The enclosed material provides for City Council acceptance of the public improvements
that the developers, GNZ Properties Inc., L. Wingate Properties LLC, and D. Wingate
Real Estate LLC, have recently completed in Wingate Place No. 5.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 63-12, the developer
of Wingate Place No. 5 was required to install certain improvements including street
paving with curb, sanitary sewer main, watermain, storm sewers and catch basins,
detention facilities, and street lighting and to dedicate these improvements to the City
upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On December 12, 2013, the owners requested City's acceptance of the improvements
in Wingate Place No. 5. Upon inspection by the City, it has been determined that the
public improvements required by Resolution 63-12 have been completed, with the
exception of the storm water detention facilities, in accordance with plans approved by
the City Council and in conformance with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements
with the exception of the storm water detention facilities. Maintenance of said public
improvements shall be the responsibility of the owners, GNZ Properties Inc., L. Wingate
Properties LLC, and D. Wingate Real Estate LLC, for a period of two (2) years from the
date of acceptance by City Council. Per Resolution No. 63-12, the storm water
detention facilities (on Lot B Wingate Place No. 3) may be accepted after 80 percent of
the lots in the Wingate Place No 2, 3, 4, and 5 are developed and adequate erosion
control measures are installed on the remaining 20 percent of the lots.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements, with the exception of storm water detention facilities, in Wingate Place
No. 5.

RESOLUTION NO. 189-14
ACCEPTING PUBLIC IMPROVEMENTS IN WINGATE PLACE NO. 5 IN THE CITY OF
DUBUQUE, IOWA
Whereas, pursuant to Resolution 63-12, certain public improvements including
street paving with curb, storm sewer and catch basins, storm water detention facilities,
sanitary sewer, watermain, and street lighting were installed by the developer of
Wingate Place No. 5 in the City of Dubuque, Iowa; and
Whereas, the improvements, except for storm water detention facilities, have
been completed and the City Manager has examined the work and has filed a certificate
stating that the same has been completed in accordance with the plans approved by the
City Council and in conformance with City specifications, and has recommended that
the improvements be accepted by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and
that said public improvements in Wingate Place No. 5, except for the storm water
detention facilities, be and the same is hereby accepted.
Section 2. That maintenance of said public improvements shall be the
responsibility of the owners, GNZ Properties Inc., L. Wingate Properties LLC, and D.
Wingate Real Estate LLC, for a period of two (2) years from the date of this resolution.
Passed, approved and adopted this 7th day of July, 2014.
