SUBJECT: Asbury Road Widening at Sam's Club
City Engineer Gus Psihoyos recommends City Council acceptance of the dedication of
right-of-way and Grant of Easement for storm sewer and traffic signals needed for
construction of an additional eastbound lane on Asbury Road by Sam's Club.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Asbury Road Widening at Sam's Club
BACKGROUND
The construction of an additional eastbound lane on Asbury Road was one of the
requirements as part of the Development Agreement for Sam's Club. This
widening required additional right-of-way to be obtained from Plastic Center, Inc.
along the south side of Asbury Road and the need for easements for storm
sewer and traffic signals.
DISCUSSION
The attached acquisition plats dedicate the additional right-of-way required for
the widening along the south side of Asbury Road and a dedication of the
existing roadway easement for Asbury Road along the entire Plastic Center
frontage. The plats also indicate easements reserved for storm sewer and traffic
signals. The plats have been prepared by Buesing & Associates with the owner
dedicating the platted area for right-of-way and public utilities.
RECOMMENDATION
Engineering recommends approval of the acquisition plats and acceptance of the
proposed right-of-way dedication, and acceptance of the Grant of Easement for
Storm Sewer and Traffic Signals.
ACTION TO BE TAKEN
The dedication of right-of-way and Grant of Easement should be accepted by
adopting the enclosed resolutions approving the acquisition plats and Grant of
Easement for Storm Sewer and Traffic Signals.

RESOLUTION NO. 360-07
ACCEPTING A CONVEYANCE OF EASEMENTS OVER PART OF LOT
1 OF PFOHL FARM TO THE CITY OF DUBUQUE
Whereas, the City of Dubuque entered into an Agreement with Plastic
Center, Inc. pursuant to which Plastic Center, Inc. agreed to convey easements
for storm sewer and traffic signals over part of Lot 1 of Pfohl Farm in the City of
Dubuque, Iowa, as shown on the Acquisition Easement and Plat thereof; and
Whereas, Plastic Center, Inc. has executed a conveyance of said
property.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby
approves, accepts and consents to the Grant of Easement for Storm Sewer and
Traffic Signals from Plastic Center, Inc., copies of which are attached hereto, as
required by Iowa Code Section 569.7.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection
herewith.

GRANT OF EASEMENT FOR STORM SEWER & TRAFFIC SIGNALS
For and in consideration of the sum of One and 00/100 Dollar ($1.00) and other
good and valuable consideration, the receipt whereof is hereby acknowledged,

of Dubuque County, State of Iowa, for themselves, their heirs and assigns, do
hereby grant, sell and convey to the CITY OF DUBUQUE, IOWA, a municipal
corporation, its agents and contractors, from the date hereof, aright-of-way and
easement through, under and across the following described real estate situated
in Dubuque, Iowa, to wit:
Lot 1 of Pfohl Farm in the City of Dubuque, Dubuque County, Iowa
Said easement shall be as shown on the attached Acquisition and Easement Plat
for the purpose of maintaining a storm sewer and traffic signals already
constructed in accordance with the Plans and Specifications on file in the office
of the City Engineer.
It is understood and agreed that the Grantee herein shall restore the disturbed
area due to any maintenance or repair of said storm sewer or traffic signals.
Further, it is understood that Grantee shall maintain the spillway located within
the subject easement so as to prevent any erosion of, or damage to that
property.
Grantor reserves the right to alter or terminate said storm sewer easement
should such interfere with Grantor's future use of the encumbered real estate.
To have and to hold unto the said City of Dubuque, Iowa, forever, and the
undersigned do hereby expressly covenant that they are the owners in fee of
said real estate and have good right to execute this agreement, and that the
Grantee, its agents or contractors, shall at all times have free access to and
egress from and over said real estate to maintain or repair said storm sewer
thereon or therein.
