Van Milligen, City Manager SUBJECT: Accepting the Deed to Certain Real Estate from SB Development, LLC DATE: August 13, 2014 In 2013 and 2014, the City of Dubuque entered into purchase agreements with Blum Properties, Inc. for real estate on 16th Street in connection with the Bee Branch Creek Restoration Project. The Blum property was subject to a prior right of first refusal agreement between Blum Properties, Inc. and SB Development, LLC. The City and SB Development, LLC have entered into an agreement pursuant to which SB Development, LLC has agreed to relinquish all right, title and interest in and to the Blum property for $25,000. City Attorney Barry Lindahl recommends City Council approval of a resolution accepting the Quit Claim Deed to the Blum property on 16th Street. The City and SB Development, LLC have entered into an agreement pursuant to which SB Development, LLC has agreed to relinquish all right, title and interest in and to the Blum property. The attached Quit Claim Deed relinquishes all right, title and interest of SB Development, LLC in and to the Blum property. Attached is a resolution accepting the deed to the property. I recommend that the resolution be submitted to the City Council for consideration and approval. WHEREAS, SB Development, LLC (SB) has entered into a Right of First Refusal Agreement (the ROFR) with Blum Properties, Inc. (Blum), dated March 31, 2006, recorded July 17, 2006, Instrument No. 2006-10777, records of the Dubuque County Recorder, for the real estate described in the ROFR; and WHEREAS, the City of Dubuque, Iowa (Dubuque) has entered into purchase agreements with Blum for real estate which is the subject of the ROFR, described in Exhibit "A" attached hereto (the ROFR Real Estate); and WHEREAS, SB has agreed to relinquish all right, title and interest in and to the ROFR Real Estate upon the terms and conditions set forth herein. IN THE CITY OF DUBUQUE Whereas, the City of Dubuque intends to acquire certain real estate to for the stormwater mitigation activities collectively known as the Bee Branch Watershed Flood Mitigation Project as recommended in the 2001 "Drainage Basin Master Plan" as amended in 2013; and Whereas, a purchase agreement has been finalized with the owner of the property scheduled for acquisition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City of Dubuque hereby approves the acquisition of the following legally described property: Lots 182, 182A, 183, 184, 185, 186, West 65' of Lots 217, 218, 219, 220, & 221, and East 35' of Lots 217, 218, 219, 220, & 221 all in East Dubuque Addition, in the City of Dubuque, Dubuque County, Iowa At the cost of Five Hundred Thousand and 00/100 Dollars ($500,000.00).
