SUBJECT: Multijurisdictional Drug Task Force Agreement -City of Dubuque,
Dubuque County, City of East Dubuque, Illinois and Jo Daviess County,
Illinois
For the past several years the City of Dubuque, Dubuque County, the City of East
Dubuque, Illinois and Jo Daviess County, Illinois have jointly worked in the investigation
and prosecution of illegal drug use through the use of a multijurisdictional drug task
force agreement which is scheduled to expire on April 30, 2007. Task force operations
have become the cornerstone to the City's illegal drug investigation capabilities. Having
the ability to share resources, information and other investigative assets continues to
strengthen the City's abilities as the City works to combat the very mobile and adaptable
illegal drug trade.
Chief of Police Kim Wadding recommends City Council approval of the Multi-
jurisdictional Drug Task Force Agreement between the City of Dubuque, Dubuque
County, the City of East Dubuque, Illinois and Jo Daviess County, Illinois.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION:
The purpose of this memorandum is to seek approval to renew the attached
Multijurisdictional Drug Task Force Agreement between the City of Dubuque, Dubuque
County, City of East Dubuque, Illinois and Jo Daviess County, Illinois.
BACKGROUND:
For the past several years the City of Dubuque, Dubuque County, the City of East
Dubuque, Illinois and Jo Davies County, Illinois have jointly worked together in the
investigation and prosecution of illegal drug use through the use of a multijurisdictional
drug task force agreement. Currently the investigative component of drug task force
operations consists of three full-time Dubuque Police Officers, three Dubuque County
Sheriffs Deputies, an administrative assistant from the Dubuque County Attorney's
Office, and an analyst from the Iowa National Guard.
On April 30, 2007 the current multijurisdictional drug task force agreement is scheduled
to expire. Task force operations have become the cornerstone to our illegal drug
investigation capabilities. Having the ability to share resources, information and other
investigative assets continues to strengthen our abilities as we work to combat the very
mobile and adaptable illegal drug trade.
DISCUSSION:
Due to today's high mobility illegal drug trade, multijurisdictional task forces have
become a law enforcement mainstay to combat illegal drug use in our community. By
combining our intelligence network, staff resources and investigative assets with other
member agencies our effectiveness and efficiency continues to increase and expand.
By continuing the Multijurisdictional Drug Task Force agreement we continue to add
depth and strength to our illegal drug investigations. City Attorney Barry Lindahl
reviewed and assisted with the update of the new agreement. The new agreement has
also been reviewed by Ralph Potter, Dubuque County Attorney.
RECOMMENDATION:
Based upon the past benefits of drug task force operations, I recommend continuing the
cooperative agreement with Dubuque County, the City of East Dubuque, Illinois, and Jo
Daviess County, Illinois to combine resources to combat the illegal drug trade through
the attached Multijurisdictional Drug Task Force Agreement.
ACTION REQUESTED:
Action requested is for City Council consideration and approval of the Multijurisdictional
Drug Task Force agreement between the City of Dubuque, Dubuque County, the City of
East Dubuque, Illinois and Jo Daviess County, Illinois.

MULTIJURISDICTIONAL DRUG ENFORCEMENT AGREEMENT
BETWEEN AND AMONG
THE CITY OF EAST DUBUQUE, ILLINOIS,
JO DAVIESS COUNTY, ILLINOIS,
THE CITY OF DUBUQUE, IOWA, AND
DUBUQUE COUNTY, IOWA
This Agreement, dated for reference purposes this day of , 2007,
is entered into in compliance with Articles 7 and 10 of the Constitution f the State of
Illinois, the Intergovernmental Cooperation Act (5 ILCS 220/1, et seq. and 65 ILCS 5/11-
1-2.1)and Iowa Code Chapter 28E of the 2007 Code of Iowa, by, between, and among
the City of East Dubuque, Illinois, Jo Daviess County, Illinois, City of Dubuque, Iowa,
and Dubuque County, Iowa to engage in a cooperative effort in criminal investigations
and prosecutions thereof, particularly involving illegal drug trafficking and the use and
distribution of controlled substances.
The City of East Dubuque, Illinois, Jo Daviess County, Illinois, the City of
Dubuque, Iowa, and Dubuque County, Iowa, agree as follows:
SECTION 1. The parties agree to cooperatively engage, as the Multijurisdictional
Drug Task Force, in authorized criminal investigations and prosecutions involving illegal
drug trafficking and the use and distribution of controlled substances within the
respective jurisdictions of the parties.
SECTION 2. No separate, legal entity will be created by this Agreement.
SECTION 3. This Agreement shall be administered by the Multijurisdictional Drug
Enforcement Joint Board (the Joint Board) comprising the Dubuque County Sheriff, the
Dubuque County Attorney, the City of Dubuque Police Chief, the City of East Dubuque
Police Chief, and the Jo Daviess County Sheriff.
SECTION 4. The Illinois members of the Joint Board shall appoint an Illinois Control
Group to conduct the operations authorized by the Joint Board in Illinois. The Iowa
members of the Joint Board shall appoint an Iowa Control Group to conduct the
operations authorized by the Joint Board in Iowa. Each Control Group shall for its
respective jurisdiction:
4.1 Establish criteria for the selection of investigative targets;
4.2 Allocate funds and investigative and prosecutorial resources that may be made
available to that Control Group;
4.3 Establish criteria for the prosecution of cases, including policies on the use of
informants, immunity, priority of targets, forfeiture, plea agreement goals, and choice of
federal or state forums for prosecution; and
4.4 Oversee ongoing investigations.
SECTION 5. Each party (the Indemnifying Party) shall defend, indemnify and hold
harmless the other parties {the Indemnified Parties) from and against any and all claims
of any kind that may be made against the indemnified Parties arising out of the
negligence of the Indemnifying Party.
SECTION 6. Each party shall be solely responsible for any injuries or damages to
such party's employees and equipment.
SECTION 7. Any party may terminate this Agreement by providing not less than sixty
(60} days written notice to atl other parties. Equipment or other property acquired during
the term of the Agreement shall be distributed equally among the parties upon
termination of the Agreement based upon each party's contribution toward the purchase
thereof.
