Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the Chlapaty Center project,
including location of the building, parking, access drive and storm water detention basin.
There was one neighbor who spoke with concerns about storm water and reviewed
photos of storm water problems that occurred in 1993 and 1994.
Staff reviewed the requirements for amending an Institutional District, requirements for
storm water and erosion control, and the process for review of site plans.
The Zoning Advisory Commission discussed the request, noting that the proposed
alignment of the access drive will be less intrusive to residents living on Princeton Place,
and directed staff to address storm water and erosion control at the outset of construction
for the Chlapaty Center.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission approved the site plan and directed
staff to add more concise language regarding storm water management and erosion
control during construction. Staff has added this language in Section C.1 and C.2 in the
enclosed Ordinance.
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.

Purpose: To amend the ID Institutional District for the University of Dubuque to allow
the construction of a new recreation and wellness center coupled with the upgrading of
Chalmer's Field and installation of lighting for night time games.
Property History: The subject property has been part of the University of Dubuque
campus for over 30 years. Currently, the site has an existing service road that connects
with the Gilliam/West Streets intersection.
Physical Characteristics: The subject property slopes generally towards the west and is
bordered on two sides by existing single-family residences. The east side of the
proposed Chlapaty Building also will contain the new seating for Chalmer's Field.
Conformance with Comprehensive Plan: This project implements the
Comprehensive Plan's Land Use Element Goals: 7.2, 7.3, and the Education Element
Goals 8.1 and 8.4.
Staff Analysis: The proposed construction of the new Chlapaty Recreation and
Wellness Center will be primarily served by the existing service road that connects with
McCormick and Bennett Streets.

Streets: This service road also connects with Gilliam and West Streets. University
of Dubuque officials have indicated that the access to the Gilliam/West Street
intersection will have a gate that will restrict vehicle access except during sporting
events, which has been the practice for many years.
Sidewalks: Access to the building will be provided by appropriate pedestrian
sidewalks meeting current ADA standards.
Parking: As part of the new recreation and wellness center, a new parking lot will
be constructed south of the building. This parking lot will provide 160 parking
spaces and replace two existing parking lots that currently provide 140 parking
spaces.
Lighting: New outdoor lighting will be required to use cut-off light fixtures to reduce
impact to adjacent properties. However, the proposed lighting for the football field
is not able to utilize cut-off light fixtures and meet NCAA requirements for light
levels.
signage: No signage has been proposed as part of this ID plan amendment. New
signage shall be subject to Section 4-3.11 of the Zoning Ordinance.
Bulk Regulations: The layout of the proposed Chlapaty Recreation and Wellness
Center and the proposed parking area will be constructed in substantial compliance
with the adopted conceptual plan.
Permeable Area (%) & Location (Open Space): The proposed changes in this area
of campus will increase the amount of impervious area by approximately 10
percent. Storm water control and a storm water detention basin will be part of the
Chlapaty Center project and will be reviewed through the City's site plan review
process.
Landscaping/Screening: Planning staff recommends that screening be added
along the west side adjacent to the existing and proposed tennis courts to help
screen adjacent residential properties that front on Princeton Place.
Phasing of development: None.
Impact of Request on:
Utilities: Existing utilities are adequate to handle the proposed project.
Traffic Patterns/Counts: There are no traffic counts available for McCormick,
Bennett, Gilliam or West Streets.

Public Services: Existing public services are adequate to serve the si#e.
Environment: Staff does not anticipate any adverse impact to the environment
provided that adequate erosion control is provided during all phases of
construction and adequate storm water control is provided as part of the
development of the proposed project.
Adjacent Properties: The proposed new Chfapaty Recreation and Wellness
Center will be a significant visual change to this portion of the University of
Dubuque campus. In addition, one of the tennis courts will be relocated on the
south side of the existing two tennis courts. The service road that connects to
Gilliam and West Streets has been realigned, in response to concerns expressed
by surrounding homeowners. The service road initially was proposed to go
between the tennis courts and the single-family homes on Princeton Place but
has now been relocated to an area between the tennis courts and the new
Chlapaty Center.
CIP Investments: None proposed.
Staff Analysis: The University of Dubuque is requesting an amendment to their
Institutional District to allow the construction of the new Chlapaty Recreation and
Wellness Center to be located in the southwest portion of the campus adjacent to
Chalmer's Field. Amendments to the ID Institutional District are required where either
the institutional district boundaries are being expanded or significant on-campus
expansions are taking place. The proposed recreation and wellness center is a
significant investment for the University of Dubuque that will include the new building, a
new parking area for staff, students and visitors, replacement of the Chalmer's Field turf
with a synthetic surface and new bleachers for both home and visiting fans.
The proposed Chlapaty Recreation and Wellness Center will provide recreation space
for University of Dubuque faculty, staff and students, including an indoor track, fitness
center, men's and women's varsity locker rooms, meeting facilities for athletic
department staff, restrooms, concessions area and space for coaches and the press.
The current bleachers for Chalmer's Field will be integrated into the west building wall
of the Chlapaty Center and will provide 1,825 seats. The proposed Chlapaty Center will
be built over the existing parking lot currently serving this portion of campus. Anew
parking area will be built on the south side of the Chlapaty Center north of the two
existing and one proposed tennis courts. The service drive that serves this portion of
the campus will be routed between the Chlapaty Center and the tennis courts. The
proposed service drive and parking lot also will serve the existing Potterveld
Apartments. Attached to this staff report is the conceptual plan and renderings that
show the proposed facilities, including floor layouts.

