Van Milligen, City Manager SUBJECT: Upper Bee Branch Creek Restoration Project 429 Rhomberg Stabilization Project (CIP #3401654) DATE: September 26, 2014 Dubuque 2007 • 2012 • 2013 City Engineer Gus Psihoyos is recommending approval of the plans, specifications, form of contract and the estimated cost of $255,881 for the 429 Rhomberg Stabilization Project to be considered at the public hearing. The Bee Branch Creek Restoration Project requires a permit from the U.S. Army Corps of Engineers (USACE). The issuance of a federal permit constitutes a federal action. Therefore, the Bee Branch Creek Restoration Project must meet the federal requirements set forth in 36 CFR Part 800, Section 106 (Section 106). The stated goal of Section 106 is to assure that "no unnecessary harm comes to historic properties as a result of a federal action." In 2009, Architectural Historian James Jacobsen evaluated 429 Rhomberg and concluded that it meets the criteria for being listed on the National Register of Historic Places due to distinctive architectural characteristics. According to the U.S. Department of the Interior National Park Service, the National Register of Historic Places is "the official list of the Nation's historic places worthy of preservation." Due to the potential effect on historic buildings such as 429 Rhomberg, the Bee Branch Creek Restoration Project could not move forward until procedures, stipulations, and acceptable mitigation measures were established to take into account those potential effects. This was accomplished through the execution of a Programmatic Agreement (PA) among the U.S. Army Corp of Engineers, the Iowa Department of Natural Resources, the State Historic Preservation Officer, and the City of Dubuque as authorized by the City Council in April of 2010. Per the terms of Programmatic Agreement, the City of Dubuque is obligated to protect 429 Rhomberg from both direct and indirect adverse effects that can be reasonably foreseen due to the construction of the Bee Branch Creek Restoration Project. Further, the City is obligated to develop treatment measures to minimize and/or mitigate those effects. City staff inspection of 429 Rhomberg revealed that there are structural issues with the building. Of specific concern was the roof and parapet. The parapet was specifically mentioned in the architectural historian's report that established the historic significance of the building. Because the Bee Branch Creek Restoration Project involves driving support structures for a bridge within 50 feet of 429 Rhomberg, it is "reasonably foreseeable" that the vibration to occur during construction of the bridge will adversely impact 429 Rhomberg. Therefore, per the Programmatic Agreement the City is obligated to devise treatment measures to minimize the effect that construction will have on the building. When City staff approached the property owner to discuss the condition of the building and potential, preventative stabilization measures, the owner informed the City that they were open to selling 429 Rhomberg, along with 427 Rhomberg and the two vacant lots to the west. The primary benefit of purchasing 429 Rhomberg is that it would allow the City complete control over the building before and during the construction activity in the vicinity of the property. Owning the property expands the City's options when it comes to stabilize and protect the building from damage otherwise all city actions would have to be done through a potentially cumbersome agreement with a third party. In either case, it would prove costly and it would delay completion of the project if the City waits to stabilize and protect the building until damage starts to occur as a result of the construction activity associated with the Bee Branch Creek Restoration Project. This would force the City's contractor to cease construction while stabilization measures are designed, approved, and implemented. Therefore, it was in the best interest of the city to acquire 429 Rhomberg, and as a condition of the sale 427 Rhomberg and the two vacant lots to the west. It is also in the best interest of the City to stabilize the building prior to construction of the Bee Branch Creek Restoration Project. Unfortunately, the City has experience with a similar situation when the 4th Street Parking Ramp was constructed. During the construction process some of the historic structures in the 300 block of Main Street were cracked, resulting in years of litigation and hundreds of thousands of dollars in costs. On the Bee Branch Project, the City is trying to do a better evaluation of potential risks and methods to mitigate those risks. On November 18, 2013, the City Council authorized the acquisition of 427-429 Rhomberg for $130,000.00 thought to be less than the actual value of the property based on the appraised value of similar property in the area. In addition to issues with the roof and parapet, 429 Rhomberg which had already been vacant for several months is to remain vacant during construction of the Bee Branch Creek Restoration Project. Therefore, in order to protect the City's investment, it is prudent to close up the building temporarily to protect it from the weather as well as to secure it from vandalism. Therefore, it is in the best interest of the City to protect its 2 investment, prevent deterioration of the building, until it is redeveloped following construction of the Bee Branch Creek Restoration Project. 