SUBJECT: Release and Acceptance of Sanitary Sewer Easement, Lot 4 of Raven
Oaks No. 2 and Lots 1 and 2 of Raven Oaks Place in the City of
Dubuque, Iowa
A request has been received from Kluck Construction to vacate and relocate a portion
of an existing sanitary sewer easement and vacate a utility easement in Lot 4 of Raven
Oaks No. 2 and Lots 1 and 2 of Raven Oaks Place.
Kluck Partnership is the current owner of Lot 4 of Raven Oaks No. 2 and Lots 1 and 2 of
Raven Oaks Place in the City of Dubuque, Iowa. Kluck Partnership intends to construct
an apartment building on Lot 4 of Raven Oaks No. 2 which will conflict with the location
of the existing City sanitary sewer easement on this property.
Since Kluck Partnership has agreed to relocate the sewer at their expense and grant
the City a new easement, City Engineer Gus Psihoyos recommends City Council
approval of the request and that a public hearing be set for June 18, 2007.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Oaks No. 2 and Lots 1 and 2 of Raven Oaks Place in the City of
Dubuque, Iowa
INTRODUCTION
This is in response to a May 18, 2007 request from Kluck Construction for the vacating
and relocation of a portion of an existing sanitary sewer easement and vacate of a utility
easement in Lot 4 of Raven Oaks No. 2 and Lots 1 and 2 of Raven Oaks Place.
DISCUSSION
Kluck Partnership is the current owner of Lot 4 of Raven Oaks No. 2 and Lots 1 and 2 of
Raven Oaks Place in the City of Dubuque, Iowa, which is located along Raven Oaks
Drive. Kluck Partnership intends to construct an apartment building on Lot 4 of Raven
Oaks No. 2 which will conflict with the location of the existing City sanitary sewer
easement on this property.
Kluck Construction has relocated a portion of the sanitary sewer at the northwest corner
of the proposed building at their sole expense, and desires to dedicate a new sanitary
sewer easement to the City as shown on the attached Plat of Easements.
RECOMMENDATION
The improvement plans and location of the new sanitary sewer have been reviewed and
approved by City Engineering. Kluck Partnership has also contacted the utility
companies regarding the vacating of the utility easement along the east side of said Lot
4 as shown on the Exhibit Plat of Easements to be vacated.
Since Kluck Partnership has agreed to relocate the sewer at their expense and grant
the City a new easement, I would recommend that the City Council approve the request
and that the vacating of the prior sewer easement and portions of the utility and access
easements be set for public hearing on June 18, 2007.
ACTION TO BE TAKEN
The enclosed resolution releasing a portion of the existing sanitary sewer, access and
utility easements and dedicating a new sanitary sewer easement should be set for a
public hearing.

request the vacation of the 5 foot wide utility easement along the easterly line of said Lot
4 and a portson of the existing utility and access easement along the westerly boundary of
said Lot 4 as shown on the attached sketch.
we have contacted the affected utilities and City Bnginccring and they have not indicated
a problem with the proposed vacating. We have relocated the existing sanitary sewer in
accordance with plans approved by City Engineering- The proposed vacating will provide
an adequate area for the construction of an apartment building on the site.

RESOLUTION OF INTENT TO DISPOSE OF INTEREST AND RELEASE
A PORTION OF AN EXISTING 20-FOOT WIDE SANITARY SEWER
EASEMENT, A 25-FOOT ACCESS AND UTILITY EASEMENT, AND A 5-FOOT
UTILITY EASEMENT ON LOT 4 OF RAVEN OAKS NO. 2 AND LOTS 1 AND 2
OF RAVEN OAKS PLACE IN THE CITY OF DUBUQUE, IOWA
Whereas, Kluck Partnership is the current owner of Lot 4 of Raven Oaks
No. 2 and Lots 1 and 2 of Raven Oaks Place in the City of Dubuque, Iowa; and
Whereas, a 20-foot wide sanitary sewer easement, a 25-foot access and
utility easement, and a 5-foot utility easement are currently platted on said lots;
and
Whereas, Kluck Partnership has petitioned to vacate an unused portion of
said easements in said lots.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque, Iowa, intends to dispose of its
interest and release of an unused portion of an existing 20-foot wide sanitary
sewer easement, a 25-foot access and utility easement, and a 5-foot utility
easement on Lot 4 of Raven Oaks No. 2 and Lots 1 and 2 of Raven Oaks Place
in the City of Dubuque, Iowa.
Section 2. That the City Clerk be and is hereby authorized and directed
to cause a notice to be published as prescribed under Section 364.7 Code of
Iowa.
