The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing that the existing portion of Wood Gate Drive is
paved to 24 feet in width and would like to maintain that width rather than pave to 26 feet.
Staff reviewed the proposed lot split and Fringe Area Development Policy requirements regarding
private street widths for development within secondary growth areas.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that Wood Gate Drive will not be
extended any further, serves a limited amount of property and a 24 foot wide paving width is
appropriate for this subdivision.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the
request subject to allowing Wood Gate Drive to be paved to 24 feet in width and 37 %2 foot paving
width for the cul-de-sac and waiving ArtiGe IV, Design and Improvement standards for the
subdivision regulations, except for Section 42-19, Blocks and Lots.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 232-07
RESOLUTION APPROVING THE FINAL PLAT OF LOTS 1-1 AND 1-2 MILLER PLACE
IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Lots 1-1 and 1-2
Miller Place; and
Whereas, the Final Plat has been examined by the Zoning Advisory Commission
and has its approval endorsed thereon, with the waiver of Article IV, Design and
Improvement Standards of the Subdivision Regulations, except for Section 42-19,
Blocks and Lots, and installation of a 24-foot wide private street and 37 1/2-foot radius
cul-de-sac; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except Section 42-19, Blocks
and Lots, and that a private street (Wood Gate Drive) be constructed to a 24-foot width
and 37 1/2-foot radius cul-de-sac and maintained as part of Miller Place.
Section 2. That the Final Plat of Miller Place is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
Resolution No. -07

City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein
named, execute their written acceptance hereto attached agreeing:
a) A private street (Wood Gate Drive) be constructed to a 24-foot
width and 37 1/2-foot radius cul-de-sac in accordance with
improvement plans signed on March 29, 2007.
Section 3. That in the event Bill Miller Logging, Inc. fails to execute the
acceptance within 180 days after the date of this Resolution, the provisions hereof shall
be null and void and the approval of the plat shall not be effective.

INTRODUCTION
The submitted final plat of Lot 1 of 1 and 2 of 1 of Miller Place is located along U.S.
Highways 151/61 immediately west of the Highway 61/151 interchange, south of the city
of Dubuque. The submitted final plat subdivides the existing Lot 1 of Miller Place into
two lots.
DISCUSSION
The submitted final plat subdivides the existing parcel into two lots. Currently, Bill Miller
Logging is located on what is now designated as Lot 1 of 1 of Miller Place. Lot 2 of 1 of
Miller Place will be developed by Larry McDermott for an industrial use. Access to the
property will be provided by a new private roadway named Woodgate Drive. Both lots
do have frontage on the right-of-way for Highway 151; however, there are no access
rights for this property at this location.
Normally, a simple lot split such as this is reviewed and approved by the City Planner.
However, because of the proposed private street, Woodgate Drive, the City Subdivision
Regulations require review and approval by both the Zoning Advisory Commission and
City Council. The subject parcel is located in Dubuque County and is designated as a
secondary growth area as established in the City's Fringe Area Development Policy.
The requirements in the secondary growth area require that streets be built to City
private street standards, which is 26 feet of paving without curb and gutter or 27 feet
with curb and gutter.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission review the final plat of
Lot 1 of 1 and Lot 2 of 1 of Miller Place and recommend approval of the final plat as it is
in substantial compliance with the City of Dubuque Subdivision Regulations subject to
waiving Article IV, Design Improvement Standards, except for Section 42-19, Blocks
and Lots.
