Van Milligen, City Manager FROM: Don Vogt, Public Works Director DATE: June 6, 2014 SUBJECT: Request for Acceptance of the Purina Drive Barge Docking Facility Repair Project (CIP#S802479) Dubuque trati a -America City '111' 2007 • 2012 • 2013 INTRODUCTION The attached resolution provides for the acceptance of the construction contract for the Purina Drive Barge Docking Facility Repair Project, as completed by Dubuque Barge and Fleeting DBA Newt Marine Service of Dubuque, Iowa at a final project cost of $608209.15. BACKGROUND In the fiscal year 2014 Capital Improvement Project budget, funds ($670,577) are allotted for the repair of the Purina Drive barge docking facility. Engineering plans and specifications, along with construction inspection and testing services, for this project were completed by IIW Engineering & Surveyors, P.C. This project provided for the installation of new sheet pile dock facing and a related tie -back system. It also provided for the removal of an abandoned conveyor system. The dock facility is used to unload salt and other dry materials subsequently stored on City -owned property by contracted lessees. PROJECT COST - BUDGET IMPACT Bid Award Final Costs Construction Contract $ 589,850.00 $ 608,209.15 Contingency 19,277.00 .00 EngineeringAnspection 61,450.00 69,149.20 Environmental 15.000.00 Total Project Cost $ 670 577.00 $ 692,358.35 This project is funded with monies budgeted specifically for the Purina Drive Barge Docking Facility Repair Project in the Public Works Department's fiscal year 2014 Capital Improvement Project budget (CIP#6802479) in the amount of $670,577.00. The $21781.35 overage for this project will be billed to the docking facility's current lease -holder, as per the current lease agreement. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the Purina Drive Barge Docking Facility Repair Project improvement and authorizing payment of the final contract amount of $608 209.15 to Newt Marine of Dubuque, Iowa. Dubuque Barge & Fleeting DBA Newt Marine Service of Dubuque, Iowa, has completed construction of the above referenced Project in compliance with the drawings and specifications. The final project construction cost is $608,209.15. We recommend that the City of Dubuque approve and accept the Purina Drive Barge Dock Maintenance Project work. Retainage in the amount of $30,410.46 will be held for 30 days after acceptance and paid at that time provided no claims from others are filed. We will prepare Contract Payment No. 7 Final for the retainage due the contractor at the appropriate time. Approval and acceptance starts the two year warranty period. SURVEYORS. iiw RESOLUTION NO. 169-14 ACCEPTING THE PURINA DRIVE BARGE DOCKING FACILITY REPAIR PROJECT AND AUTHORIZING THE PAYMENT OF THE FINAL CONTRACT AMOUNT TO THE CONTRACTOR Whereas, the Public Improvement Contract for the Purina Drive Barge Docking Facility Repair Project (the Project) has been completed and IIW Engineers & Surveyors, P.C. of Dubuque, Iowa, the City's consulting engineering firm, has examined the work and filed a letter stating that the Project has been completed according to the terms of the Public Improvement Contract and has recommended that the Project be accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City's consulting firm is approved and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay the Contractor from the Public Works Department's FY2014 Capital Improvement Project budget code 680- 2479 appropriation the contract amount of $608,209.15 less any retained percentage provided therein as provided in Iowa Code, Chapter 573, and pay such retainage only in accordance with the provisions of Iowa Code Chapter 573.
