Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request reviewing the existing structures on the property and his desire to demolish them and build a new duplex residence. Staff reviewed surrounding zoning and land use and noted that the existing structures are non-conforming in terms of setback requirements. There was one public comment in opposition to the request citing concern for the lot being too small and that if approved, could encourage additional rezoning requests. The Zoning Advisory Commission discussed the request, reviewing the amount of green space and off-street parking requirements for a duplex. Recommendation By a vote of 5 to 0 the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Property History: The property was annexed to the City in the 1930s, subdivided in the 1940s and asingle-family home built at this location in 1951. Physical Characteristics: The subject property has 50 feet of frontage along Beverly Avenue and is 110 feet deep. The subject property drops approximately 8 feet from the high spot in the back yard to Beverly Avenue. The subject property accommodates an existing single-family home and detached garage. The structures appear to be legally non-conforming in that they are built closer to the rear and side property lines than the required 6 feet. Concurrence with Comprehensive Plan: The Comprehensive Plan calls for this area to remain residential. Impact of Request on: Utilities: Existing utilities are adequate to serve the site. Traffic Patterns/Counts: The conversion of asingle-family home to a duplex at this location will have very little impact on existing traffic. Access to Beverly Avenue will remain the same. Public Services: The existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control and storm water control is provided during all phases of development. Rezoning Staff Report - 2678 Beverly Avenue Page 2 Adjacent Properties: The conversion of asingle-family home to a duplex should have limited impact on adjacent properties. Any conversion will require that the required amount of parking be provided for afour-plex. CIP Investments: None proposed. Staff Analysis: The applicant is proposing to purchase a lot at 2678 Beverly Avenue that accommodates an existing single-family home and detached garage that were built in 1951. The applicant's intention is to demolish the house and garage and build a duplex at this location. A duplex requires a minimum of 5,000 square feet of lot area, and the car lot has 5,500 square feet of lot area. The applicant will have to provide a minimum of four paved off-street parking spaces for a duplex, if approved. The property is bordered on all sides by single-family residential development; however, the property to the south along the rear property line is zoned R-2. Therefore, the applicants request is to expand an existing R-2 District. Staff recommends that the Zoning Advisory Commission review the criteria established in Section 6-1.1 regarding rezoning.
