A resolution and related materials for City Council review and approval are attached. The submitted Final Plat of Timber-Hyrst Estates #4 is a continuation of the existing subdivision that begins at Manson Road and will, with the completion of the latest phase, extend all the way to North Cascade Road. The City Council reviewed and approved Phase #3 of this subdivision at their December 17, 2012 City Council meeting. DISCUSSION The submitted Final Plat of Timber-Hyrst Estates #4 subdivides approximately 127 acres into 111 single-family lots. The Final Plat includes the construction of two new public streets, Cherry Ridge Drive and Hunters Glen Court. Both new streets will be built with 31 feet of paving and a 60 -foot right-of-way. Creekwood Drive will begin at North Cascade Road and extend southward and eastward to a point where it connects with the existing terminus of Creekwood Drive. Creekwood Drive will be built with a 60 -foot right-of-way and 31 feet of paving measured from back of curb to back of curb with parking restricted to one side. However, the section of Creekwood Drive connected to North Cascade Road and extending south for approximately 1,400 feet, will be constructed with 27 -foot of paving within a 60 -foot right-of-way and parking restricted on both sides. The narrower street width for this section of Creekwood Drive is being done to reduce impermeable area and since there is no proposed platting of building Tots along this section of Creekwood Drive. The subject subdivision complies with the Unified Development Code's 40 points of sustainability by: 1) utilizing the City's alternate street standard of a 27 -foot wide paved street; 2) that the covenants require the planting of trees on private property; Page 2 3) that street trees will be provided throughout the subdivision, and that the preservation of existing trees on-site will be insured; 4) that the street lights will utilize LED lighting; and 5) that the grading and development is confined to the area of the property that was used for agricultural purposes, preserving the wooded hillsides and steeper sloped areas from development. RECOMMENDATION Staff recommends approval of the resolution for the Final Plat of Timber-Hyrst Estates #4 as it is in compliance with the City of Dubuque Unified Development Code. Thank you. To provide a Grant of Easement for Culvert Pipe, Embankment Slope, and Storm Water Impoundment from Gary Valentine satisfactory to and benefitting the City of Dubuque over a portion of Lot 1 of Valentine Place No. 3 in the City of Dubuque. Section 4. Sidewalk installation shall be the responsibility of each lot owner abutting the public rights-of-way, including Tots with multiple frontages, as required by City Code Chapter 10-1-2 (Sidewalk Installation and Repair) and 16-11-16 (Sidewalks). Installation of the section of sidewalk along the west side of Creekwood Drive from its intersection with North Cascade Road to the north property line of Lot 37 is waived until such time as the adjacent property is developed. Once development occurs on the subject property, sidewalk installation will be required by City Code Chapters 10-1-2 and 16-11-16. Section 5. That the owner must continue to maintain Lot J of Timber-Hyrst Estates #4 and stormwater detention facility until (1) the facility has been fully completed, (2) 80% of the platted Tots (Lots 1-5, 94, 95, and 106-111, inclusive) of Timber-Hyrst Estates #4, and subdivisions thereof have been fully developed, and (3) adequate erosion control measures, as approved by the City Engineer, have been installed on the remaining 20% of the Tots. Acceptance of the detention facility must be by the City Council as required by the Unified Development Code. Upon the City's acceptance of the detention facility, the inspection, administrative and maintenance expenses incurred by the City of Dubuque for the storm water detention facility (Lot J) shall be assessed against the property owners, except the City of Dubuque, of all phases of Timber-Hyrst Estates #4, as indicated above and on the Preliminary Plat of Timber-Hyrst Estates Phase III, in equal amounts, and the City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the Dubuque County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law. Section 6. That the planting of street trees shall be coordinated with the City Forester. Trees planted within the street right-of-way must be chosen and planted by the City of Dubuque Leisure Services Department at the developer's expense. Section 7. That the final acceptance of all public improvements shall only occur upon certification of the City Engineer to the City Council that all public improvements have been completed in accordance with the approved improvement plans and City standard specifications and accepted by City Council Resolution. Section 8. That in the event North Cascade Road Developers, LLC fails to execute the acceptance and furnish the guarantees provided hereof within 180 days after the date of this Resolution, the provisions hereof shall be null and void and the acceptance of the dedication and approval of the plat shall not be effective. Section 9. That in the event North Cascade Road Developers, LLC fails to provide a Grant of Easement for Culvert Pipe, Embankment Slope, and Storm Water Impoundment from Gary Valentine benefitting the City of Dubuque over a portion of Lot 1 of Valentine Place No. 3 in the City of Dubuque within 30 days after the date of this Resolution, the provisions hereof shall be null and void and the acceptance of the dedication and approval of the plat shall not be effective. Staff Analysis: The submitted Final Plat of Timber-Hyrst Estates #4 subdivides approximately 130 acres into 109 buildable lots and is the fourth phase of the subdivision. The subject property is zoned R-3, Moderate Density Multi -Family Residential District. The subject property was annexed into the City of Dubuque in August 2006. Subdivision Staff Report —Final Plat of Timber Hyrst Estates #4 Subdivision Page 3 The first phase of timber-Hyrst Estates was approved in April 2006, and included the development of 30 building lots and the construction of Creek Wood Drive and a bridge over Catfish Creek near Creek Wood Drive's intersection with Manson Road. The second phase of Timber-Hyrst Estates included the development of 50 building lots, the dedication of land for a public park, construction of the public Street Heather Glen, and extension of Creek Wood Drive. The third phase of Timber-Hyrst Estates included the development of 34 building lots, the construction of the public street Deer Creek Ridge, and extension of Creek Wood Drive. The subject property can be served by City water and sanitary sewer mains through extension of the mains from the current terminus of Creek Wood Drive. Storm water control/detention has been reviewed in detail as part of the improvement plans. Lot J will be utilized for storm water detention. The development of the subdivision also preserves much of the wooded hillsides and minimizes the percentage of land disturbed to encourage the infiltration of storm water. The subdivision is in compliance with the City's storm water policies and regulations. The proposed extension of Creek Wood Drive will be built with a 60 -foot right-of-way and 31 feet of paving measured from back -of -curb to back -of -curb, with parking restricted to one side. However, the section of Creek Wood Drive connected to North Cascade Road and extending south for approximately 1,400 feet shall be constructed with 27 feet of paving within a 60 -foot right-of-way and parking restricted on both sides. The initial portion of Creek Wood Drive was built with a 50 -foot right-of-way and 27 feet of paving and parking is restricted to one side only. The 1,400 foot long section of Creekwood Drive from North Cascade Road south to the first building lot will only have sidewalk on the west side of the roadway. The sidewalk on the east side is being requested to be waived until such time as the property to the west is developed. The proposed cul-de-sac street (Timber-Hyrst Court) on the north side of Creek Wood Drive will also be built to 60 feet of right-of-way and 31 feet of paving, with parking allowed on both sides of the street. Typically, a residential cul-de-sac street has only 50 feet of right-of-way. The developer is proposing a 60 -foot right-of-way to allow for a greater parkway width. The Final Plat also includes a short stub street to be named Cherry Ridge Drive that will provide access to an area for a future phase of Timber-Hyrst Estates (Lot H). This public street will also be built with 60 feet of right-of-way and 31 feet of paving. Creek Wood Drive will be extended to North Cascade Road from the existing portion of Creek Wood Drive. The submitted Final Plat and resolution commits the developer of completing the extension of Creek Wood Drive to North Cascade Road within a two- year time frame.
