AGREEMENT
FOR THE PROCESSING AND MARKETING OF RECYCLABLES
BETWEEN AND AMONG
DUBUQUE METROPOLITAN AREA SOLID WASTE AGENCY,
DITTMER RECYCLING, INC.
AND
THE CITY OF DUBUQUE, IOWA
This Second Amendment to the Agreement for the Processing and
Marketing of Recyclables between and among the Dubuque Metropolitan Area
Solid Waste Agency (Agency), Dittmer Recycling, Inc. (Contractor) and the City
of Dubuque, Iowa (City) is dated for reference purposes the I7day of
Tek, ,2014.
Whereas, Agency, Contractor and City entered into the Agreement for the
Processing and Marketing of Recyclables (the Agreement), dated for reference
purposes the 20th day of June, 2011, which Agreement expires June 30, 2014;
and
Whereas the Agreement was amended by the First Amendment to
Agreement dated for reference purposes October 5, 2011; and
Whereas, Agency, Contractor and City now desire to further amend the
Agreement as provided herein.
Now, therefore, it is agreed by and between Agency, Contractor and City
that the Agreement is amended as follows:
1. Section 1 is amended to read as follows:
SECTION 1. TERM OF AGREEMENT. The term of this Agreement shall be
from April 1, 2011 until midnight June 30, 2015 (the Term), unless earlier
terminated pursuant to this Agreement. Agency may at its option renew this
Agreement for one one-year term by giving Contractor written notice of renewal
not less than ninety (90) days prior to the expiration of the Term or an extension
of the Term.
