INTRODUCTION
This memorandum transmits the Final Plat of Timber-Hyrst Estates #4. A resolution and
related materials for City Council review and approval are attached. The submitted
Final Plat of Timber-Hyrst Estates #4 is a continuation of the existing subdivision that
begins at Manson Road and will, with the completion of the latest phase, extend all the
way to North Cascade Road. The City Council reviewed and approved Phase #3 of this
subdivision at their December 17, 2012 City Council meeting.
DISCUSSION
The submitted Final Plat of Timber-Hyrst Estates #4 subdivides approximately 127
acres into 111 single-family lots. The Final Plat includes the construction of two new
public streets, Cherry Ridge Drive and Hunters Glen Court. Both new streets will be
built with 31 feet of paving and a 60 -foot right-of-way.
Creekwood Drive will begin at North Cascade Road and extend southward and
eastward to a point where it connects with the existing terminus of Creekwood Drive.
Creekwood Drive will be built with a 60 -foot right-of-way and 31 feet of paving measured
from back of curb to back of curb with parking restricted to one side. However, the
section of Creekwood Drive connected to North Cascade Road and extending south for
approximately 1,400 feet, will be constructed with 27 -foot of paving within a 60 -foot
right-of-way and parking restricted on both sides. The narrower street width for this
section of Creekwood Drive is being done to reduce impermeable area and since there
is no proposed platting of building Tots along this section of Creekwood Drive.
The subject subdivision complies with the Unified Development Code's 40 points of
sustainability by:
1) utilizing the City's alternate street standard of a 27 -foot wide paved street;
2) that the covenants require the planting of trees on private property;

3) that street trees will be provided throughout the subdivision, and that the
preservation of existing trees on-site will be insured;
4) that the street lights will utilize LED lighting; and
5) that the grading and development is confined to the area of the property that was
used for agricultural purposes, preserving the wooded hillsides and steeper
sloped areas from development.
RECOMMENDATION
Staff recommends approval of the resolution for the Final Plat of Timber-Hyrst Estates
#4 as it is in compliance with the City of Dubuque Unified Development Code.

RESOLUTION NO. 181-14
RESOLUTION APPROVING THE FINAL PLAT OF TIMBER-HYRST ESTATES #4 IN
THE CITY OF DUBUQUE, IOWA
Whereas, North Cascade Road Developers, LLC, as owners, have filed with the
City Clerk the Final Plat of Timber-Hyrst Estates #4 in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Creekwood Drive
(Lot K), Timber-Hyrst Court (Lot L), Cherry Ridge Court (Lot M), North Cascade Road
(Lot N), and a Detention Basin (Lot J), together with certain public utility, access, storm
sewer, storm drainage, sanitary sewer and water main easements, which North
Cascade Road Developers, LLC by said final plat have dedicated to the public forever;
and
Whereas, said Plat provides zero feet of frontage for Lot A and Lot J , where fifty
feet is required by Section 16-11-14(B)of the Unified Development Code; and
Whereas, said Preliminary Plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that no streets or
public utilities have yet been constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Creekwood Drive (Lot K), Timber-Hyrst Court
(Lot L), Cherry Ridge Court (Lot M), North Cascade Road (Lot N), and a Detention
Basin (Lot J), together with the easements for public utilities, access, storm sewer,
storm drainage, sanitary sewer and water main, as they appear upon said final plat, be
and the same are hereby accepted.
Section 2. That Section 16-14-11(B) of the Unified Development Code is
waived to allow Lot A and Lot J to have zero feet of frontage, where fifty feet of frontage
is required.
Section 3. That the Final Plat of Timber-Hyrst Estates #4 is hereby approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said Final Plat, provided the North Cascade
Road Developers, LLC execute their written acceptance hereto attached agreeing:
(a) To reduce Creekwood Drive (Lot K), Timber-Hyrst Court (Lot L), Cherry
Ridge Court (Lot M), and North Cascade Road (Lot N) to grade and
construct longitudinal sub -drain, concrete curb and gutter, with asphaltic
concrete pavement, or Portland Cement concrete pavement with integral
curb, all in accordance with the City of Dubuque standard specifications,
all in a manner acceptable to the City Engineer, in conformance with
construction improvement plans approved by the City Engineer, and
inspected and approved by the City Engineer.
(b) To install sanitary sewer main and sewer service laterals into each
individual lot, water main and water service laterals into each individual
lot, detention basins, storm sewers and catch basins, roadway culverts,
boulevard street lighting, fiber optic conduit, and erosion control devices
all in accordance with the City of Dubuque standard specifications, all in a
manner acceptable to the City Engineer, and in accordance with
construction improvement plans approved by the City Engineer, and
inspected and approved by the City Engineer.
(c) To construct accessible sidewalk ramps at the intersections of Creekwood
Drive & Timber-Hyrst Court, Creekwood Drive and Cherry Ridge Court,
and at approximate Station 70+75 on Creekwood Drive, and along the
east side of Creekwood Drive from approximate Station 70+50 to North
Cascade Road right of way, in accordance with the City of Dubuque
standard specifications, all in a manner acceptable to the City Engineer,
and in accordance with construction improvement plans approved by the
City Engineer, and inspected and approved by the City Engineer.
(d) To construct the improvements outlined in (a) and (b) and (c) within two
(2) years from the date of acceptance of this resolution, at the sole
expense of North Cascade Road Developers, LLC, or future owner;
(e) To maintain the improvements outlined in (a) and (b) and (c), for a period
of two (2) years from the date of the acceptance of those improvements
by the City Council of the City of Dubuque, Iowa, at the sole expense of
North Cascade Road Developers, LLC, or future owner;
(f)

