SUBJECT: Acceptance of Sanitary Sewer Lift Station in Arbor Estates -Phase 3
City Engineer Gus Psihoyos is recommending acceptance of the sanitary sewer lift
station that the developer, Kivlahan Farms, LLC, recently completed in Arbor Estates -
Phase 3. Maintenance of said improvements shall be the responsibility of the
contractor, McDermott Excavating, and the owner, Kivlahan Farms, LLC, for a period of
two years from the date of acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of the sanitary sewer lift
station that the developer, Kivlahan Farms, LLC, has recently completed in Arbor
Estates -Phase 3.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 450-05, the
developer of Arbor Estates was required to install certain improvements including a
sanitary sewer lift station, and to dedicate the improvements to the City upon
completion. The developer of Arbor Estates -Phase 3, Kivlahan Farms, LLC, has
recently completed the lift station and has requested the City's acceptance of the lift
station that has been installed. The remaining improvements for the subdivision will
be accepted after completion and inspection.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of
the improvements, together with a statement of reasons for any rejection.
Kivlahan Farms, LLC, requested City's acceptance of the sanitary sewer lift station
in Arbor Estates. Upon inspection by the City, it has been determined that the
sanitary sewer lift station required by Resolution No. 450-05 has been completed in
accordance with plans approved by the City Council and in conformance with City
specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the sanitary sewer lift
station in Arbor Estates -Phase 3. Maintenance of said improvements shall be the
responsibility of the contractor, McDermott Excavating, and the owner, Kivlahan
Farms, LLC, for a period for two years from the date of acceptance by the City
Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the sanitary
sewer lift station.

RESOLUTION NO. 238-07
ACCEPTING SANITARY SEWER LIFT STATION IN ARBOR ESTATES
- PHASE 3
Whereas, pursuant to Resolution 450-05, certain public improvements
including a sanitary sewer lift station were installed by the developer of Arbor
Estates -Phase 3; and
Whereas, -the sanitary sewer lift station has been completed and the City
Manager has examined the work and has filed a certificate stating that the same
has been completed in accordance with the plans approved by the City Council
and in conformance with City specifications, and has recommended that the
sanitary sewer lift station be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said sanitary sewer lift station in Arbor Estates -Phase 3 be and the
same is hereby accepted.
Section 2. That maintenance of said lift station shall be the
responsibility of the contractor and the owner for a period of two years from this
date.

Re: Arbor Estates Lift Station Phase 3
Dear Gus:
This letter is being prepared on behalf of John & Doris Kivlahan, owners of the Arbor Estates Subdivision.
They request final acceptance by the City of Dubuque for 100% completion of the new lift station that has
been installed as a part of the project development in the subdivision per the lift station plans.
Jonathan Brown of the City Wastewater Treatment Operations along with Jason McDermott of McDermott
Excavating were present at the site on January 4, 2007 for the final inspection and to view the operation of
the lift station. Subsequent to this start up, Jonathan required that a modification be made on the trash
basket to facilitate the removal of the basket from the rail system. Said modifications were accomplished
and Jonathon reviewed the project again on April 2, 2007 and gave his approval thereafter in an email to
Ron Turner dated April 5, 2007. By approving this unit, the City operations personnel can get the station
integrated into their normal operations and it is the desire and wishes of the subdivision owners that this be
accomplished at this appropriate time.
The lot in the subdivision where this lift station is located is further described as:
LOT 15, BLOCK 7, IN THE CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA.