427 Rhomberg is another matter. While considered by itself, it was not determined to be a historic property worthy of preservation. Because the redevelopment of 429 Rhomberg would be better served by removing 427 Rhomberg, it is in the City's best interest to deconstruct 427 Rhomberg. The Project involves the removal (deconstruction) of the steel sided building addition and to stabilize or otherwise "mothball" the original 3 -story masonry building to a weatherproof condition that can be maintained until such time when it will be fully developed following construction of the Upper Bee Branch Creek Restoration Project. The stabilization will be done in conformance with the U. S. Department of the Interior's guidelines to ensure the building retains its eligibility for historic rehabilitation tax credits. The work includes masonry repair and tuckpointing, a complete roof membrane and insulation system removal and replacement, temporary existing opening wall infill, and other selective building envelop repair. The work also includes removal and salvage of the existing metal cornice at the top of the parapet, and steel fire escapes and ladders for potential future restoration and reinstallation. Finally, the work includes the deconstruction and removal of 427 Rhomberg, the attached, adjacent building to the west, and the infill of the common wall that currently exists between the two buildings. Planning Services Manager Laura Carstens has provided a thorough explanation of the designation of 429 Rhomberg as an Individually National Register Eligible property with local significance because of its distinctive architectural characteristics. Therefore, in order to protect the City's investment, it is prudent to close up the building temporarily to protect it from the weather as well as to secure it from vandalism. In order to proactively prevent damage to 429 Rhomberg, in order to protect the building from the weather as well as to secure it from vandalism, and in order to deconstruct the attached, adjacent building, on September 15, 2014 the City Council authorized the initiation of the public bidding process and established the date for a public hearing to consider the plans, specifications, form of contract, and estimated cost for the 429 Rhomberg Stabilization Project. The Project involves the removal (deconstruction) of the steel sided building addition and to stabilize or otherwise "mothball" the original 3 -story masonry building to a weatherproof condition that can be maintained until such time when it will be fully developed following construction of the Upper Bee Branch Creek Restoration Project. The stabilization will be done in conformance with the U. S. Department of the Interior's guidelines to ensure the building retains its eligibility for historic rehabilitation tax credits. BUDGET IMPACT The estimate of probable costs for the 429 Rhomberg Stabilization Project is as follows: Construction $ 182,817.00 Contingency 36,564.00 Engineering 36,500.00 Total Project Cost $ 255,881.00 The work will be completed using funds established for the $200 million Bee Branch Watershed Flood Mitigation Project. BACKGROUND In 2009, as part of the federally mandated Section 106 Review Process for the Bee Branch Flood Mitigation Project, the City hired an architectural/historical consultant to prepare an Iowa Site Inventory Form for the property. The attached Iowa Site Inventory Form notes that the State Historic Preservation Office has determined that the property is individually eligible to be placed on the National Register of Historic Places. DISCUSSION The property at 429 Rhomberg Avenue has been identified as an Individually National Register Eligible property with local significance because of its distinctive architectural characteristics. This determination would correlate to a high significance rating. This property is one of 107 properties that the City acquired for the Bee Branch Creek Restoration Project. The City deconstructed 82 structures, which included 27 structures of varying degrees of historical significance. None of the deconstructed structures had as high a significance rating as the structure at 429 Rhomberg Avenue. As part of the Section 106 Review Process, the City must consult with the State Historic Preservation Office regarding potential deconstruction of 429 Rhomberg Avenue. Given the high significance rating of this structure and its level of architectural integrity, the State Historic Preservation Office may be very reluctant to support its deconstruction. Narrative Description: This narrowthree-story brick corner commercial buliding was built in 1889 by 1-lugo IRuh (cornerstone in). Its casiron storefront was produced by the National Iran and Bolier Works of Dubuque. A number of features distinguish its design. First is its height. Second is the highly ornamental prominent parapet wall, half a floor in height, which splays outward at the corners. Third is the height of the main floor with its high transom lights. Finally the main facade has assymetrical fenestration. The corner location meant that the front and sidewall shared the same formal facade design. The is a single storefront with a left-hand (west) side upstairs entry. The storefronis structually present although the windows have been infilled and miniscule bar windows are centered in each bay. Three prominent corner brick columns are integrated with the cast iron work to support the main floor front. -- cast ironwork features decorative_-_rosettes,,,—1 —f -his time period. There -- stone watertable and plain unadorned flat stonework forms the Iintets and sitis of the windows and caps the storefront. Paired wlndow sets infill the west half of the main facade, whilesinglewindovvo are ' gyo�pedonth�eaatha���th�froDt. The east facade fenestration ia vertically alligned above the ground floor. There is a cast iron fire escape near the center of that sidewall. Bands of angted brick, set soldier course fashion, run just below the lintel levels on the upper two floors. The parapet combines corbelled brickwork and a pressed metal cornice line in a very elaborate design. 