Chlapaty Recreation and Wellness Center
An issue that was raised during the Zoning Advisory Commission's review of the new
Facility Building proposed by the University of Dubuque is an existing problem with
storm water as it left the University of Dubuque campus and flowed toward Princeton
Place. The proposed development will include a new storm water detention facility.
The City Engineering Department has discussed with the University of Dubuque's
engineering firm additional field studies to determine existing downstream capacities
and future needs. Any necessary changes to storm water control facilities, either on the
University of Dubuque campus or off-site, will need to be identified and addressed as
part of a site plan submittal for the Chlapaty Center.
Another issue that may impact surrounding properties is that as part of the refurbishing
of Chalmer's Field with a new athletic playing surface, new light standards will be
installed for night games. ft is Planning staff's understanding that NCAA lighting
standards preclude these lights from being cut-off luminaries. University of Dubuque
officials have indicated they will be installing three (3) light standards on each side of
the field to allow light fixtures to be more narrowly focused. Each light standard will be
responsible for lighting a smaller portion of the field when compared to two (2) light
standards per side. Any new outdoor lighting other than those used to illuminate the
football fie{d will be required to utilize cut-off luminaries to limit the amount of light
leaving the area. Staff anticipates that because of Chalmers Field's elevation relative to
adjacent residential properties, there will be an increase in the ambient light levels
during sporting events requiring use of the new lights.
Planning staff also reviewed the existing and proposed amount of seating available for
Chalmer's Field. The new facility will increase the number of seats by 825. Currently,
there are 2,000 seats on the west side of Chalmers Field. The new facility will provide
1,825 seats on the west side and 1,000 seats on the east side for visiting fans. The
balance of the Chlapaty Recreation and Wellness Center will be utilized by University of
Dubuque staff and students, and thus, should not have an appreciable impact on the
surrounding street system in terms of traffic volumes or parking. The current parking lot
adjacent to Chalmers Field and the existing parking lot serving Potterveld Apartments
provides 140 parking spaces. The new parking lot proposed on the south side of the
Chlapaty Center will have 160 parking spaces. The Institutional District regulations
require one parking space for each six (6) permanent seats for athletic facilities. Based
on this requirement, a total of 471 parking spaces would be required for the 2,825 seats
proposed. Currently, 333 parking spaces should be provided for Chalmers Field with
the current 2,000 seats. The Institutional District wasn't created until the 1975 rewrite
of the City's Zoning Ordinance. Chalmers Field predates the creation of the University
of Dubuque Institutional District, and staffs interpretation _is that the field is
grandfathered.
Planning Services staff feel that 471 parking spaces are not necessary to
accommodate sporting events at Chalmers Field or the new Chlapaty Center.
Currently, with 2,000 seats and 140 parking spaces, staff is not aware of a parking
problem associated with sporting events held at Chalmers Field. This is due in part to

the fact many of the fans attending the games are students who live on campus. In
addition, there are several parking lots located in close proximity to Chalmers Field that
can provide parking for evening or weekend sporting events. The parking lot at the
north end of Chalmers Field has 70 spaces and the new parking lot west of the new
Meyers Academic and Administration Building has 130 parking spaces. Together, the
three lots provide 360 parking spaces. The Institutional District regulations allow off-
street parking requirements in Institutional Districts to be different than those contained
in Section 4-2 of the Zoning Ordinance. In summary, Planning staff believes there is
adequate off-street parking available to support the new Chlapaty Center and
improvements to Chalmers Field.
Planning staff recommends that the Zoning Advisory Commission review Section 3-
5.2(D)(4) that establishes the criteria for review of Institutional District amendments.

I have one major concern about approval of the University of Dubuque zoning
approval to build the Recreation and Wellness Center: WATER AND STORM
DRAINAGE. My property sets in the low point in the valley below the proposed center,
parking lot, and tennis courts. Over the years during severe ram storms or after heavy
saturation of the hillsides on the University property storm water has flooded my property
similar to the pictures attached to this letter. The iwo years shown in the photos (1993 and
1994)were the most severe occurences, but similar events have taken place about every
2 or 3 years since that time. Every time the University builds a structure that takes away
more grassy surface, the water problems tend to increase for me.
I have been told that the proposed water retention basin will begin 11 feet to the
rear of my property with a 7 foot berm. This means that several arborvitae and pine trees
will be removed and a nice privacy barrier destroyed. These trees are on University
property and were planted, I'm told by neighbors, about 50 years ago.
I have lots of questions about how big and deep this basin will be, as well as its
overall appearance. Will it have standing water in it after a rain? Wifl the storm pipe that it
drains into be .able to handle the water flow without puting in a bigger pipe? Are the city
engineers working with the University to handle on this issue?
I would appreciate the attention of the Commission on these matters.

