replacement Program
Fund, Street Program Related Sanitary Sewer Improvements Fund, W. 5th Street (Alta
Vista to Hill) Storm Sewer Improvement Fund, Fiber Optic Conduit -Paving Projects
Funds, and special assessment bonds may be issued in anticipation of deferred
payments of special assessments when a contract has been performed and accepted,
and the proceeds thereof used to pay the contractor.
The above resolution was introduced, approved and ordered placed on file with
the City Clerk this loth day of February , 2007.

authorized and directed to cause a notice of time and place of such hearing to be

RESOLUTION WITH RESPECT TO THE ADOPTION OF THE RESOLUTION
OF NECESSITY PROPOSED FOR THE 5T" STREET RECONSTRUCTION
PROJECT -ALPINE STREET TO HILL STREET
Whereas, the City Council has proposed a Resolution of Necessity for the Stn
Street Reconstruction Project -Alpine Street to Hill Street has given notice of the public
hearing thereon as required by law; and
Whereas, the public hearing has been held, all persons offering objections have
been heard and consideration given to all objections and is pending before this Council;
and
Whereas, this is the time and place set as provided for the taking of action on the
proposed Resolution of Necessity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the proposed Resolution of Necessity described above is hereby:
Adopted, without amendment, and all objections filed or made having been duly
considered are overruled.
Adopted as amended by the Preliminary Schedule of Assessments attached
hereto as Exhibit A, and made a part hereof by reference. All objections filed or
made having been duly considered are overruled.
Deferred for later consideration to a City Council meeting to be held on the
day of , 2007, next at 6:30 p.m. in the Public Library Auditorium, with
jurisdiction retained for further consideration and action at the adjourned meeting.

ORDERING BIDS
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the 5th Street Reconstruction Project -Alpine Street to Hill Street is hereby
ordered to be advertised for bids for construction.
BE IT FURTHER RESOLVED that the amount of the security to accompany each
bid shall be in an amount which shall conform to the provisions of the Notice to Bidders
hereby approved as a part of the plans and specifications heretofore adopted.
That the City Clerk is hereby directed to advertise for bids for the construction of
the improvements herein provided, to be published in a newspaper having general
circulation in the City of Dubuque, Iowa, which notice shall not be less than twenty days
nor more than forty-five days prior to the receipt of said bids at 2:00 p.m. on the 22nd
day of March, 2007. Bids shall be opened and read by the City Clerk at said time and
will be submitted to the Council for final action at 6:30 p.m. on the 2nd day of April,
2007.