8. Narrative Statement of Siqnificance: The Bee Branch sewer project wildemolish the core of this potentially eligible historic district. Twenty three buildings wil) (or have) been demolished,standing. The west side of Kniest Street, between Rhomberg Avenue and East 22nd Street and the east half of the Rhomberg Avenue block, Iocated west of Johnson Street will remain. The original district, like all of the potentially eligible predominantly residential districts that were identified in the successive Dubuque architectural and historical surveys, was identified based upon the high proportion of brick buildings at this key intersection. Due to the nearly complete use of vinyl and metal siding on the frame buildings, most of these buildings could not be evaluated in terms of style or integrity. The residual west side of Kniest Street will not comprise a significant districtbeing one-sided array of eleven buildings, including on|y two or three brick buildings. The half block on Rhomberg Avenue, with fifteen buildings, lacks the scale and architectural distinctiveness to be a significant district as well. In short, it is recommended that the loss of so many buildings within the core of the originaly district, eliminates that district. There is no possibility that either of these fragments can be grouped with any other proposed districts, Washington and West 22nd in particU|ar, which is located to the northwest. Individual Building Evaluation: This building is deemed to be insignificant on architectural grounds. While the city has dozens of these isolated corner combination comrnercial/residential bUi|diOgs, this one looms out in terms of its scale, location, and ornamentation. Of particular interest is the very high first floor ceiling height. The building has likely lost its upper level windows although they might be simply covered over. The storefront has also been infilled but the structural columns are intact. It very likely Ied the way in the commercial development of this area and corner and its saloon was likely associated with the industrial presence that was immediately to the south. Individual Building History: This impressive building was built in 1889 by Hugo RuThe 1889 Perspective Map of the City of Dubuque shows frame houses on thls corner. The Hera/d (December 29, 1889) reported that Ruh had built this three-story $8,000 buildiduring 1889. It was present on the Sanborn Map as of 1891, used as a saloon and grocery, addressed as 79 Rhomberg. The building's three-story rear porch was already present. It first appears as 99 Rhomberg in the 1890-91 city directory when it housed a grocery/saloon/feed store and residence for Huga A. Ruh. Ruh was a saloon keeper by 1894, addressed as 497 Rhomberg. Previously Ruh had been located at 2003 Washington. Mrs. Mary Ruh ran the saloon as of 1899-1900, this being the final Ruh listing (497 Rhomberg). This property is one of 107 properties that the City of Dubuque acquired for the Bee Branch Creek Restoration Project. The City deconstructed 82 structures on these properties, which included 27 structures of varying degrees of historical significance. BACKGROUND In 1978, the City hired an architectural/historical consultant to prepare a community wide assessment of property to determine areas that are architecturally or historically significant. During that survey, five areas were identified to be significant. These areas was later designated as the City's five Historic Districts: Langworthy, Cathedral, Jackson Park West 11th Street, and Old Main.;, During the survey, the consultant signed a number value to different structures in these Historic Districts These values orrespond to the architectural/historical significance of a property as follows: State or National Structures felt to meet one or more of the criteria of eligibility for individual listing on the National Register of Historic Places at the state or national level. 2 City Structures felt to meet one or more of the criteria of eligibility for individual listing on the National Register of Historic Places at the local level. 3 Neighborhood Structure that are of significance when found in groups or are contributors to the significance of district felt to meet one or more of the criteria of eligibility for listing on the National Register of Historic Places (i.e. contributing structure). 429 Rhomberg Avenue — Historical Significance 4 Supportive — Structures of no particular architectural significance other than as background within districts felt to meet one or more of the criteria of eligibility for listing on the National Register of Historic Places. 5 Non -Supportive — Structures of no particular architectural significance because of recent dates of construction or because of insensitive and irreversible modifications. DISCUSSION The property at 429 Rhomberg Avenue has been identified as an Individually National Register Eligible property with local significance because of its distinctive architectural characteristics. In 2009, as part of the federally mandated Section 106 Review Process for the Bee Branch Flood Mitigation Project, the City hired an architectural/historical consultant to prepare an Iowa Site Inventory Form for the property. The attached Iowa Site Inventory Form notes that the State Historic Preservation Office has determined that the property is individually eligible to be placed on the National Register of Historic Places. This would correlate to a number 2 rating if we were to use the 1978 survey rating structure. The Historic Preservation Commission (HPC) and Planning Services Department Staff rely on our in-depth Architectural/Historic Surveys/Evaluations. These surveys are prepared for the City by qualified architectural historians who meet standards set by the Secretary of the Interior (the overseeing federal body who regulates historic preservation). These surveys help identify properties that are architecturally and historically significant. They assist the HPC and Planning Services Department to make informed decisions when reviewing a property for a Design Review, Section 106 Review, National Register Eligibility, demolition, or disaster response. If a situation