Van Milligen, City Manager SUBJECT: Chapter 11 Permit for Construction on Bluff Land or Land Adjacent to a Bluff City Attorney Barry Lindahl and Building Services Manager Rich Russell have developed and are recommending adoption of an ordinance providing that the Building Official may require an engineering study prior to issuance of a permit for construction on bluff land or land adjacent to a bluff to determine that the land or bluff is safe for such construction. Van Milligen MCVM/jh Attachment cc: Barry Lindahl, City Attorney Cindy Steinhauser, Assistant City Manager ORDINANCE NO. 21-07 AMENDING CHAPTER 11 BUILDINGS AND BUILDING REGULATIONS SECTION 11-37 APPLICATION FOR PERMIT BY ADDING A NEW SUBSECTION (d) PROVIDING THAT THE BUILDING OFFICIAL MAY REQUIRE AN ENGINEERING STUDY OR STUDIES PRIOR TO ISSUANCE OF A PERMIT FOR CONSTRUCTION ON BLUFF LAND OR LAND ADJACENT TO A BLUFF TO DETERMINE THAT THE LAND OR BLUFF IS SAFE FOR SUCH CONSTRUCTION Section 1. Sec. 11-57 of the City of Dubuque Code of Ordinances is amended by adding thereto the following: (d) Construction on Bluff Land or Land Adjacent to Bluffs. The application shall indicate whether the construction is on bluff land or land adjacent to a bluff. If the construction is on bluff land or land adjacent to a bluff, prior to the issuance of a permit, the Building Official may require the developer to fund an engineering study or studies, to determine whether the bluff land, land adjacent to a bluff, or adjacent bluff is sufficiently stable to allow for the construction or use. If the Building Official determines, based upon the engineering study or studies, that the bluff land, land adjacent to a bluff, or adjacent bluff is not sufficiently stable to allow for the construction or use, the Building Official may require as a condition of the issuance of the permit such stabilization or other measures as the engineering study or studies recommend to make the bluff land, land adjacent to a bluff, or adjacent bluff sufficiently stable to allow for the construction or use. Van Milligen City Manager DATE: April 12, 2007 Re: Ordinance Amendment to Chapter 11 -Buildings and Building Regulations At a recent City Council meeting, the question was raised whether the City had the authority to require an engineering study before the issuance of a permit for construction on or near bluff land. After researching the issue and consulting with Building Services Manager Rich Russell, we have concluded that it is not clear under the current City of Dubuque Code of Ordinances whether the building official has such authority. Attached is a proposed ordinance clarifying the building official's authority in such situations.
