Van Milligen, City Manager SUBJECT: Sale of Portion of Lot 25 Finley Home Addition A request has been received from Dennis Benda, representing The Finley Hospital, to purchase a lot of 3,958 square feet that is located on West Third Street. Finley has leased the area from the City of Dubuque since 1996 for its Health Education Center. City Engineer Gus Psihoyos states that the City has no plans for the utilization of that lot, except for reserving an easement for access and utilities to the water tower, and recommends the sale for the purchase price of $19,790, plus publication and filing fees, and that Finley Hospital pay the costs to survey and plat the lot. Van Milligen, City Mana er FROM: Gus Psihoyos, City Engineer , SUBJECT: Sale of Portion of Lot 25 Finley Home Addition INTRODUCTION Dennis Benda, representing The Finley Hospital (Finley), has requested the purchase of part of Lot 25 of Finley Home Addition owned by the City of Dubuque. The lot size is 3,958 square feet and is located on West Third Street. Finley has leased the area from the City of Dubuque since 1996 for its Health Education Center. DISCUSSION The proposed area to be purchased is Lot 1 of Finley Home Addition No. 2. The adjoining property east of Lot 1 is utilized for a City of Dubuque water tower and the area west of Lot 1 is an existing driveway next to The Finley Hospital parking ramp. The Finley Hospital plans to remove the Health Education Center building when the Finley Diabetes Center is completed on University Avenue and plans to widen and improve the driveway from West Third Street to the hospital loading docks. There was an appraisal of the property in November, 2004. The Finley Hospital's offer agrees with the value recommended in the appraisal ($5.00 per square foot) and is in line with the value of other City property that has been sold. Finley Hospital paid for surveying and platting of the property. Water Department Manager Bob Green indicates the City does not have a need to retain ownership of the property provided access to the water tower is retained. Easements for said access and utilities will be reserved on the entire Lot 1 being disposed of. Based on this information, it is believed that Finley's offer is fair. Due to the location, size, and very limited potential use of the property, there would not be other interested parties. RECOMMENDATION I recommend a public hearing be held for the disposition of the City's interest in Lot 1 of Finley Home Addition No. 2. I would further recommend that the purchase price be established at $19,790, plus publication and filing fees, and that Finley Hospital pay the costs to survey and plat the lot. ACTION TO BE TAKEN The recommendation of the City Manager should be approved and a public hearing should be held on the disposal of the property through the adoption of the enclosed resolutions. Turner, City of Dubuque, 50 W. 13th Street, Dubuque, Iowa (563) 589-4270 RESOLUTION NO. 138-07 RESOLUTION DISPOSING OF CITY INTEREST IN LOT 1 OF FINLEY HOME ADDITION NO. 2 IN THE CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA Whereas, pursuant to resolution and published notice of time and place of hearing, published in the Telegraph Herald, a newspaper of general circulation published in the City of Dubuque, Iowa on this 23rd day of February , 2007, the City Council of the City of Dubuque, Iowa met on the 5th day of March 2007, at 6:30 p.m. in the Public Library Auditorium, 360 West 11 Street, Dubuque, Dubuque County, Iowa to consider the proposal for the sale of real estate described as: Lot 1 of Finley Home Addition No. 2 in the City of Dubuque, Dubuque County, Iowa Whereas, the City Council of the City of Dubuque, Iowa overruled any and all objections, oral or written to the proposal to sell such real estate, except for easement as noted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the sale of City of Dubuque real property described as Lot 1 of Finley Home Addition No. 2 in the City of Dubuque, Dubuque County, Iowa, to The Finley Hospital be and the same is hereby approved for the sum of $19,790.00, plus the cost of platting, publication, and filing fees. Conveyance shall be by Quit Claim Deed. Section 2. The City of Dubuque reserves unto itself a perpetual easement including the right of ingress and egress thereto, for the purpose of erecting,. installing, constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer, drainage, .gas, telephone, television cable, and electric lines as may be authorized by the City of Dubuque, Iowa, over and across the entire Lot '! of Finley Home Addition No. 2. Section 3. That the Mayor be authorized and directed to execute a Quit Claim Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed of conveyance to The Finley Hospital upon receipt of the purchase price in full. Section 4. That the City Clerk be and is hereby authorized and directed to record a certified copy of this resolution in the offices of the City Assessor, Dubuque County Recorder and Dubuque County Auditor.
