Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff memorandum and related materials are attached for your review.
Discussion
The applicant was not in attendance.
Staff reviewed the staff report, reviewing the location of the property and noting that Lot 1 does
not have frontage on a public or private street, but rather there is an access easement reserved
as part of the submitted plat through Lot 2. Staff indicated reciprocal access easements are not
unusual in commercial developments, and recommended approval of the submitted Final Plat.
There were no public comments.
The Zoning Advisory Commission discussed the request, and felt it was appropriate.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request subject to waiving lot frontage requirements for Lot 1 Miller Place No. 2.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Final Plat of Miller Place No. 2 is located in Dubuque County north of the
Highway 61/151 interchange. The submitted Final Plat is within two miles of the city of
Dubuque, and is being jointly reviewed by the City and Dubuque County.
DISCUSSION
The submitted Final Plat of Miller Place No. 2 subdivides an existing 16.55 acres into
two parcels to facilitate the sale of Lot 1.
The existing parcel is served by an existing private roadway in Dubuque County named
Woodgate Drive. Lot 1 does not have frontage on Woodgate Drive, but rather utilizes a
66 -foot access and utility easement through Lot 2. Lot 3 has frontage on Woodgate
Drive.
Planning staff does not object to Lot 1 not having frontage on Woodgate Drive. It is not
unusual within commercial subdivisions to have reciprocal access easements between
properties. The use of access easements within commercial and industrial subdivisions
can maximize developable land, help reduce impermeable surface, and still ensure
appropriate emergency access.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission review the submitted
Final Plat of Miller Place No. 2, and recommend approval of the Final Plat subject to
waiving lot frontage requirements for Lot 1.

DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk a Final Plat of Miller Place No. 2
in Dubuque County, Iowa; and
Whereas, said Final Plat provides 0 feet of frontage for Lot 1 on a public or
approved private street, where street frontage is required by Section 11-14 of Title 16 of
the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the Code of Ordinances, Unified
Development Code, is waived to allow 0 feet of frontage on a public or approved private
street for Lot 1.
Section 2. That the Final Plat of Miller Place No. 2 is hereby approved and the
Mayor and City Council are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa upon said Final Plat.
