Interstate Power & Light Company Electric Facilities Extension Agreement
City Engineer Gus Psihoyos is recommending execution of an agreement with Interstate
Power to activate the second power pedestal for electrical service on the easterly side
of Chavenelle Road in Dubuque Industrial Center West.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Interstate Power & Light Company Electric Facilities Extension Agreement
INTRODUCTION
This memorandum is to seek authorization to approve the Electric Facilities Extension
Agreement between Interstate Power and Light Company (Interstate Power) and the
City of Dubuque to provide electric service for roadway lighting along Chavenelle Road.
BACKGROUND
The Dubuque Industrial Center West 3rd Addition is a 150-acre project that involved the
installation of storm sewer, watermain, paving, fiber optic conduit, landscaping, and
streetlights at the former Bergfeld farm property and the east and west sections of
Chavenelle Road through the McFadden farm. The 25 streetlights along the south side
of Chavenelle Road are serviced by two (2) power pedestals.
In January, 2007, 15 of the 25 streetlights on the westerly side of Chavenelle Road
were activated.
DISCUSSION
In order to energize the remaining 10 streetlights on the easterly side of Chavenelle
Road, Interstate Power and Light Company requires the execution of the Electric
Facilities Extension Agreement.
The key elements of this Agreement include:
1. Interstate Power will construct, install, maintain, and operate the second power
pedestal to service these 10 streetlights on the easterly side of Chavenelle Road.
2. The City will provide a nonrefundable amount of $10,138.48 for the estimated
installation cost.
3. The City agrees to furnish at its expense all necessary easements and permits
required for the said installation.
4. The City agrees to physically mark the location of all obstacles that lie underground
within 10 feet of proposed excavation.
5. Title to all electric facilities will remain with Interstate Power.
RECOMMENDATION
recommend that the City Council authorizes the City Manager to execute the Facilities
Extension Agreement between Interstate Power and Light Company and the City of
Dubuque to activate the second power pedestal for electrical service on the easterly
side of Chavenelle Road.
BUDGET IMPACT
The estimated installation cost of $10,138.48 will be funded from the Dubuque Industrial
Center West 3~d Addition and Chavenelle Road Extension (CIP 3601481).
ACTION TO BE TAKEN
The City Council is requested to authorize the City Manager to execute the Facilities
Extension Agreement between Interstate Power and Light Company and the City of
Dubuque to activate the second power pedestal for electrical service to the streetlights
on the easterly side of Chavenelle Road.

This agreement made this 28`~ day of February, 2007 by and between Interstate Power and Light
Company, an Iowa corporation headquartered at 200 First Street SE, Cedar Rapids, Iowa, (hereinafter
referred to as "the Company") and City of Dubuque, acorporation/partnership/proprietorship with principal
offices at City of Dubuque, State of Iowa, (hereinafter referred to as "the Customer/Developer"):
WITNESSETH:
WHEREAS, the Company is engaged in the distribution of electricity, and
WHEREAS, the Customer/Developer is the owner of the following legally described premises:
Chavenelle Rd, East end street lite controller, as shown on the map attached hereto (marked Exhibit A) and
made a part hereof and;
WHEREAS, the Company desires to sell electricity to the owners or occupants of the residences, or
other buildings being built or installed on said premises, and the Customer/Developer desires to have
electricity available for such residences or other buildings, hereinafter called "Electric Service".
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
The Company agrees to construct, install, maintain and operate electric distribution facilities to serve
said premises upon application for Electric Service made by the owner or occupant of each such
residence or other building.
The Customer agrees to contribute anon-refundable amount of $10,138.48, to the Company for the
estimated cost of construction of electric facilities, less credits, as set out in Exhibit B, attached. The
Contribution In Aid of Construction or portions thereof will not be refunded for any subsequent
connections made to the electric facilities extension
3. The Customer/Developer agrees to furnish at his own expense all necessary easements and permits
required for the installation of said electric facilities. Prior to underground electric facilities installation the
customer/developer agrees to install lot pins and have existing grade within six inches of final grade.
Prior to overhead electric facilities installation the customer/developer agrees to install lot pins and have
existing grade within one foot of final grade. The Customer/Developer and the Company will cooperate
so that said construction and installation can be accomplished in the most economical manner.
4. The Customer/Developer agrees to physically mark the location of all obstacles on
Customer/Developer's site that lie underground within ten feet of proposed excavation. Such obstacles
may include, but are not limited to, septic and sewer systems, buried wire for out-buildings or decorative
lighting, drain tiles and LP gas lines. The Customer/Developer shall mark the location of all such
obstacles with stakes or flags or by painting the ground prior to and maintained until commencement of
the proposed excavation. The Customer/Developer accepts full responsibility for any and all damage to,
or damage caused by, Company or its contractor striking any such underground obstacles the
Customer/Developer fails to mark or marks incorrectly.
5. Title to all electric facilities installed pursuant to this agreement shall be in the Company

6. Applications for electric service referred to above shall be subject to and pursuant to applicable rules and
regulations of the company effective at the date of said applications with respect to the availability of
electricity and the rates and charges for same.
