INTRODUCTION
This memorandum provides information concerning John Herrig's proposed Serenity
Ridge Subdivision located on Derby Grange Road just north of Plaza Drive in Dubuque.
Mr. Herrig is requesting to address the Mayor and City Council members at the May 19th
Council meeting as it relates to development of Serenity Ridge Subdivision (see
attached request).
BACKGROUND
John Herrig had previously received preliminary plat approval back in 2007 for Serenity
Ridge Subdivision and then submitted a final plat/improvement plans in 2008. Attached
is a vicinity map and correspondence from the Zoning Advisory Commission, Planning
Services staff, and Engineering staff on issues with the preliminary plat for Serenity
Ridge Subdivision.
There were many discussions and meetings between Mr. Herrig and City staff
concerning his project between 2007 and 2009. The improvement plans for Phase 1
were never completed and a final plat was never approved. Preliminary plats are good
for two years unless a final plat/improvement plans are submitted and approved within
that two-year time frame.
DISCUSSION
Primarily, there are two outstanding issues that Mr. Herrig has not yet resolved:
extension of City water service to his proposed subdivision and access to Derby Grange
Road.
Attached to this memorandum is a letter addressed to John Herrig dated December 7,
2009 from City Engineer Gus Psihoyos that provides a chronology of events leading up
to a meeting in October 26, 2009.
Subsequent to that letter, Mr: Herrig contacted City staff regarding submittal of a new
preliminary plat for Serenity Ridge Subdivision. The plat was submitted in February

2014. Mr. Herrig attended a Development Review Team meeting with City staff on
February 13, 2014 regarding the preliminary plat. Staff noted that Mr. Herrig needed to
address outstanding issues of access to Derby Grange Road and extension of water
main to the property. Mr. Herrig elected to place his new preliminary plat process on
hold until he had a chance to discuss with Roger Cherland, the adjacent property
owner, the extension of the water main to his proposed subdivision.
REQUESTED ACTION
This information is being provided as background for issues surrounding the processing
of preliminary and final plats for Serenity Ridge Subdivision. No action is required.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing traffic and roadway issues, reducing the speed
limit on Derby Grange Road and traffic study conducted by Business and Associates. Ken Buesing,
Buesing & Associates, representing John Herrig, discussed his firm's traffic study and information
submitted by HDR, Inc.
Staff reviewed traffic analyses regarding Derby Grange Road, and the attached information
submitted by Gus Psihoyos, City Engineer, regarding the proposed intersection of Derby Grange
Road and Plaza Dive, and information supplied by HDR, Inc. on behalf of the City of Dubuque.
There were no public comments.
The Zoning Advisory Commission discussed the request, reviewing issues with the proposed
intersection of Derby Grange Road and. Plaza Drive, whether a second access needs to be provided
to Phase II of Serenity Ridge Subdivision, and the provision of a park in Phase I in addition to the
park proposed in Phase II.
Recommendation
By a vote of 5 to 0 the Zoning Advisory Commission approved the preliminary plat subject to the
following conditions:

1. Approval is contingent upon resolution of the intersection improvements for Plaza
Drive and Derby Grange Road;
2. That the Zoning Advisory Commission review the final plat for Phase 1 of the
subdivision;
3. That a second access be provided for Phase 2 of the subdivision and the final plat for
Phase 2 be submitted to the Zoning Advisory Commission; and

BACKGROUND
This is a follow-up to discussions with Buesing and Associates and HDR regarding the
design criteria for the proposed intersection of the extension of Plaza Drive with Derby
Grange Road just west of Herod Lane as shown on the preliminary plat of Serenity
Ridge. The posted speed limit at the proposed intersection is 35 mph. The 85th
percentile speed is between 52 and 55 mph.
DISCUSSION
Buesing and Associates evaluated the existing vertical alignment of Derby Grange
Road and determined the roadway would have to be lowered up to 6.5 feet to meet the
design requirements for an intersection in a 45 mph zone. The grading for this design
was estimated at over 8000 cubic yards with 1500 feet of roadway to be rebuilt.
Another option of adding a left turn lane at the proposed intersection was not warranted
by existing traffic counts and would not sufficiently increase safety if the sight distance
issue was not resolved. Buesing and Associates recommended traffic calming devices
such as flashing beacons, etc. to lower the 85th percentile speed.
Since City Engineering was not comfortable with Buesing and Associates
recommendations, we forwarded the Buesing and Associates plans and profile to HDR
for further review. HDR agreed the roadway should be designed for 45 mph and
recommended two options. One option was to lower the roadway to meet sight
distance requirements for the proposed intersection. The other option was to relocate
the intersection across from Herod Lane. (Relocating the intersection involves a third
party not associated with the proposed development).
RECOMMENDATION
Based on the above analysis by Buesing and Associates and HDR, City Engineering
recommends that a design speed of 45 mph be established for intersection sight
distance for this portion of Derby Grange Road. This will involve the regrading of the
roadway or relocation of the intersection to meet the sight distance requirements.

