Van Milligen, City Manager SUBJECT: Authorization to Sign - "Notice of Expiration of Right of Redemption" DATE: April 28, 2014 The City of Dubuque purchased the tax certificate for 1921 Madison Street. The City must hold the tax certificate for nine months and then provide the property owner 90 days to redeem the property for the full amount of the tax sale certificate plus interest. If the property owner fails to pay in full, the City will receive title to the property at the end of the 12 month process. As part of this process the City is required to send a "Notice of Expiration of Right of Redemption." Assistant City Attorney Crenna Brumwell recommends City Council approval for any attorney in the City Attorney's office to sign notices of this nature. Van Milligen City Manager DATE: April 15, 2014 RE: Authorization to Sign - "Notice of Expiration of Right of Redemption" The City of Dubuque purchased the tax certificate for 1921 Madison Street from Dubuque County in 2013. The City must hold the tax certificate for nine (9) months and then provide the property owner ninety (90) days to redeem the property for the full amount of the tax sale certificate plus interest. Per Iowa Code Section 447.9, the individual signing the Notice must be authorized by the City Council. Brumwell Suite 330, Harbor View Place, 300 Main Street, Dubuque, IA 52001 (563) 583-4113 RESOLUTION NO. 127-14 AUTHORIZING THE ATTORNEYS IN THE CITY OF DUBUQUE CITY ATTORNEY'S OFFICE TO SIGN NOTICES OF EXPIRATION OF RIGHT OF REDEMPTION Whereas, Iowa Code §447.9 outlines the requirements for providing notice of expiration of right of redemption of real estate which has been sold at a tax sale; and Whereas, Iowa Code §447.9 requires that the city officer signing the notice of expiration of right of redemption be authorized to sign the notice by resolution of the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The City Council hereby authorizes the City Attorney and the Assistant City Attorneys to sign notices of expiration of right of redemption on behalf of the City of Dubuque.
