INTRODUCTION
The enclosed resolutions provide for the acceptance of the construction contract for the
Asphalt Overlay Project - Curb Ramps Phase Two.
BACKGROUND
This was a project to replace 19 defective access ramps in the Merz Street, Viola
Street, Eagle Street, and Althauser Street areas in conjunction with the Public Works
Asphalt Overlay Program. The enclosed resolutions provide for the acceptance of the
construction contract for the Asphalt Overlay Project - Curb Access Ramps Phase Two.
Due to recent United States Department of Justice (USDOJ) rulings governing the
installation of curb access ramps, and in an effort to comply with those rulings the
engineering and the public works departments have teamed up to address the issues of
which ramps are to be replaced, the design and placement of these ramps and
documenting the newly placed compliant ramps to into the City's transition plan in
conjunction with Public Works yearly asphalt overlay program.
DISCUSSION
The Asphalt Overlay Project - Curb Access Ramps Phase Two received one bid from:
Midwest Concrete of $65,382.00 at 26.03'/0 over the engineers estimate.
The Asphalt Overlay Project - Curb Access Ramps Phase Two was completed by
Midwest Concrete of Peosta, Iowa in the final contract amount of $62,563.37 which is
4.3% below the contract amount of $65,382.00.
The average cost per ramp on the Phase two curb ramp replacement was $3,475.74
due to the topography of the area and the need to utilize the maximum amount of
removal and installation to meet the slopes mandated by the current ADA standards.

RESOLUTION NO. 340-14
ACCEPTING THE ASPHALT OVERLAY PROJECT CURB ACCESS RAMPS PHASE
TWO AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Asphalt Overlay Project Curb
Access Ramps Phase Two (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Asphalt Overlay Project Curb Access Ramps Phase One appropriations for the contract
amount of $62,563.37, less any retained percentage provided for therein as provided in
Iowa Code chapter 573, and to pay such retainage only in accordance with the
provisions of Iowa Code chapter 573.