This letter is a follow-up to our meeting with the City Manager on October 26, 2009 and
the site visit on October 27, 2009 concerning the proposed improvements to Derby
Grange Road which' are necessary to allow an intersection with the extension of Plaza
Drive. First of all, 1 would like to recap our conversations and to clarify the issues.
Because of the complexity of issues and longevity of the process, I have listed below
the chronology of events leading to this point.
April 17, 2004 John Herrig met with Gus Psihoyos, Deron Muehring, Kyle Kritz
and Ron Turner to discuss improvements necessary to develop
the area north of Wendell Corey's property off of Derby Grange
Road.
October 5, 2005 John Herrig letter to City committing to purchase 112 acres from
Don Butler and the desire to annex to the City. This letter
requests City to provide sewer and water to the property line.
February 27, 2006 John Herrig letter to City Manager regarding voluntary
annexation of Don Butler's 112 acres and request for
residential, multi -family, and commercial zoning.
March 7, 2006 John Herrig, Wendell Corey, Jack Leaman, Dave Frommelt,
Gus Psihoyos, Ron Turner, and Todd Irwin met with IIW
Engineers, Gary Sejkora, and others to discuss annexation and
coordination of utility construction. Corey states that it will be no
problem getting the roadway graded to Herrig's south property
line. John Herrig expressed he wanted water service by August,
2006, Corey felt water would be constructed by spring, 2007.

construct a graded road to Herrig's south line by July 1, 2007
and construct a watermain to serve Herrig's property by August

Buesing & Associates memo with City staff regarding two
design options for modifications for Derby Grange Road to
accommodate a new intersection of Plaza Drive. ECIA traffic
studies have indicated the 85th percentile speeds of over 50
mph. Buesing & Associates indicated the current roadway
meets the design requirements for 40 mph. Buesing and
Associates recommended traffic control devices to lower the
85th percentile speed since reconstruction to lengthen the
vertical curve from 900 feet to 1,300 feet would be "cost
prohibitive."
City requested HDR to evaluate the alternatives for the design.
HDR memo concerning design options on Derby Grange Road
for the new intersection. HDR agreed that the vertical curve
should be increased from 900 feet to 1,320 feet to meet the 45
mph design speed for the intersection.
Engineering Department memo to Planning Department

July 2, 2007 City Council approves Preliminary Plat of Serenity Ridge
Subdivision with conditions per the recommendation of the
Zoning Advisory Commission,
July 9, 2007 City Manager and staff met with John Herrig, Tom Olthafer and
Terry Koelker to discuss responsibility for improvements to
Derby Grange Road. City Manager stated that John Herrig had
the responsibility to do the intersection construction and that he
should find out what needs to be done and get a cost estimate.
City will discuss later how they can assist in financing. City will
pay for one-half of the study for improvements.
October 3, 2007 WHKS submits proposal for preliminary engineering on Derby
Grange Rd. based on DAGIS contours for a fee of $5900.
October 12, 2007 City staff memo from Engineering to Planning Services
recommending the developer's engineer prepare a preliminary
design and estimate of the probable costs of the intersection of
Plaza Drive with Derby Grange Road. This memo also requests
a commitment from the developer for the improvements prior to
approval of the preliminary or final plats.
October 16, 2007 Preliminary Plat dated October 5, 2007 was reviewed by
Engineering with comments forwarded to Buesing & Associates,
Comments included the requirement that preliminary design
and construction for the intersection of Derby Grange Road and
Plaza Drive must be resolved prior to approval of preliminary or
final plats.

