City Engineer Gus Psihoyos recommends City Council acceptance of the public
improvements that the developers, North Cascade Road Developers, LLC, have
recently completed in Timber-Hyrst Estates No. 3. Maintenance of said public
improvements shall be the responsibility of the owners, North Cascade Road
Developers, LLC, for a period of two years form the date of acceptance by the City
Council. There are no storm water detention facilities associated with this phase of the
subdivision.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements
that the developers, North Cascade Road Developers, LLC, have recently completed in
Timber-Hyrst Estates No. 3.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 343-12, the
developer of Timber-Hyrst Estates No. 3 was required to install certain improvements
including street paving with curb, sanitary sewer main, watermain, storm sewers and
catch basins, and street lighting and to dedicate these. improvements to the City upon
completion. There are no storm water detention facilities associated with this phase of
the subdivision.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On July 30, 2014, the owners requested City's acceptance of the improvements in
Timber-Hyrst Estates No. 3. Upon inspection by the City, it has been determined that
the public improvements required by Resolution 343-12 have been completed in
accordance with plans approved by the City Council and in conformance with City
specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements as
described above. Maintenance of said public improvements shall be the responsibility of
the owners, North Cascade Road Developers, LLC, for a period of two (2) years from
the date of acceptance by City Council. There is no storm water detention facilities
associated with this phase of the subdivision.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements in Timber-Hyrst Estates No. 3.

ACCEPTING PUBLIC IMPROVEMENTS IN TIMBER-HYRST ESTATES NO. 3 IN THE
CITY OF DUBUQUE, IOWA
Whereas, pursuant to Resolution 343-12, certain public improvements including
street paving with curb, storm sewer and catch basins, sanitary sewer, watermain, and
street lighting were installed by the developer of Timber-Hyrst Estates No. 3 in the City
of Dubuque, Iowa; and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and
that said public improvements in Timber Hyrst Estates No. 3 be and the same is hereby
accepted.
Section 2. That maintenance of said public improvements shall be the
responsibility of the owners, North Cascade Road Developers, LLC, for a period of two
(2) years from the date of this resolution.

The City of Dubuque is in the midst of a project to convert 9th Street (between Locust
Street and Kerper Boulevard), 11th Street (between Central Avenue and Kerper
Boulevard), and Pine Street (between 9th and 11th Streets) from one-way to two-way.
As part of this conversion, the Iowa Department of Transportation has requested some
segments of 9th Street, 11th Street, Pine Street, the former Elm Street connector and
White Street have roadway jurisdiction transfer from the Iowa Department to
Transportation to the City or from the City to the Iowa Department of Transportation.
Traffic patterns are expected to shift due to the conversion of streets to two-way traffic.
Recognizing this shift will occur, this agreement addresses that portion of roadway that
will be US 52 and that portion that will be local. In most cases, the transfer of
jurisdiction is for half the roadway. This addresses the fact that traffic will be allowed to
travel both directions. One direction is for the state route, the other direction is local
traffic. The route signage will be updated on the roadways once the change has taken
place.
City Engineer Gus Psihoyos recommends City Council authorization for the Mayor to
execute the Transfer of Jurisdiction Agreement with the Iowa Department of
Transportation.
