The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Tom Berger, Dubuque Firefighters Task Force, representing the applicant, spoke in favor of
the request. He reviewed the layout of the subdivision and reasons for requesting the
proposed street be named Public Safety Way.
Staff reviewed the submitted plat noting that the property is designated as a primary growth
area and that both the Julien Care Facility and Fire Training Center are served with City
sanitary sewer and water. Staff noted the proposed street name is non-compliant because
it is not named the same as the street directly across Seippel Road, which is Humke Road.
Staff noted the County has approved the name, Public Safety Way.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that while there are current
examples in the City where street names don't match across intersections, that it is not a
reason to continue the practice. Commissioners discussed naming the new street Humke
Road for consistency, as was done in naming Chavenelle Drive across the Northwest
Arterial in Medical Associates Campus.
Recommendation
By a vote of 4 to 0 the Zoning Advisory Commission recommends that the City Council
approve the request, subject to the proposed roadway being named Humke Road or Humke
Court. Naming the proposed street to Public Safety Way requires a waiver of Section 42-
20(h) of the Subdivision Regulations.
A simple majority vote is needed for the City Council to approve the request, or to override
the Commission and waive the Subdivision Regulations.

RESOLUTION NO. 398 - 07
RESOLUTION APPROVING THE FINAL PLAT OF JULIEN CARE PLACE IN DUBUQUE
COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Julien Care Place;
and
Whereas, the Final Plat has been examined by the Zoning Advisory Commission and
has its approval endorsed thereon, and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Final Plat of Julien Care Place is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City
of Dubuque, Iowa, upon said final plat, provided the owners of said property herein named,
execute their written acceptance hereto attached agreeing:
a) A public street (Public Safety Way) be constructed to a 37-foot width and 60-
foot right-of-way in accordance with the approved improvement plans.
Section 2. That in the event Dubuque County fails to execute the acceptance
within 180 days after the date of this Resolution, the provisions hereof shall be null and void
and the approval of the plat shall not be effective.

Recommended Motion: Motion to approve the submitted final plat of Julien Care Place
as it is in substantial compliance with the City of Dubuque Subdivision Regulations.
Conformance with Comprehensive Plan: Designation of the subject property on the
Future Land Use Map is for mixed use development. This project implements the
Comprehensive Plan's Land Use Element: Goal 3.1, 3.3, 7.2, 7.3, 10.3, 10.5 and 10.6.

Utilities: Currently, the Julien Care Facility and the Fire Training Center are
connected to City water.
Traffic Patterns: Seippel Road is a County roadway and based on 2005 IDOT
counts carries approximately, 4,180 vehicles trips a day.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development of
the remaining property in this final plat.
Adjacent Properties: Staff does not anticipate any significant impact to adjacent
properties.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat of Julien Care Place is in Dubuque County
adjacent to the City of Dubuque Industrial Center West. The City and County are jointly
reviewing the plat. The plat is comprised of three lots -Lot 1 being that of the existing
Julien Care Facility, Lot 2 is the location of the new Fire Training facility, and Lot 3 is
existing property used by the County for road maintenance.
The submitted final plat includes a new public street to be named Public Safety Way.
Dubuque County will maintain the street and will be built with a 60-foot easement for
right-of-way and 37-foot of paving which meets the City's collector street standard.
Access from Lot 2 and 3 is to the proposed Public Safety Way, while Lot 1, Julien Care
Facility, has existing street access to Seippel Road.
Section 42-20(h) of the City of Dubuque Subdivision Regulations requires that new
streets that are aligned with existing streets will bear the name of the existing street.
The proposed roadway is across from Humke Road and to name the new street Public
Safety Way will require that the Zoning Advisory Commission waive Section 42-20(h).
This issue was raised once before when the developers of Associates Park wanted to
name the street opposite Chavenelle Road, Associates Drive. The City Zoning
Advisory Commission and City Council declined to waive Section 42-20(h} in that
situation.
Currently, both Julien Care Facility on Lot 1 and the Fire Training Center on Lot 2 are
served by City water. Laterals were extended and connected to the City's 16" water
main currently located within the Seippel Road right-of-way. The Water Department is
requiring that an easement for a future water main be provided along the north side of
Public Safety Way for future service to properties when annexed.

The City Engineering office is requiring that the necessary easements be provided for
extension of sanitary sewer service when the property is annexed to the City of
Dubuque. The City's existing sanitary sewer main that serves the Dubuque Industrial
Center is located to the east of the subject property. The Julien Care Facility is
currently tied into the system, as previously they directed their sanitary sewer flow to a
lagoon system that was taken out as part of the City's development of the Dubuque
Industrial Center West. Lot 2, which contains the Fire Training Facility, is located at an
elevation that uses a pump to access City sanitary sewer main.
The subject property is located in a primary growth area as established in the City's
Fringe Area Development Policy. Subdivisions proposed within primary growth areas
are required to meet City standards for subdivisions. The subject subdivision meets the
requirements for a City subdivision. The proposed Public Safety Way will be a County-
maintained street built to City standards, and once the property is annexed into the City,
maintenance of that street will be transferred to the City of Dubuque.
