Van Milligen, City Manager SUBJECT: Acceptance of Public Improvements in Cedar Lake Plaza City Engineer Gus Psihoyos is recommending acceptance of the public improvements that the developers, Richard V. and Charlene L. Hansel, have recently completed in Cedar Lake Plaza. Maintenance of said improvements shall be the responsibility of the owner, Richard V. and Charlene Hansel Living Trust, for a period of two years from the date of acceptance. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer v~ SUBJECT: Acceptance of Public Improvements in Cedar Lake Plaza INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements which the developers, Richard V. and Charlene L. Hansel, have recently completed in Cedar Lake Plaza. BACKGROUND As a condition of subdivision plat approval through Resolution No. 287-01, the developers of Cedar Lake Plaza were required to install certain improvements including street paving with curb, sanitary sewer main, sewer pumping station, watermain, storm sewers and catch basins, and boulevard street lighting and to dedicate these improvements to the City upon completion. In addition, the developers were required to install and maintain a private detention facility to serve the development. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On February 20, 2004, Jeffrey S. Hansel requested City's acceptance of the improvements in Cedar Lake Plaza. Upon inspection by the City, it has been determined that all of the public improvements required by Resolution No. 287-01 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION I would, therefore, recommend that the City Council accept the public improvements. Maintenance of said improvements shall be the responsibility of the owner, Richard V. and Charlene Hansel Living Trust, for a period of two (2) years from the date of acceptance by the City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the improvements. Prepared by Ronald J. Turner, PLS RESOLUTION NO. 379-07 ACCEPTING PUBLIC IMPROVEMENTS IN CEDAR LAKE PLAZA Whereas, pursuant to Resolution No. 287-01, certain public improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and sanitary sewer pumping station were installed by the developer of Cedar Lake Plaza; and Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public improvements in Cedar Lake Plaza be and the same is hereby accepted. Section 2. That the maintenance of the privately-owned detention facility shall remain the responsibility of the developer. 2001: Section 3. In accordance with an agreement with the developer dated July 30, a. "The City will pay for all day-to-day operational costs, including electrical costs of the pumping station. Major repair costs, beyond day-to-day operational costs, shall be assessed to Cedar Lake Plaza property owners, their successors, and assignees and paid annually upon receipt of a statement from the City." b. The storm sewer extending beyond the right-of-way line of Cedar Cross Road shall remain private and be maintained by the developer, their successors, and assignees. Section 4. That maintenance of said improvements shall be the responsibility of the contractor and developer for a period of two (2) years from this date.
