The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing adjacent businesses to his
property and configuration of the subject parcel.
Staff reviewed surrounding zoning, land use and history of zoning changes in the area.
There were no public comments.
The Zoning Advisory Commission discussed the request, and felt it was appropriate
Recommendation
By a vote of 5 to 0 the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

ORDINANCE NO. 26-07
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES $Y RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT THE'END OF KEBBIE
DRIVE FROM R-2 TWO-FAMILY RESIDENTIAL DISTRICT TO R-3 MODERATE
DENSITY MULTI-FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The -Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter-described
property from R-2 Two-Family Residential District to R-3 Moderate Density Multi-Family
Residential District, to wit:
Lot 3 C. J. Bies Subdivision No. 2, and to the centerline of the adjoining
public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Property History: The property was located in the County until its annexation in 1965.
The property was subsequently subdivided and two houses built on the southern
portion of Kebbie Drive in the 1960s. The property sat idle until three duplexes were
built in 2004.
The property has been rezoned several times in a relatively brief period. It was
originally zoned R-2 Two Family Residential, then rezoned to R-4 Multi-Family
Residential, then rezoned to R-1 Single-Family Residential and in 2001 rezoned back to
R-2 Two-Family Residential. The property directly south and adjacent to the subject lot
was rezoned to C-3 General Commercial District from R-4 Multi-Family Residential
District also in 2001.
Physical Characteristics: The subject property is an approximately 15,000 square foot
irregular shaped lot sloping from the north to the south. It is located at the southern
terminus of Kebbie Drive and the southern portion of the lot is consumed by public
right-of--way for an offset cul-de-sac.
Concurrence with Comprehensive Plan: The Future Land Use Map 2030 indicates
this area as single- ortwo-family residential. The Land Use Element of the
Comprehensive Plan encourages the concept of mixed use development and diverse
self sufficient neighborhoods. The Land Use element also recommends buffering
incompatible uses from each other.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.

Traffic Patterns/Counts: The Iowa Department of Transportation does not have
traffic counts for the Kebbie Drive area. Kebbie Drive empties onto Bies Road.
There is significant cross traffic from the Kennedy Mall/Dodge Street area along
Century Drive over both Sylvan and Bies Drives to Pennsylvania Avenue. The
addition of a tri-plex here should have very limited impact on overall traffic in the
area.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.
Adjacent Properties: The subject parcel is directly adjacent to a duplex and across
the street from asingle-family residence. The subject parcel is also directly
adjacent to a C-3 zoned office/commercial property to the east and vacant C-3
property to the south. A tri-plex at this location could serve as a buffer between
single and two-family residential development and general commercial
development.
CIP Investments: None proposed.
Staff Analysis: The applicant is proposing to rezone an approximately 15,000 square
foot lot at the southern terminus of Kebbie Drive from R-2 Two-Family Residential
district to R-3 Moderate Density Multi-Family Residential district.
The applicant's intention is to build athree-plex and accessory detached garage at this
location. The neighborhood is currently a mix of older 60s single-family homes and
several newer duplexes built in 2004. The subject property is irregularly shaped in that
the offset cul-de-sac consumes a large portion of the southern portion of the lot.
The property is bordered by the existing Lifetime Center to the east and vacant, C-3
zoned property to the south. The addition of a tri-plex at this location should generate
little additional traffic and have very limited impact on the neighborhood. The proposed
residence may serve as a buffer between the commercial and residential uses.
Staff recommends the Commission review the criteria established in Section 6-1.1 of
the Zoning Ordinance regarding rezoning reclassification.
