Van Milligen, City Manager SUBJECT: Acceptance of Public Improvements in Cedar Ridge Farm Place No. 7 City Engineer Gus Psihoyos is recommending acceptance of the public improvements that the developer, Nemmers Cedar Ridge Farm, LP, has recently completed in Cedar Ridge Farm Place No. 7. Maintenance of said improvements shall be the responsibility of the contractors, Connolly Construction, Inc. and River City Paving, and the owner, Nemmers Cedar Ridge Farm, LP, for a period of two years from the date of acceptance. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer ,~ SUBJECT: Acceptance of Public Improvements in Cedar Ridge Farm Place No. 7 INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements which the developer, Nemmers Cedar Ridge Farm, LP, has recently completed in Cedar Ridge Farm Place No. 7. BACKGROUND As a condition of subdivision plat approval through Resolution No. 489-04, the developer of Cedar Ridge Farm Place No. 7 was required to install certain improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and a stormwater detention facility and to dedicate these improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. Nemmers Cedar Ridge Farm, LP has requested City's acceptance of the improvements in Cedar Ridge Farm Place No. 7. Upon inspection by the City, it has been determined that all of the public improvements required by Resolution No. 489-04 have been completed in accordance with plans approved by the City Council and in conformance with City specifications, except for the installation of one streetlight. Since the location of this light cannot be determined until additional electrical distribution and lots are laid out, Nemmers Cedar Ridge Farm, LP, has provided additional securities to cover this cost. RECOMMENDATION I would, therefore, recommend that the City Council accept the improvements. Maintenance of said improvements shall be the responsibility of the contractors, Connolly Construction, Inc. and River City Paving, and the owner, Nemmers Cedar Ridge Farm, LP, for a period of two (2) years from the date of acceptance by the City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the improvements. Prepared by Ronald J. Turner, PLS RESOLUTION NO. 175-07 ACCEPTING IMPROVEMENTS IN CEDAR RIDGE FARM PLACE NO. 7 Whereas, pursuant to Resolution No. 489-04, certain public improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and a stormwater detention facility were installed by the developer of Cedar Ridge Farm Place No. 7. Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBQUE, IOWA: Section 1. That the .recommendation of the City Manager be approved and that said public improvements in Cedar Ridge Farm Place No. 7 be and the same is hereby accepted. Section 2. That maintenance of said improvements shall be the responsibility of the contractor and owner for a period of two (2) years from this date. Passed, approved and adopted this 2nd day of April , 2007.
