Phyllrich Drive Residential Parking District_Second ReadingORDINANCE NO. AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF DUBUQUE, IOWA, BY ADOPTING A NEW SECTION 32-401 PROVIDING FOR THE DESIGNATION OF PHYLLRICH DRIVE BETWEEN KEYSTONE DRIVE AND KEYMONT DRIVE AS A RESIDENTIAL PARKING PERMIT DISTRICT Whereas, Sections 32-381 and 32-393 of the Code of Ordinances of the City of Dubuque, Iowa, empowers the City Council to establish a Residential Parking Permit District upon receipt of a valid petition and the finding of certain conditions; and Whereas, a valid petition has been received to declare an area described as follows as a Residential Parking Permit District: Phyllrich Drive, between Keystone Drive and Keymont Drive Whereas, the City Manager has caused a parking study of the above identified area to be conducted, and which study has established that the area meets the criteria as established in Section 32-383 of the Code of Ordinances of the City of Dubuque, Iowa: 1. At least 80 percent (80°l°) of the curbside parking spaces in the proposed Parking Permit District were utilized during peak periods; and 2. At least 25 percent (25%) of the curbside parking spaces in the proposed Parking Permit District were utilized by nonresident parkers; and Whereas, the City Manager, based upon the petition and the results of the parking study, recommends to the City Council that the area be designated as a Residential Parking Permit District during the hours of 7:00 a.m. to 3:00 p.m. daily, except Saturdays, Sundays, and holidays; and Whereas, the City Council pursuant to public notice on 23rd day of February, 2007, in the City of Dubuque Telegraph Herald, a newspaper of general circulation, met in session on the day of , 2007, at 6:30 p.m. at the Carnegie Stout Public Library, 360 11th Street, Dubuque, Iowa, for the purpose of hearing all interested persons and representatives of organizations and to consider any and all objections which have been filed to the proposed designation of the above area as a Residential Parking Permit District during the hours of 7:00 a.m. to 3:00 p.m. daily, except Saturdays, Sundays, and holidays; and Whereas, all interested parties have been given an opportunity to be heard and all objections have been duly considered. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That a petition containing the required number of signatures and meeting the intent and purpose of Section 32-381 through 32-393 of the Code of Ordinances of the City of Dubuque, Iowa, has been received by the City of Dubuque. Section 2. That any and all objections to the designation of the area as a Residential Parking Permit District during the hours of 7:00 a.m. to 3:00 p.m. daily, except Saturdays, Sundays, and holidays be and same are overruled. Section 3. That the recommendation of the City Manager based upon the petition and the parking study to designate the area as a Residential Parking Permit District during the hours of 7:00 a.m. to 3:00 p.m. daily, except Saturdays, Sundays, and holidays, is hereby approved and accepted. Section 4. That the Code of Ordinances of the City of Dubuque, Iowa, be amended by enacting the following new Section 32-401: SEC. 32-401. RES{DENTIAL PARKING PERMIT DISTRICT H. a) The following described area constitutes a Residential Parking Permit District designated as Residential Parking Permit "H". Phyllrich Drive, between Keystone Drive and Keymont Drive b) No vehicles shall park curbside in Residential Parking Permit District H during the hours of seven o'clock (7:00) A.M. to three o'clock (3:00) P.M., except Saturdays, Sundays, and holidays, without displaying a valid parking permit issued by the City. The City's parking study of this area indicates that during the requested time period, at least 80% of the curbside spaces were utilized, and at least 25°l° of such curbside parking spaces were utilized by non-resident parkers. The petition, therefore, meets the requirements of the RPPD ordinance. City Engineer Gus Psihoyos recommends City Council approval of the establishment of a Residential Parking Permit District on Phyllrich Drive between Keystone Drive and Keymont Drive between the hours of 7:00 a.m. to 3:00 p.m. daily, except Saturdays, Sundays and holidays. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Phyllrich Drive On October 18, 2006, a petition was received to obtain a Residential Parking Permit District (RPPD) on Phyllrich Drive between Keystone Drive and Keymont Drive. The petition represents in excess of 60 percent (60%) of the dwelling units along Phyllrich Drive between Keystone Drive and Keymont Drive, as is required under the ordinance. The petition requests that the parking restriction be effective between the hours of 7 a.m. and 3 p.m. daily, except Saturdays, Sundays and holidays. The City's parking study of this area indicates that during the requested time period, at least 80 percent (80%) of the curbside spaces were utilized, and at least 25 percent (25%) of such curbside parking spaces were utilized by non- resident parkers. The petition, therefore, meets the requirements of the RPPD ordinance. At its August 7, 2006 meeting, the City Council adopted an ordinance designating as Residential Parking Permit District H, Vizaleea Drive and Keymont Drive from Keyway Drive to its westerly terminus. At its December 4, 2006 meeting, the City Council adopted an ordinance designating as Residential Parking Permit District H, Hansel Drive between Keystone Drive and Keymont Drive. The time and days requested by the petitioners on Phyllrich Drive correspond to those in District H. Therefore, Phyllrich Drive should be added to District H. ACT{ON TO BE TAKEN It is recommended that Phyllrich Drive