Sealed bids were received. for the Heron Pond Tree Removal Project. Leisure Services
Manager Gil Spence recommends award of the contract to the low bidder, Top Grade
Excavating, in the amount of $30,299.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Heron Pond Tree Removal Project, #1128
INTRODUCTION
The purpose of this memorandum is to request that the City Council award a contract to
Top Grade Excavating for the Heron Pond Tree Removal Project.
DISCUSSION
Bids were received on February 1, 2007 for the Heron Pond Tree Removal Project. A
summary of the bids received is as follows:

The Fiscal Year 2007 C.I.P. budget contains $80,000 for this project. The purpose of
the project is to create a more open view of the area between the Heron Pond Trail and
the Hilton Garden Inn parking lot and the area around Heron Pond to Miller-Riverview
Park. This will provide a more secure feeling for people using the trail while opening the
view of the Heron Pond and Peosta Channel. This area is vastly overgrown with
"volunteer" Cottonwood trees, contains a large amount of concrete and rocks, and has
an uneven terrain.

This project removes all the Cottonwood trees, removes all the concrete and rock that
can be seen, and then grades the area to match the contours that are present. When
this is completed, Park Division staff will apply grass seed and plant some trees (the
number has not been determined). We will then be able to maintain the area to prevent
the future growth of the volunteer trees.
This area contains a large number of trees that range in size from one inch diameter to
eighteen inches in diameter. We do not believe any of the trees are significant but as
the trees are being removed, if a significant tree is discovered that should remain, it will
not be removed. The only way to improve the appearance of the area is with this
approach. Prior to construction of the hotel and the trail, the appearance of the area
was not important, but now there is heavy use of the trail and the hotel is doing very
well.
Fill dirt and topsoil that may be needed and excess concrete and rock that may need to
be removed are not part of the bid so change orders are expected.
RECOMMENDATION
I recommend that the contract be awarded to Top Grade Excavating in the amount of
$30,299.
ACTION STEP
The action requested is that the City Council adopt the attached resolutions awarding a
contract to Top Grade Excavating in the amount of $30,299 for the Heron Pond Tree
Removal Project.

RESOLUTION NO. 112-07
RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
WHEREAS, on the 16th day of January, 2007, plans, specifications, form of contract
and estimated cost were filed with the City Clerk of Dubuque, Iowa for the Heron Pond
Tree Removal Project.
WHEREAS, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are hereby
approved as the plans, specifications, form of contract and estimated cost for said
improvements for said project.

RESOLUTION NO. 113 -07
AWARDING CONTRACT
WHEREAS, sealed proposals have been submitted by contractors for the Heron
Pond Tree Removal Project pursuant to Resolution No. 29-07, and notice to bidders
published in a newspaper published in the City of Dubuque, Iowa, on the 19th day of
January, 2007.
WHEREAS, said sealed proposals were opened and read on the 1st day of
February, 2007, and it has been determined that the bid of Top Grade Excavating in the
amount of $30,299 was the lowest bid for the furnishings of all labor and materials and
performing the work as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Top Grade Excavating,
and the Manager be and is hereby directed to execute a contract on behalf of the City of
Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's bond, the
City Treasurer is authorized and instructed to return the bid deposits of the unsuccessful
bidders.

RESOLUTION NO. 114-07
APPROVING CONSTRUCTION CONTRACT WITH TOP GRADE
EXCAVATING FOR THE HERON POND TREE REMOVAL PROJECT
Whereas, the City Council by Resolution No. 113-0~ awarded the construction
contract for the Heron Pond Tree Removal Project to Top Grade Excavating; and
Whereas Top Grade Excavating has submitted the attached executed contract
and bond.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
1. The contract and bond attached hereto are hereby approved.
2. The City Manager is hereby authorized and directed to execute the contract on
behalf of the City of Dubuque.
