INTRODUCTION
The enclosed resolutions provide for the acceptance of the construction contract for the Asphalt
Overlay Project- Curb Ramps Phase One.
BACKGROUND
This was a project to replace 20 defective access ramps in the Coates Street, Collins/Gandolfo
Street, Croydon Crest and Cambridge Court areas in conjunction with the Public Works Asphalt
Overlay Program. The enclosed resolutions provide for the acceptance of the construction
contract for the Asphalt Overlay Project Curb Access Ramps Phase One.
Due to recent United States Department of Justice (USDOJ) rulings governing the installation of
curb access ramps, and in an effort to comply with those rulings the engineering and the public
works departments have teamed up to address the issues of which ramps are to be replaced,
the design and placement of these ramps and documenting the newly placed compliant ramps
to be entered into the City's transition plan in conjunction with Public Works yearly asphalt
overlay program.
DISCUSSION
The Asphalt Overlay Project- Curb Access Ramps Phase One received two competitive bids
from: Midwest Concrete with a bid of$46,243.88 at 8.34% over the engineers estimate and from
Drew Cook & Sons Excavation with a bid of$66,281.40 at 55.28% over the engineers estimate.
The Asphalt Overlay Project- Curb Access Ramps Phase One was completed by Midwest
Concrete of Peosta, Iowa in the final contract amount of$67,487.32 which is 45.94% over the
contract amount of$46,243.88. The project cost increase is due to eight additional ramps on
Rosemont Street; added to assure completion of the asphalt overlay and ramps prior to the
beginning of the school year; and additional curb on Coates Street and on Collins Street added
due to the crumbling of the existing curb.
The eight additional ramps were originally slated for Phase Two of the Asphalt Overlay Project-
Curb Access Ramps which included the Jefferson Junior High School area in the bid. The
availability of the contractor to complete these eight additional ramps in a timely manner in
coordination with the Public Works Department's milling and overlay schedule was the factor
which determined the additional ramp work to this project.
The average cost per ramp on the Phase one curb ramp replacement was $2410.26, in keeping
with the pricing the engineering department has observed the last three years.

RESOLUTION NO. 339-14
ACCEPTING THE ASPHALT OVERLAY PROJECT CURB ACCESS RAMPS PHASE
ONE AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Asphalt Overlay Project Curb
Access Ramps Phase One (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Asphalt Overlay Project Curb Access Ramps Phase One appropriations for the contract
amount of $67,487.32, Tess any retained percentage provided for therein as provided in
Iowa Code chapter 573, and to pay such retainage only in accordance with the
provisions of Iowa Code chapter 573.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that he
has inspected the Asphalt Overlay Project Curb Access Ramps Phase One, that the
Project has been performed in compliance with the terms of the Public Improvement
Contract, and that the total cost of the completed work is $74,887.32.
