Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Snow Removal Assessment DATE: April 11, 2014 INTRODUCTION Dubuque AB-Ammica City 2007 • 2012 • 2013 The enclosed resolutions provide for the establishment of the final assessments for the 2013-2014 Snow Removal from City Right -Of -Way. BACKGROUND Engineering records show snow accumulations from November 22, 2013 through the month of March 15, 2014. Iowa State Code Section 364.12b states the abutting property owner is responsible "for the removal of the natural accumulations of snow and ice from the sidewalks within a reasonable amount of time and may be liable for damages caused by the failure of the abutting property owner to use reasonable care in the removal of the snow or ice." City Code of Ordinance 10-1-3-C-1 addresses the duties of the abutting owner, removal by City, and the collection of costs. Complaints and inspections produced 505 notices being sent to property owners: of the 51 properties that were contracted for cleaning of snow/ice accumulations; 9 of those properties required sending a crew on two or more separate occasions. Of the 51 properties billed in the 2013-2014 season, 37 remain unpaid; two of those cleared properties were assessed separately in an effort to have the assessments on record before they were sold at Sheriff's sales, March 18, 2014 & April 15, 2014 and are not reflected in this final assessment. DISCUSSION The Final Schedule of Assessments for snow removal from City Sidewalks has been completed in the amount of $5,966.25; this total includes the $25.00 per incident administrative fee. BUDGET IMPACT The Sidewalk Inspection Program — Assessable Capital Improvement Project (CIP 1001108) is a general fund — liens account, in the amount of $6388.75. The General Special Assessment Fund (CIP 25510255) covers the cost of contracting and the revenue from those assessments. RECOMMENDATION I recommend that the City Council approve the resolutions establishing this Final Assessment Schedule for the 2013-2014 Snow Removal from City Right -Of -Way in the amount of $5,966.25. The City Council is requested to approve the attached resolutions establishing the Final Assessment Schedule for the 2013-2014 Snow Removal from City Right -of -Way.