copy of which is on file with the City of Dubuque Planning Services Department, for
property legally described to wit:.
Lots 2-1, 1 & 2 of 1-1-1 and Lot 2-1-1 all in Cain's Subdivision No. 2 and to the
center line of the adjoining public right-of--way, all in the City of Dubuque, Iowa.
Section 2. institutional District Regulations.
A. Use Regulations.
The following regulations shall apply to all uses made of land in
the above-described ID Institutional District:
Principal permitted uses shall be limited to:
a. Offices for administrative personnel or other
institutional employees and affiliates
b. Churches, libraries, and museums

c. Classrooms, laboratories, lecture halls, and similar places of
institutional assembly
d. Off-street parking and loading
e. Recreational or athletic facilities for the primary use and
benefit of institutional residents or affiliates
Single-family, two family or multi-family dwellings for the
housing of institutional residents or affiliates ]
2. Accessory Uses. The following uses shall be permitted as
accessory uses in the above-described ID Institutional District:
a. Located entirely within a principal building, bookstores, or
bars seating not more than seventy-five (75) persons at one
.time and located not closer than two hundred feet (200')
from the nearest Residential or Office Residential District.
b. All uses customarily incidental to the principal permitted
uses in conjunction with which such accessory uses
operated or maintained, but not to include commercial use
outside the principal building.
3. No conditional uses shall be allowed.
[ ]Parking requirements as per Section D of this Ordinance.
B. Lot and Bulk Regulations.
Development of land in the ID Institutional District shall be regulated as
follows:
The proposed Chlapaty Recreation and Wellness Center shall be
constructed in substantial conformance with the attached conceptual
development plan and all final site development plans are to be approved
in accordance with provisions of the ID Institutional District regulations.
C. Performance Standards
The development and maintenance of uses in this ID Institutional District
shall be established in conformance with Section 3-5.2 of the Zoning
Ordinance and the following standards:
That a storm water detention basin shall be designed and built as
part of the Chlapaty Center project subject to review and approval
by the City of Dubuque;;Engineering Department. The basin shall

be constructed at the beginning of the project to provide protection
to downstream property.
2. That appropriate erosion and sediment control will be installed prior
to commencement of any land disturbing activity related to the
Chlapaty project, including all required state and city permits
related to erosion control.
3. New outdoor lighting shall utilize 72-degree cut-off luminaries,
except new fighting for Chalmers Field.
4. Landscaping shall be provided in compliance with Section 4-5 of
the Zoning Ordinance, and arborvitae shall be planted along the
west property line to provide a buffer to the homes on Princeton
Place.
5. All utilities including telephone and cable television shall be
installed underground.
6. Final site development plans shall be submitted in accordance with
Section 4-4 of the Zoning Ordinance.
D. Parking Reauirements
The off-street parking requirements for the principal pem~itted uses for the
herein described ID Institutional District shall be regulated as follows::
That one hundred and sixty (160) off-street parking spaces shall be
provided in the new parking lot constructed south of the Chlapaty
Recreation and Wellness Center.
2. Any significant expansion or reduction in the number of off-street
parking spaces must be reviewed by Planning Services staff for
compliance with the adopted Institutional District regulations.
E. Open Space and Recreational Areas
Those areas not designated on the conceptual development plan for
developmen# shall be maintained as open space, as defined by Section 8
of the Zoning Ordinance by the property owner and/or association.
F. Sign Regulations
The sign regulations shall be the same as that which are allowed in the ID
Institutional District as established in Section 4-3.11 of the Zoning
Ordinance.

G. Additional Standards
That all previously approved conceptual development plans are hereby
amended to allow for the attached conceptual development plan.
H. Transfer of Ownership
Transfer of ownership or lease of property in this ID Institutional District
shall include the transfer or lease agreement a provision that the
purchaser or lessee acknowledges awareness of the conditions
authorizing the establishment of the district.
Modifications
Any modifications of this Ordinance must be approved by the City Council
in accordance with zoning reclassification proceedings of Section 6 of the
Zoning Ordinance.
J. Recording
A copy of this ordinance shall be recorded at the expense of the
property owners. with the Dubuque County Recorder as a
permanent record of the conditions accepted. as part of this
reclassification approval within thirty (30) days of the adoption of
this ordinance. This ordinance shall be binding upon the
undersigned and all his/her heirs, successors and assignees.
Section 3. That the foregoing amendment has heretofore been
reviewed by the Zoning Commission of the City of Dubuque, Iowa.
Section 4. That the foregoing amendment steal{ take effect upon
publication, as provided by law.
