SUBJECT: Heron Pond Tree Removal Project, Project #1128
Leisure Services Manager Gil Spence is recommending acceptance of the Heron Pond
Tree Removal Project, as completed by Top Grade Excavating, in the final contract
amount of $30,299.
The City continues to work with the U.S. Army Corps of Engineers and the Iowa
Department of Natural Resources on clearly identifying the boundaries of the wildlife
management area and developing a restoration plan for future plantings.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Heron Pond Tree Removal Project, Project #1128
INTRODUCTION
The purpose of this memorandum is to recommend that the City Council accept the
Heron Pond Tree Removal Project.
DISCUSSION
The Heron Pond Tree Removal Project has been completed by Top Grade Excavating
in the final contract amount of $30,299. A summary of the project costs is as follows:

There were no change orders on this project. The FY 2008 C.I.P. budget contains
$80,000 for this project. We moved $30,000 to the Eagle Point Park Fee Collector's
Booth Construction Project and will use the $19,701 contingency fund to seed the area
and plant trees.
ACTION STEP
The action requested is that the City Council adopt the attached resolutions accepting
the improvement and setting the final cost.

RESOLUTION NO. 234-07
ACCEPTING IMPROVEMENT
WHEREAS, the contract for the Heron Pond Tree Removal Project has been
completed and the City Manager has examined the work and filed his certificate stating that
the same has been completed according to the terms of the contract, plans and
specifications and recommends its acceptance.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
1. That the recommendation of the City Manager be approved and that said
improvement be and the same is hereby accepted.
BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby directed
to pay to the contractor from the General Fund in amount equal to the amount of his
contract, less any retained percentage provided for therein.

RESOLUTION NO. 235-07
FINAL ESTIMATE
WHEREAS, the contract for the Heron Pond Tree Removal Project has been
completed and the Engineer has submitted his final estimate showing the cost thereof
including the cost of estimates, notices and inspection and all miscellaneous costs;
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the cost of said improvement is hereby determined to be
$30,299.00, and the said amount shall be paid from the General Fund of the City of
Dubuque, Iowa.
