SUBJECT: Acceptance of Public Improvements in Arbor Estates -Phase 1 and 2
City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, Kivlahan Farms, LC, has recently completed in Arbor Estates -
Phase 1 and 2. Maintenance of said improvements shall be the responsibility of the
contractor, Connolly Construction, and the owner, Kivlahan Farms, LC, for a period of
two years from the date of acceptance.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public
improvements which the developer, Kivlahan Farms, LC, has recently completed
in Arbor Estates -Phase 1 and 2.
BACKGROUND
As a condition of subdivision plat approval through Resolution Nos. 168-02 and
197-04, the developer of Phase 1 and 2 of Arbor Estates was required to install
certain improvements including street paving with curb, sanitary sewer main and
lift station, watermain, storm sewers and catch basins, boulevard street lighting,
and a stormwater detention facility and to dedicate these improvements to the
City upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required
public improvements, the subdivider shall notify the City in writing of the
completion of the improvements, requesting that the City either approve or reject
the acceptance of the improvements, together with a statement of reasons for
any rejection.
Kivlahan Farms, LC has requested City's acceptance of the improvements in
Arbor Estates -Phase 1 and 2. Upon inspection by the City, it has been
determined that all of the public improvements required by Resolution Nos. 168-
02 and 197-04 have been completed in accordance with plans approved by the
City Council and in conformance with City specifications. The sanitary sewer lift
station serving these lots was previously accepted by Resolution No. 136-03 on
May 3, 2003.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the improvements.
Maintenance of said improvements shall be the responsibility of the contractor,
Connolly Construction, Inc., and the owner, Kivlahan Farms, LC, for a period of
two (2) years from the date of acceptance by the City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements.

ACCEPTING IMPROVEMENTS IN ARBOR ESTATES - PHASE I AND 2
Whereas, pursuant to Resolution Nos. 168-02 and 197-04, certain public
improvements including street paving with curb, sanitary sewer main, watermain,
storm sewers and catch basins, boulevard street lighting, and a stormwater
detention facility were installed by the developer of Arbor Estates - Phase I and
2.
Whereas, the improvements have been completed and the City Manager
has examined the work and has filed a certificate stating that the same has been
completed in accordance with the plans approved by the City Council and in
conformance with City specifications, and has recommended that the
improvements be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said public. improvements in Arbor Estates - Phase I and 2 be and the
same is hereby accepted.
Section 2. That maintenance of said improvements shall be the
responsibility of the contractor and owner for a period of two (2) years from this
date.
