SUBJECT: Eagle Point Park Fee Collector's Building, Project #1759
Sealed bids were received for the Eagle Point Park Fee Collector's Building Project.
Leisure Services Manager Gil Spence recommends award of the contract to the low
bidder, Klauer Construction Company, in the amount of $229,804, which is $71,804
(45.5%) over the estimate of $158,000. Savings from other Leisure Services projects
will provide the additional funding.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to request that the City Council award a contract to
Klauer Construction Company for the Eagle Point Park Fee Collector's Building Project.
DISCUSSION
Bids were received on March 8, 2007 for the Eagle Point Park Fee Collector's Building
Project. A summary of the bids received is as follows:

The Fiscal Year 2007 C.I.P. budget contains $150,000 for this project. Total project
cost estimates were as follows:

Total project costs based on the low bid are as follows:

Total project costs are $111,229 over budget. The low bid is $71,804 (45.5%) over the
estimate. I recommend these funds be taken from the following projects:
Flora Park Storm Sewer Project, #1211 ($50,000). This project was budgeted to
place storm sewer pipe underground, catch the water and remove it from the site.
We are re-designing this project and will use bio-filtration swale and detention areas
to hold the storm water on site. Plant material will also be used to keep the water
from entering the storm sewer system. It is estimated that this system will cost less
than fifty percent of the $87,600 budgeted for the project.
• Heron Pond Tree Removal Project, #1128 ($30,000). This project is budgeted at
$80,000 and the contract was awarded at $30,299. Leaving a contingency of
$19,701, there would be $30,000 that could be moved to fee booth project.
• Eagle Point Park Stone Work Project, #1677 ($31,229). There is $52,628 available
in this project so there would be a balance of $21,399 to do some stone work.
Attached is a picture of the proposed building designed to fit with the other buildings in
the park. We view this as a small (dollar-wise) but significant project. It is significant
because this building welcomes and introduces visitors to the park. The building will be
moved down Shiras Avenue (from the present location) a little to allow a level area for
vehicles to sit as they pay the entrance fee.
Alternate 1 replaces the asphalt drive with pervious pavers to help retain storm water on
site. Alternate 2 replaces the water closet with a composting toilet. Neither of the
alternates is being recommended.
The present building is an old Photo Hut moved from Kennedy Road and Pennsylvania
Avenue twenty-one years ago when the $1.00 entrance fee was placed on Eagle Point
Park.
RECOMMENDATION
I recommend that a contract be awarded to Klauer Construction in the amount of
$229, 804.

The final design of the project went beyond what was thought five years ago when it
was proposed. The building was going to remain in its present location but it was not
possible to create a level area for vehicles at this location. The design of the project is
excellent and I would hate to reduce any part of it to reduce the cost of the project.
Receiving seven bids indicates strong interest and I do not believe re-bidding would
result in a lower cost, unless the design was changed.
ACTION STEP
The action requested is that the City Council adopt the attached resolutions awarding a
contract to Klauer Construction in the amount of $229,804 for the Eagle Point Park Fee
Collector's Building.

RESOLUTION NO. 168-07
RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
WHEREAS, on the 5th day of February, 2007, plans, specifications, form of contract
and estimated cost were filed with the City Clerk of Dubuque, Iowa for the Eagle Point
Park Fee Collector's Building Project.
WHEREAS, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are hereby
approved as the plans, specifications, form of contract and estimated cost for said
improvements for said project.

RESOLUTION NO. 169-07
AWARDING CONTRACT
WHEREAS, sealed proposals have been submitted by contractors for the Eagle
Point Park Fee Collector's .Building Project pursuant to Resolution No. 62-07, and notice to
bidders published in a newspaper published in the City of Dubuque, Iowa, on the 9th day of
February, 2007.
WHEREAS, said sealed proposals were opened and read on the 8th day of March,
2007, and it has been determined that the bid of Klauer Construction Company in the
amount of $229,804 was the lowest bid for the furnishings of all labor and materials and
performing the work as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Klauer Construction
Company, and the Manager be and is hereby directed to execute a contract on behalf of
the City of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's bond, the
City Treasurer is authorized and instructed to return the bid deposits of the unsuccessful
bidders.

RESOLUTION NO. 170-07
APPROVING CONSTRUCTION CONTRACT WITH KLAUER CONSTRUCTION
COMPANY FOR THE EAGLE POINT PARK FEE COLLECTOR'S BUILDING
PROJECT
Whereas, the City Council by Resolution No. 169-07 awarded the construction
contract for the Eagle Point Park Fee Collector's Building Project to Klauer Construction
Company; and
Whereas Klauer Construction Company has submitted the attached executed
contract and bond.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
1. The contract and bond attached hereto are hereby approved.
2. The City Manager is hereby authorized and directed to execute the contract on
behalf of the City of Dubuque.