between Keystone Drive and Keymont Drive between the hours of 7 a.m. and 3 p.m. daily, except Saturdays, Sundays and holidays be approved and designated as a Residential Parking Permit District (RPPD). At the March 5, 2007 public hearing, the City Council may reject the petition, adopt an ordinance designating the proposed area as a Residential Parking Permit, or adopt an ordinance modifying the proposed district. The City Council may also adopt alternate hours other than the 7 a.m. to 3 p.m. parking restriction daily except Saturdays, Sundays and holidays. Many neighbors have contacted Hempstead administrators, district officials, the police department, the City Manager, and/or the City Council regarding these concerns. Concerns have most often fallen in the categories of safety, access to private property, and student behavior. We have heard complaints of drivers blocking fire hydrants, of sometimes careless parking on both sides of the street resulting in narrowed right-of--way, of vehicles blocking private driveways, of students trespassing on, littering or damaging private property, of rude or otherwise inappropriate language or behavior. If you have experienced any of the above, I apologize on behalf of the school district. I can, however, assure you that, when laws have been broken, we have supported police enforcement of those laws. When specific students have been identified by callers as the perpetrators of illegal or inappropriate behavior, school officials have investigated and applied disciplinary consequences. Many of the neighbors have also commented that they know that not all Hempstead students behave in the ways about which you have complained; both you and we know that we have many respectful and considerate students at Hempstead. However, I also understand and accept that, as a result of negative experiences, several additional neighborhoods have applied to and have been approved by the City Council for designation as Residential Parking Zones. Some other zones have been in place for a decade or more, so I also realize that the problems of parking near Hempstead pre-date current issues. For the past several months, I have been working with a small committee of district and school staff, students, parents, and city representatives to attempt to resolve at least some of the concerns. Early in our discussions, we agreed that any solution must include several elements: additional on-site parking; off-site parking options; strategies to encourage walking, car-pooling, and use of buses, or to discourage students from driving to school; 4. a "good neighbor" commitment on the part of students. SJ ~. iQ t ~ f(1 ti jhur ~crrt4tdubrajue.l~ 1?.ia.tis Additional on-site parking: Since 1995, the district has added 125 parking spaces at Hempstead, bringing the capacity to 691 currently. At the Board meeting on March 12, architects will be authorized to proceed with engineering and design plans for an expansion of parking behind Hempstead. This approximately $249,000 project will add 40 spaces on site. We have asked the architects to complete this project as quickly as possible, ideally over the summer, 2007. When combined with spaces we will regain when construction equipment and vehicles are removed, we will have added approximately 70 spaces. As planning progresses for additional phases of the renovation work at Hempstead, we will review options for providing additional spaces somewhere on the school's 39.2 acre property. We do not, however, believe that it is appropriate at a high school to convert green space needed for outdoor activities -baseball, tennis, softball, physical education -for use as parking lots. Off-site parking options: It may be possible to make arrangements for students/parents to lease an off-street parking spot in the lots of one of the neighboring churches or apartment complexes. To date, we have had only informal conversations regarding this possibility, but intend to pursue this as an option which may appeal to some students and their families. Strategies to reduce the number of students driving to school: Hempstead students and staff are trying to devise ways to encourage students who are eligible to do so to ride the school bus, and to encourage others to walk, ride bicycles, use the city bus, or car-pool to school. Some callers have asked why the school or district doesn't just "forbid" students from driving to school. Clearly, we can control the number of individuals allowed to park at school, but only parents have the authority to make a decision about allowing their teenager to drive to school or not. The more limits we place on the number of students allowed to park on-site, the more we "push" the problem of parking off our property -and onto someone else's. "Good neighbor" policy and procedures: Hempstead staff and many students are concerned about the "image" that has been created of Hempstead students as boorish and inconsiderate, and are working to develop an ongoing student-led plan for reconnecting in positive ways with Hempstead neighbors. Once those plans have been refined, they wish to invite neighbors to meet with them at Hempstead, both to hear your concerns directly, and to share with you their "good neighbor" plans. In the meantime, I encourage you to call the Hempstead principal's office to report any inappropriate student behavior, or to call the police department when you observe illegal activity. If you can provide information that helps our staff, or the police, identify the offender, that is more useful than just a general complaint. Finally, I thank you for your patience and for your tolerance of student behavior that may not, at all times, be what either parents or the school expects.
