Introduction
This memo transmits a request from Tri-State Development LLC for voluntary
annexation of 1.19 acres of property at 12653 Seippef Road, in conjunction with
rezoning the property to CS Commercial Service and Wholesale District. A staff report,
vicinity map, and the application for voluntary annexation are enclosed.
Discussion
On April 4, 2007, the Zoning Advisory Commission is scheduled to consider the
rezoning request at a public hearing.
The City Council's public hearing on the rezoning request should be held concurrently
with the public hearing on the annexation. Staff recommends that a public hearing be
held at the City Council's May 7, 2007 meeting to meet State Code notification
requirements for annexations within an urbanized area.
These notification requirements include a consultation with the Dubuque County Board
of Supervisors and the Center Township Trustees.
Recommendation
recommend that a public hearing on the voluntary annexation request of Tri-State
Development LLC be set for the City Council's May 7, 2007 meeting.

We would like to voluntarily annex this property (Mason Cates Estates -Lot 1) to
the City of Dubuque.
This property is now in the county and has its own well and septic system. iVo city
sanitary sewer is a currently available so we are not expecting to hook up to city water or
sewer at the present.
This annexation is subject to the property being rezoned to a favorable zoning of
Commercial Service as it connects to Seippel Road Commercial Park.

Physical Characteristics: The subject property is asingle-family residence located at
the southwest corner of the intersection of Seippel Road and Old Highway Road.
Conformance with Comprehensive Plan: Goal 8.4 of the Economic Development
Element of the 2002 Comprehensive Plan states: Annex additional land, as necessary
and as possible to accommodate projected commercial and industrial expansion. Goat
2.3 of the 2002 Comprehensive Plan's Land Use and Urban Design Element states:
Provide opportunities for neighborhood commercial centers that assure compatibility
with residential property. The Proposed Land Use Map of the 2002 Comprehensive
Plan designates this parcel for rural density residential development.
Impact of Request on:
Utilities: The property can be adequately served by City water main along Old Highway
Road. City sanitary sewer service is approximately one mile away and terminates on
the south side of the landfill property. The applicant is working with the City to extend
the sanitary sewer service to adjacent Tri-State Development property to the south.

Traffic Patterns/Counts: The subject property is adjacent to Seippel Road and Old
Highway Road. Based on IDOT 2005 vehicle counts Seippel Road carries
approximately 1,520 ADT. Old Highway Road carries approximately 1,450 ADT.
Public Services: Existing public services are adequate to serve the property as it's
developed for residential purposes or reused/redeveloped for commercial purposes.
Environment: No adverse impacts are expected as the site is already developed.
Adjacent Properties: The impact to adjacent properties most likely will be through a
increased volume of traffic and an increase in the ambient light level and noise levels,
depending on the nature of any future commercial reuse of the subject property.
CIP Investments: None proposed.
Staff Analysiis and Recommendation:
The property requested for annexation contigent on rezoning lies within the urbanized
area (i.e., within two miles) of the City of Asbury. Iowa Code allows for these types of
voluntary annexation requests be approved first by the City Council, and then by the
State of Iowa's City Development Board. The property meets Iowa Code requirements
for 50 feet of adjacent boundary for annexation to the City of Dubuque. Because the
subject property is adjacent to Seippel Road and Old Highway Road, the City must
annex to the center lines of both County roads to comply with Iowa Code.
The property is included in the City's 1996-1997 Annexation Study as a preferred area
for annexation due to its proximity to the City limits, infrastructure and utilities. The
property is included in the City's 2006 Annexation Study Update. The annexation would
create a more uniform city boundary along Seippel Road and Old Highway Road.
Staff recommends approval of the annexation request.