To provide security for the performance of the foregoing conditions
specified in this Section in such form and with such sureties as may be
acceptable to the City Manager of the City of Dubuque, Iowa.
To provide a Grant of Easement for Culvert Pipe, Embankment Slope,
and Storm Water Impoundment from Gary Valentine satisfactory to and
benefitting the City of Dubuque over a portion of Lot 1 of Valentine Place
No. 3 in the City of Dubuque.
Section 4. Sidewalk installation shall be the responsibility of each lot owner
abutting the public rights-of-way, including Tots with multiple frontages, as required by
City Code Chapter 10-1-2 (Sidewalk Installation and Repair) and 16-11-16 (Sidewalks).
Installation of the section of sidewalk along the west side of Creekwood Drive from its
intersection with North Cascade Road to the north property line of Lot 37 is waived until
such time as the adjacent property is developed. Once development occurs on the
subject property, sidewalk installation will be required by City Code Chapters 10-1-2
and 16-11-16.
Section 5. That the owner must continue to maintain Lot J of Timber-Hyrst
Estates #4 and stormwater detention facility until (1) the facility has been fully
completed, (2) 80% of the platted Tots (Lots 1-5, 94, 95, and 106-111, inclusive) of
Timber-Hyrst Estates #4, and subdivisions thereof have been fully developed, and (3)
adequate erosion control measures, as approved by the City Engineer, have been
installed on the remaining 20% of the Tots. Acceptance of the detention facility must be
by the City Council as required by the Unified Development Code. Upon the City's
acceptance of the detention facility, the inspection, administrative and maintenance
expenses incurred by the City of Dubuque for the storm water detention facility (Lot J)
shall be assessed against the property owners, except the City of Dubuque, of all
phases of Timber-Hyrst Estates #4, as indicated above and on the Preliminary Plat of
Timber-Hyrst Estates Phase III, in equal amounts, and the City Manager shall certify
such costs to the City Clerk, who in turn shall promptly certify such costs to the
Dubuque County Treasurer, and such costs shall then be collected with and in the
same manner as general property taxes in accordance with provisions of law.
Section 6. That the planting of street trees shall be coordinated with the City
Forester. Trees planted within the street right-of-way must be chosen and planted by
the City of Dubuque Leisure Services Department at the developer's expense.
Section 7. That the final acceptance of all public improvements shall only
occur upon certification of the City Engineer to the City Council that all public
improvements have been completed in accordance with the approved improvement
plans and City standard specifications and accepted by City Council Resolution.
Section 8. That in the event North Cascade Road Developers, LLC fails to
execute the acceptance and furnish the guarantees provided hereof within 180 days
after the date of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication and approval of the plat shall not be effective.
Section 9. That in the event North Cascade Road Developers, LLC fails to
provide a Grant of Easement for Culvert Pipe, Embankment Slope, and Storm Water
Impoundment from Gary Valentine benefitting the City of Dubuque over a portion of Lot
1 of Valentine Place No. 3 in the City of Dubuque within 30 days after the date of this
Resolution, the provisions hereof shall be null and void and the acceptance of the
dedication and approval of the plat shall not be effective.

Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use element Goals: 1.2, 1.5, 4.1, 4.4 and 7.2.
Impact of Request on:
Utilities: The existing portion of the subdivision is currently served by City water and
sewer mains. Both water and sewer are located at the end of Creek Wood Drive
where it ends at Phase 3 of Timber-Hyrst Estates. These mains will be extended
to serve Phase 4 of the subdivision
Traffic Patterns: The proposed subdivision includes an extension of Creek Wood
Drive, a new cul-de-sac to be named Timber-Hyrst court and a stub street to serve
a future phase named Cherry Ridge Drive. Creek Wood Drive is proposed to be
built with a 60 -foot right-of-way and 31 feet of paving with parking restricted to one
side through the residential section of the subdivision. The section of Creek Wood
Drive beginning at North Cascade Road and extending south for approximately,
1,400 feet, will be built with 27 feet of paving width within 60 feet of right-of-way
with parking restricted on both sides of the roadway. Timber-Hyrst Court will also
be built with 60 feet of right-of-way and 31 feet of paving and parking allowed on
both sides.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development of
the property, and that adequate storm water management is provided as per City
requirements.
Adjacent Properties: Staff does not anticipate any significant impacts to adjacent
properties beyond additional vehicle trips on Manson Road and North Cascade
Road as the subdivision is built -out with new homes.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Timber-Hyrst Estates #4 subdivides
approximately 130 acres into 109 buildable lots and is the fourth phase of the
subdivision. The subject property is zoned R-3, Moderate Density Multi -Family
Residential District. The subject property was annexed into the City of Dubuque in
August 2006.

The first phase of timber-Hyrst Estates was approved in April 2006, and included the
development of 30 building lots and the construction of Creek Wood Drive and a bridge
over Catfish Creek near Creek Wood Drive's intersection with Manson Road. The
second phase of Timber-Hyrst Estates included the development of 50 building lots, the
dedication of land for a public park, construction of the public Street Heather Glen, and
extension of Creek Wood Drive. The third phase of Timber-Hyrst Estates included the
development of 34 building lots, the construction of the public street Deer Creek Ridge,
and extension of Creek Wood Drive.
The subject property can be served by City water and sanitary sewer mains through
extension of the mains from the current terminus of Creek Wood Drive. Storm water
control/detention has been reviewed in detail as part of the improvement plans. Lot J
will be utilized for storm water detention. The development of the subdivision also
preserves much of the wooded hillsides and minimizes the percentage of land disturbed
to encourage the infiltration of storm water. The subdivision is in compliance with the
City's storm water policies and regulations.
The proposed extension of Creek Wood Drive will be built with a 60 -foot right-of-way
and 31 feet of paving measured from back -of -curb to back -of -curb, with parking
restricted to one side. However, the section of Creek Wood Drive connected to North
Cascade Road and extending south for approximately 1,400 feet shall be constructed
with 27 feet of paving within a 60 -foot right-of-way and parking restricted on both sides.
The initial portion of Creek Wood Drive was built with a 50 -foot right-of-way and 27 feet
of paving and parking is restricted to one side only.
The 1,400 foot long section of Creekwood Drive from North Cascade Road south to the
first building lot will only have sidewalk on the west side of the roadway. The sidewalk
on the east side is being requested to be waived until such time as the property to the
west is developed.
The proposed cul-de-sac street (Timber-Hyrst Court) on the north side of Creek Wood
Drive will also be built to 60 feet of right-of-way and 31 feet of paving, with parking
allowed on both sides of the street. Typically, a residential cul-de-sac street has only
50 feet of right-of-way. The developer is proposing a 60 -foot right-of-way to allow for a
greater parkway width.
The Final Plat also includes a short stub street to be named Cherry Ridge Drive that will
provide access to an area for a future phase of Timber-Hyrst Estates (Lot H). This
public street will also be built with 60 feet of right-of-way and 31 feet of paving.
Creek Wood Drive will be extended to North Cascade Road from the existing portion of
Creek Wood Drive. The submitted Final Plat and resolution commits the developer of
completing the extension of Creek Wood Drive to North Cascade Road within a two-
year time frame.

The fourth phase of Timber-Hyrst Estates is subject to the UDC's 40 points of
sustainability requirements. The 40 points have been achieved through the following:
1. One-third of Tots are oriented for passive solar = 10 pts.
2. 27 -foot wide street = 5 points.
3. Covenants require planting of trees for each lot = 5 pts.
4. Street trees will be planted = 5 pts.
5. Preservation of existing trees = 5 pts.
6. LED street lights = 5 pts.
7. Disturbed area limited = 5 pts.
TOTAL: 40 pts.
Planning staff recommends that the Zoning Advisory Commission approve the
submitted Final Plat of Timber-Hyrst Estates #4 as it is in compliance with the City of
Dubuque Subdivision Regulations.