NOTICE TO BIDDERS OF THE RECEIPT OF BIDS
FOR THE 5th STREET RECONSTRUCTION PROJECT
ALPINE STREET TO HILL STREET
Sealed proposals will be received by the City Clerk of the City of Dubuque, Iowa,
at the Office of City Clerk in City Hall no later than 2:00 o'clock p.m. on the 22nd day of
March, 2007, for the 5th Street Reconstruction Project -Alpine Street to Hill Street.
A Pre-Bid Conference will be held at 9:00 am on the 6th day of March, 2007,
at Conference Room A, City Hall, 50 West 13th Street, Dubuque, Iowa. Attendance
by all prospective bidders is not mandatory but highly recommended.
Proiiect Description: The 5th Street Reconstruction Project -Alpine Street to Hill
Street will provide for the reconstruction of underground utilities, roadway sub-base and
the construction of a new 31-foot wide concrete roadway between Alpine Street and Hill
Street.
The project will incorporate upgrades to the existing sanitary sewer system that
include: the complete reconstruction of approximately 1,255 lineal feet of 8-inch
mainline sewer; the reconstruction of 7 deteriorated brick manholes; and the
replacement of 46 private sanitary sewer laterals. The cost for the individual sanitary
sewer lateral replacements will be assessed to each respective private property owner.
The project will also include the reconstruction of approximately 1300 lineal feet
of watermain, mainline valves, fire hydrants, and the replacement of 23 lead residential
water services. The cost of the individual lead residential water service replacements
will be assessed to each respective private property owner.
The project also provides for the construction of approximately 1,230 lineal feet
of new storm sewer and 13 catch basins to improve the stormwater conveyance in the
area; the installation of fiber optics and telecommunications conduit infrastructure; and
the replacement of existing sidewalks along both sides of West 5th Street.
Copies of the construction documents may be obtained in the City Engineer's
office at the City Hall. No plan deposit is required.
Payment to the contractor will be made from funds as may be legally used for
such purposes.
All work herein provided for shall be commenced within ten (10) days after the
Notice To Proceed has been issued, and shall be fully completed on or before October
12, 2007.
All bids must be submitted on the Bid Proposal Form bound in the construction
documents. Each bid shall be accompanied by a satisfactory Bid Bond executed by the
Bidder and an acceptable surety; or a cashier's or certified check payable to the City
Treasurer, City of Dubuque, drawn on a bank in Iowa or a bank chartered under the
laws of the United States, in the amount of ten percent (10%) of the bids submitted as
security that the bidder will enter into a contract for doing the work and will give bond
with proper securities for the faithful performance of the contract in the form attached to
the construction documents.
The successful bidder (Contractor) will be required to furnish a Performance
Bond in an amount equal to one hundred percent (100%) of the contract price. Said
bond is to be issued by a responsible surety company approved and acceptable to the
City Council, and shall guarantee the faithful performance of the contract and terms and
conditions therein contained, and shall guarantee the prompt payment of all materials
and labor and protect and save harmless the City of Dubuque, Iowa, from claims and
damages of any kind caused by the operations of the Contractor.
The successful bidder (Contractor) will also be required to furnish a Maintenance
Bond that will guarantee the material, workmanship and the maintenance of the
improvement(s) constructed for a minimum period of two (2) years from and after its
completion and acceptance by the City Council.
The successful bidder (Contractor) will also be required to furnish a Payment
Bond that will guarantee the prompt payment of all subcontractors, suppliers, materials,
labor and protect and save harmless the City of Dubuque, Iowa, from claims and
damages of any kind caused by the operations or non-payment on behalf of the
Contractor.
The Contractor and approved subcontractors will be provided a Sales Tax
Exemption Certification to purchase, or withdraw from inventory, materials furnished
under for this project.
No bid submitted by any Contractor which contains a condition or qualification
shall be recognized or accepted by the City Council and any letter or communication
accompanying the bid which contains a condition or qualification upon the bid which has
the effect of qualifying or modifying any provision of the specifications in any manner will
be rejected by the City Council as not responsive.
All proposals must be made on blanks furnished by the City Engineer and each
bidder will be required to state his prices for doing all the items in each section on which
he makes a bid and for all things necessary to make a complete job.
The Bidder's attention is directed to the City of Dubuque's Affirmative Action
Program which is included in the Contract Specifications and the provisions thereof and
hereby made a part of the Contract Documents by reference and incorporated therein.
The Contractor, when requested by the City of Dubuque, will furnish a statement
of his financial and practical qualifications as provided for in the General Requirements
of the Specifications.
By virtue of statutory authority, a preference will be given to products and
provisions grown and coal produced within the State of Iowa and to Iowa Domestic
Labor.
The City Council reserves the right to reject any and all bids or to waive any
technical ties and irregularities.
All bids will be publicly opened and read by the City Clerk at 2:00 o'clock p.m. on
the 22nd day of March, 2007, and will be submitted to the City Council for final action at
a meeting to be held in the Public Library Auditorium, 360 West 11th Street, at said City
at 6:30 p.m. on the 2nd day of April, 2007. A contract will be awarded at that time or
such subsequent time as the City may determine.

CONSTRUCTION SCHEDULE AND LIQUIDATED DAMAGES
All work herein provided for shall be commenced within ten (10) days after the
Notice To Proceed has been issued, and shall be fully completed on or before October
12, 2007.
For each calendar day that any work shall remain uncompleted beyond the
specified completion date of October 12, 2007, $750 per calendar day will be assessed,
not as a penalty but as predetermined and agreed liquidated damages. The Contractor
will be separately invoiced for this amount, and final payment will be withheld until
payment has been made of this invoice.
The assessment of liquidated damages shall not constitute a waiver of the City's
right to collect any additional damages which the City may sustain by failure of the
contractor to carry out the terms of his contract.
An extension of the contract period may be granted by the City for any of the
following reasons:
1. Additional work resulting from a modification of the plans.
2. Delays caused by the City.
3. Other reasons beyond the control of the Contractor, which in the City's opinion,
would justify such extension.