29 letter revising the completion dates to be between June 1
and August 1, 2008.
November 23, 2007 Herrig letter to Kyle Kritz, Planning Services, asking to table
further action on Serenity Ridge Subdivision and requesting a
refund of application since he was not aware that Phase 2 of
Wendell Corey's development was not approved and no one
informed him.
February 28, 2008 WHKS submits proposal to Herrig for final design for Derby
Grange Rd. estimated at $17,800.
May 5, 2008 City Council approves agreement with Herrig to share in the
cost of improvements to Derby Grange Road, among other
things.
May 19, 2008 City Engineer letter to Herrig requesting that the final design of
Derby Grange Road begin immediately since there will need to
be easements acquired. City agrees to pay one-half of the
$17,800 design fee.
May 29, 2008 City Planning letter to Wendell Corey requesting a plan of when
the terms of the annexation agreement to provide a graded road
and watermain to the Herrig property will be met.
June 6, 2008 Herrig agrees to perform per the agreement approved by City
Council on May 5, 2008, contingent upon the Zoning Advisory
Commission and City Council approving the final plat by July
30, 2008.
August 29, 2008 Herrig requests permission to begin preliminary grading on
Serenity Ridge Subdivision. This letter states that the proposed
utility construction for Serenity Ridge is planned for the fall of
2008.
September 23, 2008 Buesing & Associates submits a Grading and Pollution
Prevention Plan for Serenity Ridge Subdivision No. 1.
November 10, 2008 Herrig letter to Mayor, City .Council, and Engineering
Department stating he was promised sewer and water by
August, 2007 and "to date the water is still not available" and
requests "that top priority be placed on providing water to
Serenity Ridge."
December 3, 2008 City Engineering letter to Herrig requesting revised
improvement plans and stormwater calculations to further the
City's review and requests a proposed schedule for construction
of said improvements in order to further process the final plat.
March 2, 2009 City Manager letter to Herrig outlining City obligation on
watermain construction.
May 4, 2009 Engineering Department letter to Herrig responding to request
for a public water supply to Serenity Ridge. Letter listed ten
conditions to be agreed to by developer to assure the City that
he will proceed with the development.
August 6, 2009 Engineering Department memo to Buesing & Associates
outlining the additional items which still needed to be submitted

