SUBJECT: Cooperative Traffic Paint and Pavement Markings Agreement
City Engineer Gus Psihoyos is recommending City Council approval of a Traffic Paint
and Pavement Markings Agreement between the City of Dubuque and the City of
Asbury. This agreement ensures that traffic paint and pavement marking
responsibilities are not split down roadway centerlines, which is inefficient and
impractical. The agreement reflects the new annexation boundaries on Dubuque's west
side.
The Agreement provides that the City of Asbury will provide pavement markings on
Asbury Road from Seippel Road east to Briarwood Drive and on Heacock Road. The
City of Dubuque will provide pavement markings on Middle Road from Radford Road to
Seippel Road, and on Seippel Road from Middle Road to Chavenelle Drive.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to provide information and recommend
approval of a traffic paint and pavement marking agreement between the City of
Dubuque and the City of Asbury.
DISCUSSION
Due to the recent annexations of properties along Middle Road and Seippel
Road, a traffic paint and pavement markings agreement needs to be initiated with
the City of Asbury. The City Engineer and County Engineer have met to
negotiate pavement marking responsibilities for certain sections of roadways
where jurisdiction by each party extends to the roadway centerline. The
agreement ensures that the pavement marking responsibilities are not split down
the roadway centerlines, which would be inefficient and impractical. The
agreement reflects the new annexation boundaries on Dubuque's west side.
The agreement provides that the City of Asbury will provide pavement markings
on Asbury Road from Seippel Road east to Briarwood Drive and on Heacock
Road. The City of Dubuque will provide pavement markings on Middle Road
from Radford Road to Seippel Road, and on Seippel Road from Middle Road to
Chavenelle Drive. The proposed agreement was reviewed and approved by City
Attorney Barry Lindahl.
ACTION TO BE TAKEN
1 recommend that the City Council consider and approve the cooperative traffic
paint and pavement markings agreement between the City of Asbury and City of
Dubuque.

APPROVING TRAFFIC PAINT AND PAVEMENT MARKINGS
AGREEMENT BETWEEN THE CITY OF DUBUQUE AND THE CITY OF
ASBURY
Whereas, jurisdiction over certain roadways in Dubuque County is divided
down the centerline between City of Dubuque and the City of Asbury; and
Whereas, City of Dubuque, Iowa, and City of Asbury, Iowa, agree that
painting of pavement markings divided down roadway centerlines is not cost
efficient or practical; and
Whereas, City of Dubuque is willing to perform traffic paint and pavement
marking operations on portions of roadways located in Dubuque County,
specifically, Middle Road, from Radford Road to Seippel Road, and Seippel
Road, from Middle Road to Chavenelle Road; and
Whereas, City of Asbury is willing to perform traffic paint and pavement
marking operations on portions of roadway located in the City of Dubuque,
specifically, Asbury Road, from Seippel Road east to Briarwood Drive and
Heacock Road; and
Whereas, it is necessary that City of Dubuque and City of Asbury enter
into an agreement regarding the traffic paint and pavement markings on these
.roadways.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City Council of the City of Dubuque hereby
approves and directs the Mayor to sign the attached Traffic Paint and Pavement
Markings Agreement with City of Asbury for traffic paint and pavement markings
on said roadways.

TRAFFIC PAINT AND PAVEMENT MARKINGS AGREEMENT
BETWEEN
THE CITY OF ASBURY, IOWA
AND
THE CITY OF DUBUQUE, IOWA
This Agreement, dated for reference purposes the 8th day of
~aY 2007, is made and entered into by and between City of Asbury,
Iowa (Asbury) and the City of Dubuque, Iowa (Dubuque) to define the duties and
responsibilities of Asbury and Dubuque for traffic paint and pavement markings
on roadways of each city.
1. Asbury agrees to perform traffic paint and pavement marking operations on
the following roadways:
a) Asbury Road from Seippel Road east to E3riarwood Drive; and,
b) Heacock Road.
2. Dubuque agrees to perform traffic paint and pavement marking operations on
the following roadways:
a) Middle Road from Radford Road to Seippel Road; and,
b) Seippel Road from Middle Road to Chavenelle Road.
3. By separate agreement, a copy of which is attached hereto, the County of
Dubuque has agreed to perform traffic paint and pavement marking
operations on Middle Road from Seippel Road west to Dubuque's corporate
limits on behalf of Dubuque.
4. Traffic paint and pavement marking operations means the furnishing and
installation of edgelines, centerlines, symbols, and legends as needed upon
the roadway.
5. Nothing in this Agreement shall be construed to transfer any liability from one
jurisdiction to the other, except as herein specified.
,. 6. This Agreement shall take effect upon approval by both parties and shall
continue until terminated as provided herein.
7. This Agreement may be terminated at any time by either party upon thirty (30)
days written notice to the other party.
8. The City of Asbury Public Works Director and the City of Dubuque Public
Works Director shall administer this Agreement. In doing so, the Asbury
Public Works Director shall consult with the Asbury City Administrator and the
Dubuque Public Works Director shall consult with the Dubuque City Manager
on matters related to this Agreement. No real or personal property shall be
acquired by either party under the provisions of this Agreement.
9. The party responsible under this Agreement for the traffic paint and pavement
marking operations of a roadway shall defend, indemnify and hold harmless
the other party, its officers, agents and employees, from any and all causes of
action, suits at law or in equity, losses, damages, claims or demands, and
from any and all liability and expense of whatsoever nature, arising out of or
in connection with the party's performance or failure to perform its traffic paint
and pavement marking duties on such roadway pursuant to this Agreement.
