A RESOLUTION PETITIONING THE ANNEXATION OF PROPERTY TO THE
CITY OF DUBUQUE, IOWA (BURDIN PROPERTY, PART).
WHEREAS, the City of Dubuque, Iowa is the owner of approximately
fifteen acres of land which is legally described as follows:
Int 16 of John Deere Dubuque Tractor Works and Lot 2-1-1-
2-2 of SE 1/4 of NE 1/4, all in Section 2, Township 89
North, Range 2 East of the 5th P.M. in Dubuque Township,
Dubuque County, Iowa.
WHEREAS, said territory is adjoining but outside of the City of
Aibugtie and the City of Dubuque desires to incorporate said territory within
its city limits to enable it to secure the benefits of city government in the
way of police and fire protection and other municipal services; and
WHEREAS, Chapter 368 of the Code of Iowa provides that owners of
land adjoining a city may apply in writing to the (',ouncil of the adjoining
city requesting annexation of the territory and that said application must
• contain a map of the territory showing its location in relationship to the
City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City of Dubuque as the owner of the hereinabove
described property hereby petitions that said territory be annexed to the City
of Dubuque, Iowa.
Section 2. That the territory which the City of Dubuque requests to
be annexed is outlined in red on the attached map marked Exhibit "A" and which
map shows the location of the property in relationship to the existing city
limits of the City of Dubuque, Iowa, all in accordance with Chapter 368 of the
Code of Iowa.

SUBJECT: Annexation of a Portion of the Burden Property
INTRODUCTION
This memorandum presents for your consideration two resolutions providing for
the annexation of a portion of the Burden property.
BACKGROUND
The Council recently accepted the gift of the Burden property off of Peru
Road. This property consists of approximately 55 acres which were donated for
public park purposes.
Of the total property the westerly 15 acres are outside of the City's
corporate limits. Annexation of this portion of the property would eliminate
any question of the City's governmental authority by extending the juridiction
of City ordinances. The City's ability to provide for the protection of
property and persons on all of the Burden land would be clarified.

Attached to this memorandum are two resolutions which provide for the
annexation of the westerly 15 acres of the Burden property. In the first
resolution, the City as property owner applies in writing for annexation. The
required legal description and map are included.
The second resolution provides for the city's approval of the annexation
petition. It provides for the inclusion of the property in the Third Ward
First Precinct. The Clerk is directed to make filings required by Section
368.7 of the Iowa Code.
RECOMMENDATION
I recommend that the City Council accomplish the annexation of the westerly 15
acres of the Burden property by adopting the attached resolutions.
