SUBJECT: Plat Approval -Lot 1 and Lot 2 of Finley Home Addition No. 2
City Engineer Gus Psihoyos recommends City Council approval of the Plat of Survey for
Lot 1 and Lot 2 of Finley Home Addition No. 2, as approved by the City of Dubuque
Zoning Board of Adjustment.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This is a follow-up to the disposal of Lot 1 of Finley Home Addition No. 2 to The
Finley Hospital.
DISCUSSION
On March 5, 2007, a public hearing was held for the disposition of the City's
interest in Lot 1 of Finley Home Addition No. 2 to The Finley Hospital. At the time
of the public hearing, the Plat of Survey for this lot was in the review/approval
process with the City of Dubuque Zoning Board of Adjustment. The request for a
variance of lot frontage and area was officially adopted on March 22, 2007.
RECOMMENDATION
I recommend the Plat of Survey be approved for Lot 1 and Lot 2 of Finley Home
Addition No. 2 as approved by the City of Dubuque Zoning Board of Adjustment.
ACTION TO BE TAKEN
The recommendation of the City Manager and the adoption of the enclosed
resolution should be approved.

RESOLUTION APPROVING PLAT OF SURVEY OF LOT 1 AND LOT 2 OF FINLEY
HOME ADDITION NO. 2
Whereas, there has been presented to the City Council of the City of Dubuque, Iowa, a
plat dated the 16`h day of January, 2007, prepared by IIW Engineers & Surveyors, PC,
describing the proposed division of Lots 24, 25, and 32C of Finley Home Addition No. 2; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the plat dated the 16`" day of January, 2007, prepared by IIW
Engineers & Surveyors, PC, relative to the real estate hereinabove described be and the same
is hereby approved, and the Mayor and City Clerk be and they are hereby authorized and
directed to execute said plat for and on behalf of the City of Dubuque, Iowa.
Section 2. The City of Dubuque reserves unto itself a perpetual easement including
the right of ingress and egress thereto, for the purpose of erecting, installing, constructing,
reconstructing, repairing, owning, operating, and maintaining water, sewer, drainage, gas,
telephone, television cable, fiber optics, and electric lines as may be authorized by the City of
Dubuque, Iowa, over and across the entire Lot 1 of Finley Home Addition No. 2.

DATE OF PUBLIC MEETINGIDECISION: February 22, 2007
The Zoning Board of Adjustment of the City of Dubuque, Iowa hereby renders and gives
notice of its decision on the above-captioned application in conformance with Section 5 of
the Zoning Ordinance.
APPLICATION: The applicant seeks a variance create a lot with 44.47 feet of frontage
and 3,958 square feet of lot area, 50 feet and 5,000 square feet required, in an ID
Industrial District.
PUBLIC MEETING: After notice, as required by law, a Public Meeting was held on
February 22, 2007. Minutes of the meeting and copies of materials submitted in evidence
are on file in the Office of Planning Services, City Hall, Dubuque, Iowa.
FINDINGS: Based on the speck information presented at the Public Meeting and
contained in the application, and in accordance with the applicable standards in the Zoning
Ordinance, the Board makes the following findings:
1. The request does not adversely impact adjacent properties and the new drive
access will improve public safety.
CONCLUSION: The Board has determined that the application will meet the standards for
granting a variance as required by Section 5-3.5(C) of the Zoning Ordinance.
DECISION: By a vote of 5 to 0, as indicated in the minutes, the Board approves the
variance request, with the condition that the lot be used for improved drive access.
