White Street Reconstruction
Due to some errors in the original Preliminary Schedule of Assessments for the
reconstruction of White Street, Public Works Director Mike Koch is recommending that
the original schedule be rescinded and a new Preliminary Schedule of Assessments be
adopted. He further recommends that Option #3 in the Resolution be adopted, which
Would say "That the proposed Resolution of Necessity described above is hereby
deferred for later consideration to a City Council meeting to be held on the 18TM day of
February, 2002, next at 6:30 p.m. in the Carnegie Stout Public Library Auditorium, with
jurisdiction retained for further consideration and action at that adjourned meeting."
This would be the final public hearing on the White Street project and the results of the
bids on the project would be available at that meeting.
I concur with the recommendations and respectfully request Mayor and City Council
approval.

INTRODUCTION
The following resolutions are for the purpose of correcting some of the resolutions
adopted for the White Street Reconstruction Project, from 21st to 32nd Street on
December 17, 2001.
DISCUSSION
Resolution No. 554-01, dated December 17, 2001, provided for the proper
assessment amounts for each category of work; but it was later determined that
the total column did not include all of the assessable items and is therefore in error.
This problem was caught prior to the assessment notices being mailed to the
property owners; and, therefore, these notices were correct.
it is necessary, however, that Resolution No. 554-01, dated December 17, 2001,
be rescinded and a new Preliminary Schedule of Assessments should be adopted
n addition, there were a few minor errors 'n the initial assessment schedule which
will also be corrected at this time.
RECOMMENDATION
I recommend that Resolution No. 554-01, dated December 17, 2001, be rescinded
and that a new Preliminary Schedule of Assessments for the reconstruction of
White Street be adopted.
ACTION TO BE TAKEN
The attached resolution adopting a new Preliminary Schedule of Assessments on
White Street should be adopted, and the decision of the public hearing on the
special assessments should be deferred until February 18, 2002, by approving
Option No. 3 of the Resolution with Respect to the Resolution of Necessity
attached hereto.

contained calculation errors which need to be corrected.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
That the following Preliminary Schedule of Proposed Assessments, as
shown on the attached sheets, 1 to 5 inclusive, are hereby determined to be the
Schedule of Proposed Assessments for the reconstruction of White Street - 21st
to 32"d Street and the valuations set herein are hereby approved.

Whereas, the public hearing has been held, all persons offering objections have
been heard and consideration given to all objections and is pending before this Council;
and
Whereas, this is the time and place set as provided for the taking of action on the
proposed Resolution of Necessity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the proposed Resolution of Necessity described above is hereby:
Adopted, without amendment, and all objections filed or made having been dully
considered are overruled.
Adopted as amended by the Schedule of Assessments attached hereto as Exhibit

Honorable Mayor and City Council:
Louise Welu of 3103 White St. (ph 582 3238) phoned & voiced an objection to the White
Street Reconstruction because of the proposed sewer lateral going into an empty lot
next to her which will never be used.
She is looking forward to having the street reconstructed as it needs it but objects only
to the unnecessary sewer lateral going into the empty lot next to her home which could
only be used for a garage.
Also, Raymond O'Brien, 2760 Central, phoned and voiced an objection to the
White St. Reconstruction project because of the cost.

I believe that the improvements to the 21st to 32nd White Street are
indeed needed. The street and sewage/water lines are in poor repair. I do
have a few concerns with the costs.
There are many in this area that are low income. My own income is
only $23,000 a year. After payroll taxes, my bi-weekly income is less than
$500. Healtl~ life, homeowners, and auto insurance as well as City and
County taxes and other bills leave little left to pay for an almost $3,700
street repair assessment. In addition, a recent appraisal of my home shows it
is worth only $41,000. To be assessed around 9% of that value for street and
sewage repair seems excessive.
I would also like to bring to your attention, that from 2 l~t to 24th White
Street, the traffic is not that of the typical residential street. There are
several business (2 Banks, a Jeweler, an Appliance Rental, a Florist, a
Motorcycle Shop, a Shooting Range, 2 Car Dealerships, a Tavern, several
Retail Sh~o,~s and a Convenience store) located on these two street blocks
(22~ to 24 street is one long block). It is not usual to have Semi trailers
drive down this street at any given hour of the day and night. Not to mention
several school busses and the many cars that travel down White Street to
bypass the Central and Jackson Street traffic lights.
I hope that you will lower my assessment for this project due to my
limited income, as well as for the high traffic, the kind of traffic and the ~gh ~
cost to others and myself who live in and around this neighborhood. ~~

To Whom It May Concern:
Regarding the recent notice we received with respect to the White Street Construction
Project, we have been advised that it is not our obligation to pay for replacing the existing sewer
system, but the City's obligation to take care of such replacements. We understand that this is your
Assessment Policy, but we ask what law you have for this assessment.
We also note that if we are assessed, that there could be assistance through the Local Option
Sales Tax Funds, depending upon income level. I would think that everyone should benefit from this
Fund, regardless of income, because anyone who purchases anything in the city is paying that 1%
sales mx. If we are to be assessed, we ask for a copy of the financial guidelines.
We understand by your letter that the assessment can be paid in full or over a ten-year period.
We ask that you notify us in writing when the payment is due, and when the interest will begin. Is
this now, during the project, or we will be billed for the assessment once the project is complete.