would arise that there was no survey information available on a property, the Planning Services Department would prepare a detailed Iowa Site Inventory Form and submit it to the State Historic Preservation Office for their review and comment. This process can take a while to prepare the detailed form and the State Historic Preservation Office has a mandatory 30 day review period. Its cast iron storefront was produced by the National Iron and Boiler Works of Dubuque. A number of features distinguish its design. First is its height. Second is the highly ornamental prominent parapet wall, half a floor in height, which splays outward at the corners. Third is the height of the main floor with its high transom lights. Finally the main facade has assymetrical fenestration. The corner location meant that the front and sidewall shared the same formal facade design, The building is a single storefront with a left-hand (west) side upstairs entry. The storefront is structually present although the windows have been infilled and miniscule bar windows are centered in each bay. Three prominent corner brick columns are integrated with the cast iron work to support the main floor front The cast ironwork features decorative rosettes, typical of this time period. There is a stone watertable and plain unadorned flat stonework forms the lintels and sills of the windows and caps the storefront. Paired window sets infill the west half of the main facade, while two single windows are grouped on the east half of the front The east facade fenestration is vertically alligned above the ground floor. There is a cast iron fire escape near the center of that sldewall. Bands of angled brick, set soldier course fashion, run just below the lintel levels on the upper two floorshe parapet combines corbelled brickwork and a pressed metal cornice line in a very elaborate design, 8. Narrative Statement of S' II if Ica nc e: The Bee Branch sewer project will demolish the core of this potentially eligible historic district. Twenty three bulldings will (or have) been demolished, leaving twenty-six standing. The west side of Kniest Street, between Rhomberg Avenue and East 22"© Street and the east half of the Rhomberg Avenue block, located west of Johnson Street will remain. The original district like all of the potentially eligible predominantly residential districts that were identified in the successive Dubuque architectural and historical surveys, was identified based upon the high proportion of brick buildings at this key intersection. Due to the nearly complete use of vinyl and metal siding on the frame buildings, most 01 these buildings could not be evaluated in terms of style or integrity, The residual west side of Kniest Street will not comprise a significant district, being a one-sided array of eleven buildings, including only two or three brick buildings. The half block on Rhomberg Avenue, with fifteen buildings lacks the scale and architectural distinctiveness to be a significant district as well. In short, il is recommended that the loss of so many buildings within the core of the originaly district, eliminates that district. There is no possibility that either of these fragments can be grouped with any other proposed iiistricts, Washington and West 22nu in particular, which is located to the northwest. Individual Building Evaluation: This building is deemed to be individually significant on architectural grounds. While the city has dozens of these isolated corner combination commercial/residential buildings, This one looms out in terms of its scale, location, and ornamentation, Of particular interest is the very high first floor ceiling height. The building has likely lost its upper level windows although they might be simply covered over. The storefront has also been infilled but the structural columns are intact. It very likely led the way in the commercial development ot this area and corner and its saloon was likely associated with the industrial presence that was immediately to the south, Individual Building History: This impressive building was built in 1889 by Hugo Ruh (nameidatestone) The 1889 Perspective Map of the City of Dubuque shows frame houses on this corner. The Herald (December 29, 1889) reported that Ruh had built this three-story $8,000 building during 1889. It was present on the Sanborn Map as of 1891, used as a saloon and grocery, addressed as 79 Fihornberg. The building's three-story rear porch was already present. It first appears as 99 Rhomberg in the 1890-91 city directory when it housed a grocery/saloon/feed store and residence for Huga A. Ruh. Ruh was a saloon keeper by 1894 addressed as 497 Eihomberg. Previously Ruh had been located at 2003 Washington. Mrs. Mary Ruh ran the saloon as of 1899-1900, this being the final Ruh listing (497 Fihomberg). Charles Griese was here 1909-10 (was at 516 Rhomberg as of 1908). He operated a repair shop there but resided at 2404 Rhomberg. In 1908 he was at 516 Rhornberg. 9. Time and Place Sealed Proposals Will be Opened and Considered: Sealed proposals will be opened and bids tabulated at 2:00 p.m. on October 14, 2014, at City Hall, 50 West 13th Street, Dubuque, Iowa, for consideration by the City Council (Council) at its meeting on October 20, 2014. The City of Dubuque, Iowa, reserves the right to reject any and all bids. Time for Commencement and Completion of Project: Work on each improvement shall be commenced within 10 days after the Notice to Proceed has been issued and shall be fully completed by June 1, 2015. Bid Security: Each bidder shall accompany its bid with a bid security as security that the successful bidder will enter into a contract for the work bid upon and will furnish after the award of contract a corporate surety bond, acceptable to the governmental entity, for the faithful performance of the contract, in an amount equal to one hundred percent of the amount of the contract.
