INTRODUCTION
The enclosed resolutions authorize the public bidding procedure for the Rush Street
Reconstruction Project -Bryant Street to Villa Street.
BACKGROUND
Rush Street was originally constructed with macadam in 1895. In 1964 the roadway was
constructed with bituminous concrete. Rush Street is currently an asphalt-paved, 37-
foot wide street, with curb and gutter on both sides of the street.
DISCUSSION
The Rush Street Reconstruction Project -Bryant Street to Villa Street will provide for the
reconstruction of underground utilities, roadway sub-base and the construction of a new
37-foot wide concrete roadway between Bryant Street and Villa Street.
The project will be constructed in two phases. Phase I of the project will include the
complete reconstruction of all underground utilities and mainline roadway construction
from Bryant Street to Union Street. During Phase I, the contractor will not be able to do
any construction from Bryant Street to Plum Street until the last day of school which is
June 6th, 2007. All work in the Phase I section will need to be completed from Bryant
Street to Plum Street before school opens on August 24th, 2007. The Phase I section of
the project is anticipated to be completed by November 16, 2007 and open to local
residents and vehicular traffic during the winter weather season.
Phase II of the project will include the complete reconstruction of all underground
utilities and mainline roadway construction from Union Street to Villa Street. The Phase
II section of work is anticipated to be completed by July 3rd, 2008 and open to focal
residents and vehicular traffic.
The project wilt incorporate upgrades to the existing sanitary sewer system that include:
the complete reconstruction of approximately 3,065 lineal feet of 8-inch mainline sewer;
the reconstruction of 13 deteriorated brick manholes; and the replacement of 73 private
sanitary sewer laterals. The cost for the individual sanitary sewer lateral replacements
will be assessed to each respective private property owner.
The project will also include the reconstruction of approximately 4,000 lineal feet of
watermain, mainline valves, fire hydrants, and the replacement of 23 lead residential
water services. The cost of the individual lead residential water service replacements
will be assessed to each respective private property owner.
The project also provides for the construction of approximately 2,425 lineal feet of new
storm sewer and 28 catch basins to improve the storm water conveyance in the area;
the installation of fiber optics and telecommunications conduit infrastructure; and the
replacement of existing sidewalks along both sides of Rush Street.
City staff met with the City Forester on this project to discuss the condition and impact
to the existing City trees within the project corridor. There are a total of four mature
trees in this corridor. Both the engineering department and City Forester agree that a
total of three mature trees will need to be removed because of the proposed curb and
gutter location.
PROJECT COORDINATION
In an effort to inform the impacted residents along Rush Street, from Bryant Street to
Villa Street, the Engineering Department staff conducted two public informational
meetings. A third informational meeting will be held prior to the public hearing which will
allow residents to review the final improvement plans and discuss preliminary
assessments. The open forum meetings allows staff to discuss the scope of the project,
construction schedule, special assessment procedures, availability of financial
assistance, as well as to answer any questions relating to the project. The public
informational meetings proved to offer mutual benefit to both staff and residents that
attended.

RECOMMENDATION
recommend that the City Council give preliminary approval to the construction plans
and specifications, approve the Resolution of Necessity, approve the Preliminary
Schedule of Assessments, establish May 7, 2007 as the date of the public hearing, and
hereby authorize the City Clerk to advertise for bid proposals for the Rush Street
Reconstruction Project -Bryant Street to Villa Street.

The Rush Street Reconstruction Project will be funded through the annual capital
improvement project appropriation of City funds as noted above in the amount of
$1,864,703.37. The project, as outlined, will require Special Assessments in the amount
of $307,922.62 and expenditure from the FY2008 Annual Street Construction Program
(Funded through Local Option Sales Tax) in the amount of $1,173,740.75.
PROPERTY ASSESSMENTS
Low- to moderate-income property owners subject to street assessment will be eligible
for financial assistance ranging from 20 to 100 percent of the street assessment for the
owner-occupied resident property depending on family size and income level. This
financial assistance program is made available through the One Percent Local Option
Sales Tax.
ACTION TO BE TAKEN
The City Council is requested to give preliminary approval to the Resolution of
Necessity, approve the Preliminary Schedule of Assessments, establish the date of the
public hearing, and authorize the City Clerk to advertise for bid proposals through the
adoption of the enclosed resolutions for the Rush Street Reconstruction Project.

My Wife & I own the property on the corner of Rush 8~ villa Streets. We are
Petitioning the City Council to Exempt our property from the City ^f Dubuques
Directive, requiring a sidewalk when replacing a Street.
Our reasons are as follows:
1. The Li~~il~ty both the city & ourselves would incur from snow gathering
on our property and running down the steep embankment onto the steep sidewalk
creating Ice at unknown times.
2. Sidewalk would be on the north side, whidF makes for partial melting 8~ ref-
reezing on a regular basis in the winter.
3. Avery large accumulating area, directly depositing water on the sidewalk.
4.A wall ^n our property line would help putting a barrier space between
the sidewalk & wall- However We were told the city has no money far that to happen.
5. There is a 27' drop in a span of 200' Whicf~ makes for a steep 8, slippery
slope.
6. We cannot watch for the ice to freeze, thaw & refreeze at different
hours of the day 8~ night. We would make a reasonably good effort to place
salt when needed, but it is impossible for us to monitor this for 24 hrs
a day.
The sidewalk wat~ld go nowhere: That is probably the reason ^f none being
there now.
7. We walk our dogs regularly in the area for several yews, as d^ many
other people. We are very earful as to where we walknever going down a steep
sidewalk on the north shaded side of buildings, ^r even very steep streets
in inclement weather.
8. Wbethink this would surly surprise someone that does not keow the area,
and they could fall.
9. The steepness and the large gathering area above the proposed sidewalk
would create a constant flaw of water onto the sidewalk when thawing.
10. We think this is creating a hazard where none exist now.