The City is conducting an open forum discussion to acquaint the residents along the
project with the proposed improvements and project schedule. Representatives of the
City staff will be available to discuss the scope of the project, .construction phasing,
timing, special assessment procedures, availability of financial assistance, o's well as to
answer any other questions relating to the project. Feel free to stop in at any time
during the above hours for an informal discussion. This meeting should offer mutual
benefit in that it gives the City the opportunity to explain the design of the project, and
also allows the public to express their concerns and opinions regarding the proposed
design. Consideration will be given to all comments and suggestions.
White Street was budgeted fo[ reconstruction as part of the Fiscal Year 2001 Street
Program. The project consists of the complete reconstrOction of base and pavement
surface. The pavement surface will be portland cement concrete with all new curbing.
White Street will remain its current widths of 41-foot from 21~t to 24th Street, and 28-
foot. from 24'h Street to 32nd Street.
White Street from 21st to 24~h Street was originally'constructed with asphalt in 1895,
with an overlay of that section in 1925. White Street from 24TM to 27~ Street, and from
27'h to 32"~ Street, was constructed of concrete in 1925 and 1926.
The project will include the replacement of some watermain from 27~h to 30~h Street,
and replacement of all water valves. The storm sewer will be modified to drain existing

water ponding along the streets and at various Iow points. Eighty-nine (89) lead water
services will be replaced~
The project will incorporate the replacement of 5,937 feet of 8" and 12" ~f sanitary
sewer. The sewer and most laterals'are over 100 years old and are in poor condition.
In addition, the replacements of all the 298 sanitary sewer laterals from the City main to
the White Street right-of-way line are scheduled. Each lateral replacement will be
assessed individually to that property. Not only are properties on White Street (122
laterals) being assessed, but other properties on Jackson (89 laterals) and Central
Avenue (87 laterals), which tie into the White Street sewer line, 'will also need
replacement. Therefore, properties that are not actually on White Street will be
assessed for their lateral replacement on this project. Sanitary sewe¢ lateral
replacements are not normally part of a project; but due to the age and condition o[ the
laterals, they are scheduled as part of this project to prevent future problems under the
new pavement.' The sewer and lateral, replacement will also heip reduce the current
stormwater infiltration problem.
Property owners will be asked to remove their vehicles from the job site during the day;
however, after work hours, owners will be provided access to their, residences.
This informational meeting is being held to offer the property owners along the project
as much information as possible in anticipation of the City Council's public hearing on
the project, scheduled for January 21, 2002.
The project completion for the roadway is set for October 30, 2002, with estimated
final completion of sidewalk and sodding by June 30, 2003.
The construction project will include:

PROJECT ASSESSMENT INFORMATION
Based upon the City's street assessment policy, 19.38 percent of the street costs are
being assessed on this project, along with the assessment values of the water service
lateral and sanitary sewer lateral replacements. The project, as outlined, will require
$2,817,871 in City funds, which is 75% of the project cost.
Final assessments will be calculated after the completion of the project in early fall of
2003, and' after a final cost has been 'developed. The final assessment may be no
greater than the estimated assessment you have already received but could be less than
the estimated amount. Assessments may be paid in full or over a ten-year period with
interest, currently at the rate of nine percent.
STREET ASSESSMENT POLICY (ADOPTED APRIL 18, 1983)
Reconstruction: Complete removal of the existing pavement and base and replacement
with new base, curb and pavement.
For Resident Properties: (i.e., R., R., R.), along a local street is 100% of the cost is
asseSsed. (Less 20% rollback.)
Local Option Sales Tax Funds will be uti'lized to reduce the amount to be assessed by
75%.
All property included within the area described so as to include one-half of the privately-
owned property between each street to be improved and the next street, whether such
privately-owned property abuts upon the street to be improved or not shall be assessed.
In no case shall property situated more than 300 feet from the street being improved be
assessed.
FINANCIAL ASSISTANCE AVAILABLE
Financial assistance is available for a portion or the entire street paving and sewer lateral
assessments. Low- and moderate-income property owners subject to the assessments
will be eligible for financial assistance ranging from 20% to 100% of the assessment for
owner-occupied residential properties, depending on family size and income level. This
financial assistance is funded through 1% Local Option Sales Tax Funds. After final
assessments are mailed upon completion of the project (Fall, 2003), property owners
may apply for this financial assistance.. Information required to be submitted with the
application would be a copy of your. latest Federal Income Tax return, and supporting W-
2's. Information regarding the level of financial assistance as compared to family size
and income level will be available at the meeting.
