City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Port of Dubuque Storm Sewer Extension - Phase V Project, as completed by
Tschiggfrie Excavating in the final contract amount of $129,037.42, which is an 8.9%
increase from the original contract. The increase was primarily due to additional costs
associated with coordinating construction of the storm sewer with the development of
the McGraw-Hill site that was proceeding concurrently. Sufficient funds exist in the Port
of Dubuque Utility Improvements CIP.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the Port of
Dubuque Storm Sewer Extension - Phase V Project.
BACKGROUND
The Port of Dubuque Storm Sewer Extension - Phase V Project involved the construction of
approximately 500 feet of 60-inch diameter storm sewer from Bell Street to the west between
the McGraw-Hill development and 5th Street.
DISCUSSION
The Port of Dubuque Storm Sewer Extension - Phase V Project was completed by Tschiggfrie
Excavating Co. of Dubuque, Iowa, in the final contract amount of $129,037.42, which is an
8.90% increase from the original contract in the amount of $118,492.40. The increase was
primarily due to additional costs associated with coordinating the construction of the storm
sewer with the development of the McGraw-Hill site that was proceeding concurrently. The
construction of the storm sewer prevented access to the McGraw-Hill site from both Bell Street
and 5th Street. Therefore, a temporary access road was constructed to the McGraw-Hill site for
use during the construction of the storm sewer. Additional costs were associated with the time
and materials necessary to re-pave Bell Street in the winter. The winter paving was done to
provide full access to the McGraw-Hill site as soon as reasonably possible.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment of the
contract amount of $129,037.42 to the contractor for the Port of Dubuque Storm Sewer
Extension - Phase V Project.

The project cost summary for the Port of Dubuque Storm Sewer Extension - Phase V Project is

to authorize the payment of the contract amount of $129,037.42 to the contractor for the Port
of Dubuque Storm Sewer Extension - Phase V Project.

ACCEPTING THE PORT OF DUBUQUE STORM SEWER EXTENSION -
PHASE V PROJECT AND AUTHORIZING THE PAYMENT OF THE
CONTRACT AMOUNT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the Port of Dubuque Storm Sewer
Extension - Phase V Project (the Project) has been completed and the City Manager
has examined the work and filed a certificate stating that the Project has been
completed according to the terms of the Public Improvement Contract and that the City
Manager recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Manager is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Port of Dubuque Storm Sewer Extension - Phase V Project appropriation for the
contract amount of $129,037.42 less any retained percentage provided for therein as
provided in Iowa Code chapter 573, and to pay such retainage only in accordance with
the provisions of Iowa Code chapter 573.
