Grandview Final Plat of Lots 1 and 2 of C and Z Addition Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion Staff reviewed the proposed final plat indicating that the plat corrects a survey error made many years ago. The plat also corrects the encroachment of Mr. Clinton's house onto the Zahina property. There were no public comments. The Zoning Advisory Commission discussed the request, noting that the plat does not adversely impact adjacent property owners and will protect the value of the two affected properties. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, waiving the lot frontage and lot area requirements of the Subdivision Regulations. ~ A simple majority vote is needed for the City Council to approve the request. ~ Respectfully submitted, Eugene Bird, Jr., Chairperson Zoning Advisory Commission Prepared by: Laura Carstens, City Planner Address: Ci Hell 50 W. 13th St TelephOne: 589~.2t0 s RESOLUTION NO. 10-02 RESOLUTION APPROVING THE FINAL PLAT OF LOTS 1 AND 2 OF C AND Z ADDITION Whereas, there has been filed with the City Clerk a final plat of Lots 1 and 2 of C and Z Addition; and Whereas, said plat provides Lot 1 with 4,876 square feet of lot area and 50.63 feet of lot frontage and Lot 2 with 4,966 square feet of lot area and 48.70 feet of lot frontage, where 6,000 square feet of lot area and 60 feet of lot frontage respectively are required; and Whereas, said final plat has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said final plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 1 with 4,876 square feet of lot area and 50.63 feet of lot frontage and Lot 2 with 4,966 square feet of lot area and 48.70 feet of lot frontage, where 6,000 square feet of lot area and 60 feet of lot frontage respectively are required. Section 2. That the final plat of Lots 1 and 2 of C and Z Addition is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said final plat. Kritz, Associate Planner Final Plat Lots 1 and 2 of C and Z Addition INTRODUCTION The submitted final plat of Lots 1 and 2 of C and Z Addition resubdivides and consolidates four existing lots on South Grandview Avenue into two lots. The resubdivision was necessary as the owner of Lot 2, Roland Clinton, found that a small portion of his house encroached on the property of Richard J. and Patricia M. Zahina, Lot 1. DISCUSSION The submitted final plats of Lots 1 and 2 of C and Z Addition corrects a long standing platting problem along South Grandview Avenue by consolidating four lots into two, and shifting the lot line between the two lots to place Mr. Clinton's house entirely on his property. The final plat is being reviewed by the Zoning Advisory Commission because the two lots created are substandard in terms of lot frontage and lot area. ']'he lots along this portion of South Grandview Avenue all tend to have less than 60 feet of lot frontage and 6,000 square feet of lot area. The two lots created by the final plat of Lots 1 and 2 of C and Z Addition are currently occupied by a single-family house on each lot. The new subdivision will not adversely impact adjacent property or future improvements to those properties. RECOMMENDATION The submitted final plat of Lots 1 and 2 of C and Z Addition is in substantial compliance with the City of Dubuque Subdivision Regulations. Planning staff recommends that the final plat be approved subject to waiving lot frontage requirements and lot area requirements for both Lots 1 and 2. KLK/mkr Attachments