to do further review of detention calculations for `Serenity Ridge
in order to proceed with approval of SWPPP and Erosion
Control Permit.
City Manager, John Herrig, and City Engineering staff met to
discuss May 4, 2009 letter. John expressed concern that the
Derby Grange Road improvements is too large of a project for a
small developer to absorb and that other developers of
residential property have not had to meet such requirements.
He requested that the design speed be reduced to 35 mph as
posted on a portion of the road and also had an alternate
design to show Engineering staff. John would like the City to
postpone improvements to Derby Grange Road for two to three
years. City agreed to investigate an alternate profile as John
suggested. John again requested the watermain be extended
as "promised by the City." John was reminded that the
extension of the watermain was a private agreement he
had/has with Wendell Corey.
In summary, the action taken in June and July, 2007 by the Zoning Advisory
Commission and City Council gave conditional approval of the Serenity Ridge
subdivision contingent upon "resolution of the intersection improvements for Plaza Drive
and Derby Grange Road." The agreement to share in the cost of these improvements
by the City of Dubuque was approved by City Council on May 5, 2008, but is yet to be
signed by Sally Jo Herrig and yourself. In a letter to the City dated June 6, 2008, you
indicated you agreed to perform per the agreement contingent upon the Final Plat of
Serenity Ridge being approved before July 30, 2008. The City offered to assist you in
getting watermain to your proposed subdivision based on conditions outlined in a letter
dated May 4, 2009. At our meeting on October 26, 2009, you indicated concern with
Items 1 through 3 of said letter concerning improvements to Derby Grange Road.
For the purpose of public safety and welfare, it is not unusual for the City to require
improvements outside the boundaries of a property proposed to be developed.
Commercial developments are sometimes required to do a traffic study and construct
improvements to adjacent roadways, including traffic signals, when recommended by
the study.
Some residential developments have also had to install improvements outside of the
proposed subdivision. Listed below are a few recent examples:
— Marna Ridge Estates: The developer of a residential subdivision was required to
provide a second access prior to full development of the subdivision because of the
number of homes with only one access. This required the purchase of an abutting
16 -acre parcel that eventually became Marna Ridge Estates No. 2.
— Alpine Mobile Home Park: The developer of this Planned Unit Development was
limited to 115 units until a secondary access could be constructed to Highway 386 or
within five years after the approval of the ordinance. This secondary access required
the purchase of an additional 30 acres of property and extensive earthwork at a cost
of over $300,000 which eventually became a part of Tanzanite Drive. This same
development required the extension of sanitary sewer for a length of over one mile
at a cost of over $250,000 across private property to serve the development.
— AJ Spiegel's River Point Development: The ordinance approving this planned
residential development required improvements to West 3`d Street (traffic signals),
Langworthy Street, and Mazzuchelli Drive (widening). The developer agreed to pay
the City of Dubuque $150,000 for these off-site improvements in three (3) yearly
payments of $50,000.
— Timber Hyrst Subdivision: The developer was required to raise 900 feet of public
roadway above the 100 -year flood elevation and construct a two-lane bridge with
sidewalk to Iowa DOT standards. The bridge construction alone was over $402,000.
Shady Oaks Subdivision: The developer was required to extend sanitary sewer for a
length of over 3300 feet across private property to serve the development.
The City of Dubuque has shared in the cost of a plan and profile for the preliminary
redesign of Derby Grange Road dated December, 2007. Based on contours from the
City's GIS and a 45 mph design speed, this preliminary design for the proposed
intersection required substantial cut in the roadway and easements for additional right-
of-way required from several property owners. Based on our site visit on October 27,
2009, you felt an alternative design moving the high point west would have less impact
on neighboring properties. This alternative was evaluated by the Engineering
Department and was discussed with you as a preliminary redesign of the roadway. This
new alternative may reduce the cost of the project approximately $100,000.
However, since all of the preliminary design work had been based on the Dubuque Area
Geographic System (DAGIS) contours, City Engineering took the unprecedented
initiative to do a field survey on November 13, 2009, to verify the existing profile of
Derby Grange Road. When this new information was processed on November 16, we
discovered some minor discrepancies in elevations compared to the DAGIS contours.
Upon further review of the preliminary design done by WHKS, the City feels that this
design does not provide adequate sight distance for 45 mph for the proposed
intersection of Plaza Drive. (Engineering believes the preliminary design did not take
into account the gradient of the roadway.) As you know resolving the issues for the
intersection of Plaza Drive is imperative to the development of any portion of your
proposed subdivision. Therefore, we suggest that changes necessary to Derby Grange
Road which provide adequate intersection site distance for a design speed of 45 mph
be discussed with your design engineer, the City and the County Engineer at your
earliest convenience.
After approval of the final design of Derby Grange Road, and final design and submittal
of the improvement plans, storm water detention calculations and obtaining any
required approvals of the Dubuque County Board of Supervisors, the final plat could be
processed through City Council.
The City has constructed sanitary sewer at a cost of over $1 million partially in
anticipation of your project. When issues concerning improvements to Derby Grange
Road are resolved, including amending and signing the agreement, the City expects
that you will provide the final submittals which will allow your development to proceed.
Please remember that securities in the amount of 110% of the cost of the public
improvements and a 3% inspection fee must be submitted and approved prior to
recording of the final plat.
The City feels it has participated beyond its normal procedures to assist you with this
development. Namely:
• The City Council has signed the agreement to share the costs of the
improvements to Derby Grange Road which you have yet to agree to without
certain conditions not set forth in the agreement.
• The City shared in the cost of a preliminary design of Derby Grange Road and
also prepared additional alternative preliminary design profiles per your request
to help move the project along since you had not prepared a final plan for the
road as previously requested.
• The City agreed to assist you with the watermain construction to your site when
your agreement with Wendell Corey fell though.
• The City installed sanitary sewer and force main at a cost of over $1 million in
order that you could proceed with your development.
• The City has reviewed improvement plans for the subdivision and requested
additional information from your design engineer in order to complete the review,
but have not yet received the information requested.
In order for the Serenity Ridge development to move forward, you will need to
coordinate and follow through on the outstanding issues necessary for the project.