RECONSTRUCTION PROJECT
Whereas, the City Council of the City of Dubuque, Iowa has given its preliminary
approval to the proposed plans, specifications, form of contract, and estimated cost for
the Rush Street Reconstruction Project (the Project) and ordered the same to be on file
in the office of the City Clerk for public inspection.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That a public hearing will be held on the 7th day of May, 2007, at 6:30 p.m. in the
Public Library Auditorium at which time interested persons may appear and be heard for
or against the proposed plans and specifications, form of contract and estimated cost of
said Project, and the City Clerk be and is hereby directed to cause the attached notice
of the time and place of such hearing to be published in a newspaper having general
circulation in the City of Dubuque, Iowa, which notice shall be published not less than
four days nor more than twenty days prior to the date of such hearing. At the hearing,
any interested person may appear and file objections to the proposed plans,

ORDERING THE ADVERTISEMENT FOR BIDS FOR THE RUSH STREET

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the Rush Street Reconstruction Project is hereby ordered to be advertised
for bids for construction.
BE IT FURTHER RESOLVED, that the amount of the security to accompany
each bid shall be in an amount which shall conform to the provisions of the Notice to
Bidders hereby approved.
That the City Clerk is hereby directed to advertise for bids for the construction of
the improvements herein provided, by publishing the attached Notice to Bidders to be
published in a newspaper having general circulation in the City of Dubuque, Iowa, which
notice shall be published more than twenty days but not more than forty-five days
before the date for filing bids at 2:00 p.m. on the 10th day of May, 2007. Bids shall be
opened and read by the City Clerk at said time and will be submitted to the City Council
for final action at 6:30 p.m. on the 21st day of May, 2007, in the Public Library
Auditorium, 360 West 11th Street, Dubuque, Iowa.

RESOLUTION OF NECESSITY FOR THE RUSH STREET RECONSTRUCTION
PROJECT
Whereas, the plat, schedule of assessments, and estimate of total. cost for the
Rush Street Reconstruction Project have been duly prepared and approved by the City
Council of the City of Dubuque and ordered placed on file in the office of City Clerk.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
The Rush Street Reconstruction Project -Bryant Street to Villa Street will provide
for the reconstruction of underground utilities, roadway sub-base and the construction of
anew 37-foot wide concrete roadway between Bryant Street and Villa Street.
The project will be constructed in two phases. Phase I of the project will include
the complete reconstruction of all underground utilities and mainline roadway
construction from Bryant Street to Union Street. During Phase I, the contractor will not
be able to do any construction from Bryant Street to Plum Street until the last day of
school which is June 6th, 2007. All work in the Phase I section will need to be completed
from Bryant Street to Plum Street before school opens on August 24th, 2007. The Phase
I section of the project is anticipated to be completed by November 16, 2007 and open
to local residents and vehicular traffic during the winter weather season.
Phase II of the project will include the complete reconstruction of all underground
utilities and mainline roadway construction from Union Street to Villa Street. The Phase
II section of work is anticipated to be completed by July 3rd, 2008 and open to local
residents and vehicular traffic.
The project will incorporate upgrades to the existing sanitary sewer system that
include: the complete reconstruction of approximately 3,065 lineal feet of 8-inch
mainline sewer; the reconstruction of 13 deteriorated brick .manholes; and the
replacement of 73 private sanitary sewer laterals. The cost for the individual sanitary
sewer lateral replacements will be assessed to each respective private property owner.
The project will also include the reconstruction of approximately 4,000 lineal feet
of watermain, mainline valves, fire hydrants, and the replacement of 23 lead residential
water services. The cost of the individual lead residential water service replacements
will be assessed to each respective private property owner.
The project also provides for the construction of approximately 2,425 lineal feet
of new storm sewer and 28 catch basins to improve the storm water conveyance in the
area; the installation of fiber optics and telecommunications conduit infrastructure; and
the replacement of existing sidewalks along both sides of Rush Street.
There is on file in the office of the City Clerk an estimated total cost of the work,
and a preliminary plat and schedule showing the amount proposed to be assessed to
each lot for the improvement.
The date, time, and place the council will hear property owners subject to the
assessment and interested parties for or against the improvement, its cost, the
assessment, or the boundaries of the district:
That the City Council deems it advisable and necessary for the public welfare to
make the herein. mentioned improvements.
Unless a property owner files objections with the City Clerk at the time of hearing
on the resolution of necessity, the property owner is deemed to have waived. all
objections .pertaining to the regularity of the proceeding and the legality of using the
special assessment procedure.
Said improvements shall be constructed in accordance with the plans and
specifications which have been approved by the City Council and are now on file in the
Office of the City Clerk. The cost of making such improvement will be assessed against
property lying with the assessment limits.

OF DUBUQUE, IOWA:
The City Council will meet on the 7th day of May, 2007, at the Public Library
Auditorium, 360 West 11th Street, Dubuque, Iowa, at which time the owners of property
subject to assessment for the proposed improvement or any other person having an
interest in the matter may appear and be heard for or against the making of the
improvement, the boundaries of the district, the cost, the assessment against any lot, or
the final adoption of a resolution of necessity.
A property owner will be deemed to have waived all objections unless at the time
of hearing the property owner has filed objections with the City Clerk.
The City Clerk be and is hereby authorized and directed to cause a notice of the
time. and place of such hearing to be published. in a newspaper having general.
circulation in the City of Dubuque, Iowa, which notice shall be published once each
week for two consecutive weeks, the first publication of which shall be not -less than ten
